INTRODUCTION
On February 8, 1994 the Clty Council adopted Ordlnance 1727 (CCS) ,
WhlCh established the requirement to obtain a Condltlonal Use
Permlt (CUP) for automobile dealershlps, auto repalr facllltles in
the M1 Zone, and minl-marts, lf such uses are within 100 feet of a
resldentlal zone, and such uses wlsh to operate after 10PM or
before 7AM, as well as establishlng standards for automobile
washlng facilltles
Proposed lS an eighteen-month extension of
this ordlnance.
BACKGROUND
Ordlnance 1727 (CeS) was adopted to regulate the operating hours of
certain automoblle-related uses to protect any nearby residentlal
uses and to establlsh standards for automoblle washing faCllltles.
Pending permanent changes to =he Zonlng Ordinance, this interim 45-
day ordlnance lS proposed to be extended for eighteen months with
one modiflcatlon. At the February 8 hearing, the Council directed
that convenience markets that propose to operate past 10PM be
requlred to apply for a Condltional Use Permlt

been made in the attached ordlnance. The Co~ncll also asked staff
to co~sider whether there were other uses which should be regulated
under the ordinance.
No addltlonal uses are proposed for such
regulatlon at thlS tlme.

The recommendatlons of thlS report would have no budget/flnanclal
lmpact
RECOMMENDATION
It is respectfully recommended that the Clty Councll adopt the
attached ordlnance, extendlng the provlslons of Ordlnance 1727 for
a perlod of elghteen months, lncludlng the addltion of a
requlrement to obtaln a CUP for convenlence markets WhlCh are
proposed to be operated past 10PM
