BACKGROUND
The Clty Plannlng Commlssion approved the Tentatlve Map and the Ten-
ant-Partlclpatlng ConverSlon for the above project on August 4, 1993,
after a publlC hearlng and a careful review of the record and staff
yecommendations The actlon of the Planning Commisslon was based on
the Commlsslonls findlngs that the proposed Tenant-Participating
Conversion meets the requlrements of Article XX of the Clty Charter
and that the proposed subdlvislon is conslstent wlth applicable
general and speclflc plans as adopted by the City of Santa Monlca
along with all '1landatory requlrements of the Subdlvislon Map Act of
the State of Callfornla
The owners have submitted to the Clty a Wrltten Consent Agreement
bindlng the owners and any successors In interest to each condltion

imposed in connection wlth approval of this Tenant-Particlpating Con-
version. This Wrltten Consent has been approved by the City Attorney
and the Clty Manager. Each partlcipatlng tenant has been lnformed ln
wrltlng of hlS or her rights under Article XX of the City Charter.
The Llcense Divislon reports that proper arrangements have been made
to ensure pay~ent of the Tenant-Particlpatlng Conversion Tax.
The Flnal Map conforms to the Tentatlve Map. The Flnal Map has been
certlfled by the Clty Engineer for conformance wlth the Tentatlve Map
and condltions thereon, the Subdlvision Map Act and local ordinances.
The City Attorneyl s offlce has approved a Declaratlon of Covenants,
Conditions, and Restr~ctlons, or equivalent document, for thlS proj-
ect as complYlng wlth the condltions of the Tentatlve Map and the
Tenant-Partlclpatlng ConverSlon.
Council approval of a flnal map for a Tenant-Partlclpatlng ConverSlon
~epresents one of the last steps necessary ln the conversion process.
Followl~g City Councll actlon and approval by the California Depart-
ment of Real Estate the applicants may begin selllng thelr units to
the tenants. As each unlt 18 sold a conversion tax per Section 2008
of Artlcle XX :..s due ln an amount equal to twelve times the monthly
rpaXlffiUf11 allowable rent for that unit. These taxes wlll be used to
a8s1st low and moderate lncome households to purchase or lmprove
their unlts subject to affordable repayment per Sectlon 2009 of Artl-
cle XX.

BUDGET/FISCAL IMPACT
The recommendatlon presented ln thlS report does not have an lmmedi-
ate budget or fiscal lrnpact If and as un~ts in the proJect are sold
ln the future, Tenant-Part~c~patlng Convers~on Taxes will be col-
lected pursuant to the provisions of Article XX of the Clty Charter
and some lncreased property tax revenues may be generated
RECOMMENDATION
It lS respectf:.Illy recommended that the Final Map for thlS Tenant-
Partlclpating Conversion be approved by adoption of the accompanYlng
resolutlon.
