Tachiki, Chief Deputy City Attorney SUBJECT: City Council Options and Resolutions Relating to the Referendum Petitions Against Resolution Numbers 8685 (CCS) and 8686(CCS) This Staff Report transmits to the city Council six resolutions for its consideration in connection with the Referendum Petitions filed against Resolution Number 8685 (CCS), which adopted the civic Center Specific Plan and statement of Overriding Considerations, and Resolution Number 8686 (CCS), which amended the Land Use and circulation Element of the City's General Plan. Following the City Council's approval of the two resolutions on November 23, 1993, a referendum petition was circulated against both of the resolutions adopted by the City Council. These referendum petitions have now been certified as having the requisite number of valid signatures. CITY COUNCIL OPTIONS REGARDING THE REFERENDUM Since the referendum petitions have been certified as having the requisite number of valid signatures, the Elections Code provides the City Council with two choices: (1) repeal the two HAll-B_ q,A SUMMARY OF RESOLUTIONS 1. Resolution Repealinq Resolutions Numbers 8685 (CCS) and 8686 (CCS). This Resolution would repeal Resolution Numbers 8585 (CCS) and 8686 (CCS), which is one of the options that the city council can take in response to the Referendum Petition against Resolution Numbers 8685 (CCS) and 8686 (CCS). If the City council passes this Resolution, no other Resolution need be adopted with respect to this matter. No election will be held. 2. Resolution Callina and Givina Notice of the SDecial MuniciDal Election Submittina to the Voters a Referendum Directed Aaainst Resolution Numbers 8685 (CCS) and 8686 (CCS). This Resolution provides that a Special Municipal Election shall be called for and takes various actions to facilitate the election. The city council must pass this Resolution if it wishes to place the Referendum regarding Resolution Numbers 8685 (CCS) and 8686 (CCS) before the voters at an election other than the next regular municipal election. In passing this Resolution, the City council must also select an election date. This Resolution also submits to the voters the Referendum against Resolution Numbers 8685 (CCS) and 8686 (CCS), which the City council adopted on November 23, 1993. 3. Resolution Reauestina the Los Anaeles County Board of Supervisors to Consolidate a Special Municipal Election with the - - statewide Direct Primary Election To Be Held On June 7, ~994. If the City Council decides to set a special municipal election and consolidate it with the statewide direct primary election on June 7, 1994, the adoption of this resolution would act as an official request for the action by the Los Angeles County Board of Supervisors to facilitate the consolidation. 4. Resolution Reauestina Election Services from the County. This Resolution authorizes the city Clerk to request various election services from the County to assist in such tasks as distributing sample ballots. 5. Resolution Authorizing city councilmernbers to File Written Arauments Reaardina the Referendum. The purpose of this Resolution is to give members of the city Council an opportunity to submit arguments against the Referendum regarding Resolution Numbers 8685 (CCS) and 8686 (CCS). By virtue of Elections Code Sections 4015 and 4057, the City councilor its members authorized by the City Council can submit arguments against a ballot measure. If the city Council desires to permit its members to submit arguments against any proposition, the members so authorized should be inserted in sections 1 and 2. Elections Code section 4015.5 authorizes the submittal of rebuttal arguments if the legislative body, not later than the day on which it calls an election, adopts the provisions of Elections resolutions; or (2) set an election on the resolutions. 1 If the matter is set for an election, under Elections Code section 4055, the City Council shall submit the matter to the voters: either at the next regular municipal election occurring not less than 88 days after the order of the legislative body or at a special election called for the purpose not less than 88 days after the order the of the legislative body. The City Council has the option of setting the referendum. election for the next municipal election in November, 1994 or at a special election not less than 88 days beyond its order. Assuming City Council action on March 8, 1994, the special election could be set for June 6, 1994 or some date thereafter. The Statewide primary Election is currently set for Tuesday, June 7, 1994, and a special municipal election could be consolidated with that election. 1 It is also important to note that pursuant to Elections Code Section 4051, the filing of the Referendum petition suspends the effective date of the resolutions. If the city Council repeals the resolutions or if it fails at an election to obtain a majority of the votes, under Elections Code section 4055, the City council cannot again enact the resolutions, or substantially similar resolutions, for a period of one year from the date of repeal or voter disapproval. Code section 4015.5. In connection with the 1981 General Municipal Election, the City Council adopted Resolution Number 6180 (CCS) adopting the provisions of Elections Code Section 4015.5. The resolution provided in Section 2: "That the provisions of Section 1 shall apply at the next ensuing municipal election and at each municipal election thereafter, unless repealed by the legislative body." Thus, unless the city council repeals Resolution Number 6180 (CCS), the authors of the argument in favor of or against the Referendum will be permitted to prepare a rebuttal to any argument against their position. 6. Resolution Authorizinq The City Clerk To Obtain Specified services To The City Relating To The Conduct Of The Municipal Election. This resolution would permit the city Clerk to obtain services from the firm of Martin & Chapman Co. for all necessary services and supplies which cannot be obtained from the County in a consolidated or concurrent election. RECOMMENDATION It is respectfully recommended that the city Council either repeal Resolution Numbers 8685 (CCS) and 8686 (CCS) or call an election in the manner required by law. Pursuant to Elections Code section 22003, the City Council requests that the Board of supervisors of the County of Los Angeles permit the Registrar of Voters to provide the following serV1ces to the city to the extent determined necessary by the City Clerk: (1) prepare and furnish to the City of Santa Monica for use in conducting its Special Municipal Election the computer record of the names and addresses of eligible reg1stered voters in the City of Santa Monica in order that the City of Santa Monica may print labels to be attached to self-mailer sample ballot pamphlets; (2) furnish to the City of Santa Monica printed indices of the voters to be used by the prec1nct board at the polling place; (3) make available to the City of Santa Monica additional election equipment and assistance according to state law; and (4) such other services as may be provided and deemed necessary to reduce the expense and administrative burden of the election. SECTION 2. The City of Santa Monica shall reimburse the County of Los Angeles for serV1ces performed when the work is completed and upon presentation to the City of Santa Monica of a properly approved bill. SECTION 3. The Cl ty Clerk is directed to forward without delay to the Board of Supervisors of the County of Los Angeles and to the Registrar of Voters a certified copy of this Resolution. - 2 - SECTION 4. WHEREAS, in the course of conduct of the election it is necessary for the City Clerk to obtain the services of a professional election supplier; and WHEREAS, all necessary expenses in performing these services shall be paid by the city of Santa Monica, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE, DECLARE AND ORDER AS FOLLOWS: SECTION 1. That the firm of Martin & Chapman Co., being a sole source, is approved to furnish to the City all necessary services and supplies authorized by the city Clerk to conduct either a concurrent or consolidated election, consisting of the following services: - 1 - 1. provide a Calendar of Election Events setting out dates and requirements of the Election Code. 2. Provide suggested forms of resolutions and notices required for the election. 3. Provide necessary ballots, supplies and instructions for voting in the precinct and for absentee voting. 4. Provide Self-Mailer Sample Ballot & Voters Pamphlet with candidates statements, measures and absent voter application. S. Prepare and attach special labels to Self-Mailer pamphlet and arrange for delivery to the post office. 6. Have a qualified person available by telephone or in person at all times to assist the City Clerk should problems arise at any time during the election process. 7. Furnish general guidance throughout the election. SECTION 2. That the City shall pay Martin & Chapman Co. for all election supplies and services rendered. In the event any election supplies requested by the City and furnished by Martin & Chapman Co. are not correct, or contain errors so that the same are not acceptable to or usable by the City, there shall be no charge therefor made upon the City. SECTION 3. That Martin & Chapman Co. shall submit an itemized invoice to the city detailing the supplies furnished. The City shall pay all sums due and owing within 15 days of the receipt of the statement. - 2 - SECTION 4. That the total amount of these services shall not exceed $100,000. SECTION 5. That the City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
