for the Annual street Resurfacing Program and Appurtenant
Work and Set a Public Hearing for May 24, 1994
Introduction
This report recommends that the city council approve the formation
of an assessment district to construct concrete gutters, resurface
streets, repair damaged sidewalks, driveways and curbs, and remove
damaged pavement in parkway areas. These improvements are in
conjunction with the FY 1993-94 street Resurfacing Program. This
report also recommends that the City council adopt the attached
Resolution of Intention and set a public hearing for May 24, 1994,
to establish the appropriate assessment district.

The Street Resurfacing Program includes gutter construction, street
resurfacing, slurry sealing, parkway pavement removal, repair of
curb and sidewalks, and construction of driveways at various
locations in the City. The criteria used to determine which
streets are to be resurfaced and the method of repair includes:
age, surface and subsurface conditions, complaints received, type
of use (Le., commercial or residential), current traffic volume,
and projected change of use or traffic volume of the streets.

In accordance with a 1979 City council policy, residential
properties are assessed one half the cost of removal and
replacement of damaged curbs, sidewalks, driveways and the removal
of damaged parkway pavement. Commercial properties are assessed
the full cost of repair of this work.
Residential properties are not assessed for new gutter construction
or street resurfacing; however, commercial and industrial property
owners are assessed the full cost of new gutter construction and
street resurfacing. The proposed assessments are designed so that
each commercial and industrial property owner pays the same unit
cost regardless of the width of the street on which their property
fronts. Consistent with the present policy for assessing
commercial and industrial properties, this assessment will be a
cash assessment and no bonds will be issued. The total estimated
assessment for a commercial or industrial property owner with a 50
foot lot, would be $925 for resurfacing, and $1,150 for the gutter
construction.

The cost includes construction, staff time, engineering, surveying,
posting and mailing of notices, construction management and
inspection time.

The assessment district will be administered in accordance with the
procedures set forth in the Improvement Act of 1911 of the
California streets and Highways Code and the Government Code.
Budqet/Financial Analysis
The assessment district will generate for FY 1994-95 revenues of
approximately $80,000 for street resurfacing and gutter
construction to be deposited 1n revenue account number 01-500-402-
00000-0124-10000, and the amount of $60,000 for sidewalk, driveway
and curb repairs to be deposited in revenue account number 01-500-
421-00000-0179-10000. The estimated cost for this street
resurfacing is $615,000. There is $615,000 budgeted in various ClP
accounts for this program:

Recommendation
It is recommended that the City Council:

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING ON MAY 24, 1994,
FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION OF
CONCRETE GUTTER, STREET RESURFACING, SIDEWALK, DRIVEWAY
AND CURB REPAIR AND THE REMOVAL OF DAMAGED PAVEMENT IN
PARKWAY AREAS AND APPURTENANT WORK, IN CONJUNCTION WITH
THE FY 1993-94 STREET RESURFACING PROGRAM AS SHOWN ON
CITY DRAWING NO. 6061, IN THE CITY OF SANTA MONICA
WHEREAS, the city Council of the City of Santa Monica proposes
to initiate proceedings under the Improvement Act of 1911 and
Government Code for the construction of concrete gutters, street
resurfacing, repair of damaged s1dewalks, driveways and curbs, and
the removal of damaged pavement in parkway areas; and
WHEREAS, Section 19 of Article XVI of the California
Constitution provides that certain specified debt limitation and
majority protest provisions shall not apply if, after the giving of
such reasonable notice by publication and posting and the holding
of such public hearing as the City Council of the City of Santa
Monica shall have prescribed, the City council, by no less than
four-fifths vote of all members thereof, finds and determines that
the public convenience and necessity requlre the proposed
1mprovements to be made; and
WHEREAS, Streets and Highways Code Section 2804 provldes that
the "Special Assessment, Investigation, Limitation and Majority

Protest Act of 1931" shall not apply to any proceeding otherwise
subject thereto when said improvement proceeding is by a charter
city and said city has complied with the provisions of Section 19
of Article XVI of the California Constitution: and
WHEREAS, the city of Santa Monica is a charter city of the
state of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The city Council proposes to initiate proceedings
for the construct1on of concrete gutters, street resurfacing,

under the Improvement Act of 1911, which is contained in Division
7 and Chapter 22 of the streets and Highways Code of the state of
California.

subsurface conditions, complaints received, type of use (Le. ,
commercial, industrial or res~dential), current traffic volume, and
projected change of use or traffic volume. The proposed work or
improvements in the opinion of City Council of the city of Santa
Monica is of more than local or ordinary public benefit, and the

Removal
The district affected by the proposed work of improvements is shown
upon a certa1n map indicating the exterior boundary thereof, which
said Draw1ng No. 6061-A is on file 1n the office of the City
Engineer. The map hereby 1S referred to and shall govern for all
deta11s as to the extent of said assessment district. The
assessment district includes 1n general the lots and parcels
described in section 1 above but reference hereby is made to said
Drawing for all details as to the extent of said assessment
district and for any variatlon between the last mentioned general
description and the extent of said assessment distr1ct as shown on
said map.
SECTION 4. Notice is hereby given that on Tuesday, the
24th day of May, 1994, at 6:30 P.M., in the City Counc1l Chambers
located in City Hall, 1685 Main Street, Santa Mon1ca, california,

there shall be a public hear1ng before said City Council for the
purpose of determining whether the public convenience and necessity
require the above-described improvements and for the purpose of
allowing any and all persons having any objections to the proposed
work or improvements to appear and show cause why the said proposed
work or improvements shall not be carried out in accordance with
said Resolution of Intention. Inquiries concerning this public
hearing should be directed to the Department of General services,
Division of Engineering, at 458-8721.
SECTION 5. The City Clerk shall give notice of the hearing
by posting a copy of this Resolution ~n the manner described by the
streets and Highways Code Sections 5065 and 5616 and by publication
as hereinafter provided. Any interested person may make protest
against the proposed improvement in writing filed with the City
Clerk at any time not later than the hour set for the hearing in
the manner provided by the streets and Highways Code Section 5220.
SECTION 6. The Superintendent of Streets shall cause to be
conspicuously posted along the line of said contemplated work or
improvements and also along all the open streets within said
district, notice of the passage of this Resolution of Intention in
the manner and form prescribed by law.
The City Clerk is directed to mail notices 1 pursuant to
Government Code Section 54954.91 in the manner and form prescribed
by law1 of the adoption of this Resolution to all persons owning

commercial and industr1al property in the hereinbefore described
assessment distr1ct, whose names and addresses appear on the last
equalized assessment roll for the city taxes or as known to the
office of the City Engineer.
SECTION 7. The city Clerk is d1rected to publish this
Resolution, in accordance with Government Code section 6066, in The
Outlook once a week for two weeks with at least five days
intervening between the first date and second date of publication.
The f1rst publication 1S to be made not less than 45 days prior to
the date of the above public hearing.
SECTION 8. Pursuant to Public Contract Code section 20433 t
the City Council hereby finds that it is not in the public interest
to allow property owners to contract for the street resurfacing and
gutter construction improvements and thereby the City shall be
responsible for awarding and admlnlsterlng the construction
contract for this district.
SECTION 9. The City Clerk shall certify to the adoption of
th1s Resolut1on, and thereafter the same shall be in full force and
effect.

INTRODUCTION
This report recommends that the City CounCll approve a resolution
authorizing the Clty to file an applicatlon for 1994 Callfornla
Certlfled Local Government ( CLG ) Grant funds for the update of
the Clty Historlc Resources Inventory. ThlS resolutlon lS
contalned in Attachment A.
BACKGROUND
On March la, 1992 the City Counell approved by resolutlon the
Clty'S admlssion into the Callfornla State Department of Parks
and Recreatlon Office of Historlc Preservation Certified Local
Government HistorlC Preservation Program. The purpose of the
program lS to allow local governments to partlclpate ln
Californla's statewide preservatlon program. The Clty of Santa
Monlca was certlfled by the State Offlce of Historic Preservatlon
on June 9, 1992.

As a member of this program, the C1ty 1S respons1ble for
malntaining a historic preservatlon comm1SSlon, surveYlng local
h1storlc propert1es, enforcing state or local preservation laws,
and to provide public participat10n In the local preservatlon
program.
The Clty lS ellglble to apply to the State for grant funds that
may be used for additional survey work, Natlonal Reglster
nomlnatlons, historical preservatlon act1vlt1es, and training and
educat10nal programs
GRANT APPLICATION
The state has a total of $125,000 avallable for local grants.
ThlS amount lS to be dlv1ded among all Cltles applY1ng for grant
funds.
Staff has prepared an appl1catlon request1ng $18,720 from the
State to update the Clty Historlc Resources Inventory to account
for earthquake damaged buildings 1n the City The grant requires
that the City provlde 40% matchlng funds Wh1Ch would total
$12,950 The 40% requ1red by the Clty will be made up from 1n-
kind services lncludlng tlme assoclated w1th stafflng the
Landmarks Coroffilss1on The in-kind match, therefore, does not
require addit10nal C1ty funds or stafflng. The Clty H1storic
Resources Inventory Update proJect must be performed dur1ng the
grant perlod of October I, 1994 through August 31, 1995.

BUDGET/FINANCIAL IMPACT
If approved by the State, the grant w1ll provlde $18,720 for the
update of the C1ty Historic Resources Inventory and approprlate
revenue and expendlture budget charges to recognize this revenue
and authorlzed expenditures w1ll be made as part of the FY
1994/95 proposed budget or FY 1993/94 year end budget report.
The total of $12,950 matching requlrement 1S based on eXlsting
staff1ng services to the Landmarks Commission
RECOMMENDATION
It is recommended that the C1ty Councll approve the attached
resolut1on for fundlng the update of the Clty Hlstoric Resources
Inventory.

PARKS AND RECREATJ:ON OP THE STATE OF CALIFORNIA
FOR HATCHING FUNDS UNDER THE NATIONAL HISTORIC
PRESERVATION GRANTS-IN-AID PROGRAM
WHEREAS, the Congress of the United states has authorized
under Public Law 89-665 the establishment of the National Historic
Preservation Grants-in-Aid Program (hereinafter, tlNHP Grants
Program"), providing matChing funds to the state of California and
its eligible subdivisions for historic preservation survey,
registration, and planning; and
WHEREAS, under Federal law the Department of Parks and
Recreation of the state of California (hereinafter, lithe state
Department of Parks and Recreation") is responsible for the
administration of the NHP Grants Program within the State and for
establishing regulations and procedures governing applications by
local governments for local historic preservation programs; and
WHEREAS, the City of Santa Monica is a Certified Local
Government under the regulations and procedures established by the

state Department of Parks and Recreation and is eligible to apply
for and receive an NHP Grant for local historic preservation
programs; and
WHEREAS, the regulations and procedures established by
the state Department of Parks and Recreation require Certified
Local Government applicants for a NHP Grant to approve by
resolution any applications for matching funds and to certify the
availability of local matching funds prior to applying for a Grant;
and
WHEREAS, on February 14, 1994, the Landmarks Commission
of the City of Santa Monica recommended to the City Council
approval of an NHP Grant for the Historic Resources Inventory
Update Project;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION l. To approve the filing of an application for
a National Historic Preservation grant for the Historic Resources
Inventory Update Project; and
SECTION 2. To appoint the Director of the Land Use and
Transportation Management Department, or her authorized deputy, as
the agent to coordinate, process, and execute all contracts,
agreements, amendments and ancillary documents associated with the
