The Text Amendment allows a Conditional Use Permit to be granted for ancillary uses to conditionally permitted uses in the R2 District, and allows certain exceptions to the private open space requirements for 100% affordable housing projects in the NW Overlay District. As stated by the applicant at the City Council public hearin;r, the applicatlon has been amended to include the follow1ng stipulations: 1. The parking spaces constructed on the project site shall be used only to service the Senior Housing and Transitional Housing on the site or any lawful activities at the First United Methodist Church at 1008 Eleventh Street generally as shown by the Upward BoW1.d Parking Analysis dated 10/26/93. This use can include current practices allowlng use by Trinity Baptist Church of the existing surface parking lots. In addition, in the event of emergency or natural disaster, the park~ng spaces can be used temporarily by other residences. Any substantial change or substantial intensification of such use shall require a Conditional Use Permit. 2. The Applicant shall make reasonable efforts to ensure the subterranean parking garage is maintained at all times ln a clean and safe condition, free from accumulation of dust, dirt or debris. 3. The Security plan for the proJect shall contain all of the following: (a) Reasonable security control measures with respect - 3 - to ingress to and egress from the subterranean parking structures. (b) Physical barriers, such as security gates or other mechanisms! to enable the Applicant to restrict access to those parking levels not In daily use so that those barriers can be in place when the additional parking levels are not in use. (c) On-site personnel or periodic security patrols or a combination thereof as necessary or appropriate to ensure the safety of the subterranean parking structure when it is in use. 4. In order to ensure the subterranean parking garage provides acceptable air quality! a mechanical ventilation system shall be installed which satisfies the requirement of Section 705 of the Unifom Building Code. The City Council approves the following Text Amendment (bold indicates new text) : a) Section 9 04.08.040.9 (Conditionally pemitted Uses in the R2 District) (n) Storage roams, subterranean parking, or both, provided they service a use which itself is permdtted by a Conditional Use Permit in the R2 District. - 4 - . . b) Section 9.04.08.56.060 (Property Development Standards in the NW OVerlay District) (e) Usable Private Open Space. All nnits shall have the following minimum arnonnts of usable private space per unit: 100 square feet for projects with 4 or 5 units, and 50 square feet for projects of 6 units or more. Private oJ2en space shall include a deck, yard, patio, or canbinatlon thereof which is adj acent to, accessible from, and at the same approximate elevation as the primary space. The approved Text Amendment is consistent in principle with the goals, objectives, policies, land uses and programs specified in the adopted General Plan, in that the change to Section 9.04.08.06.040 of the zoning Ordinance (Conditionally Permitted Uses-R2 District) clarifies a existing allowances and does not permit any new types of uses in the R2 District, and in that the change to Section 9.04.08.56.060 (e) of the Zoning Ordinance (Usable Private Open Space -- North of Wilshire OVerlay District) 1.S consistent with objectives contained wi thin the Housing Element of the General Plan concerning the provision of affordable housing. In addition, the amendment to Section 9.04.08.56.060(e) is consistent with the reconmendations of the Santa Monica Task Force on Homelessness to provide more lenient standards for affordable housing projects. 3. The public health, safety, and general welfare require the adoption of the proposed Text Amendment, in that the approved Text Amendment serves to clarify the existing Zoning Ordinance and provide increased opportunities for the construction of affordable housing.
