or Demolition Handling Services within the city through
an Annual Permit Process and Recommendation to Approve
a Resolution Setting an Annual Permit Fee
INTRODUCTION
This report recommends that the City council conduct a public
hearing and introduce for first reading an ordinance regulating
private firms that provide refuse, recycling, or demolition
services to the commercial sector within the city through a formal
permitting process administered by the Department of General
Services. It is also recommended that Council adopt a resolution
setting an annual permit fee. Permit conditions and performance
requirements will be established by the Director of General
Services to ensure that private haulers are subject to the same
regulations that govern City operations.
BACKGROUND
On July 27, 1993, the City Council directed the City Attorney to
draft an ordinance to establish a permitting process for private
firms providing refuse, source separated recyclables and demolition
handling services to the commercial sector in the City. In
effect, private firms' performance would be monitored to ensure
that they comply with the objectives of state laws and the City'S

master plan to reduce the quantity of solid waste generated and
directed to landfills by this city.
AB 939, the Solid Waste Management Act of 1989, became state law on
January 1, 1991. This law directs cities to divert (e.g., reduce
or recycle) 25% of their 1990 waste stream levels by the year
1995, and by 50% by the year 2000. Cities that violate the terms
of AB 939 can be fined up to $10,000 per day. The City Council
endorsed the principles of AB 939 through the adoption on August 4,
1992 of a comprehensive eight-year master plan (Source Reduction
and Recycling Element) which outlines the city I s policies and
procedures for achieving the solid waste diversion goals mandated
by AB 939.
DISCUSSION
The solid waste diversion goals affect both residential and
commercial waste streams. The City I S integrated solid waste
management program currently diverts 28% of the residential waste
stream, already surpassing the 1995 goals of 25%. However, the
City currently manages only 45% of the commercial and industrial
waste stream. The remaining 55% is handled by as many as 12
competing private hauling firms. Historically, city regulatory
control over these private haulers has been relegated to enforcing
administrative rules cited in the current Municipal Code over
frequency of collection, hours of operation, and other minor
operational issues. City staff believe this limited ability to

regulate private haulers has contributed not only to a condition
whereby one-third of the entire customer base can circumvent the
policies and objectives of the Council-adopted solid waste master
plan but also to the small overall 6% diversion rate in the
commercial sector.
AB 939 requires that cities exert more comprehensive control over
all segments of solid waste management, including the monitoring of
flow control, the implementation of waste reduction and diversion
programs, and the assumption of overall quality control to ensure
environmentally sound solid waste management. In order to
determine the most appropriate approach for the ci ty of Santa
Monica to exert this control, city staff studied the effectiveness
of the approaches implemented by neighboring cities.
Staff found that some cities (e.g., Anaheim, Brea, and Garden
Grove) have entered into an exclusive contract with one firm
wherein diversion level requirements were specified and the
responsibility for aChieving these requirements was delegated to
the one firm. SOIDe cities (e.g., Burbank and Beverly Hills) have
implemented resolutions that allow the cities to charge a
percentage of the gross receipts collected by private haulers.
These funds are ostensibly applied to recycling, education, and
other diversion programs conducted by these cities. The city of
Santa Monica opted to model its ordinance and performance
requirements in part after regulations which have been developed

by the Cities of Newport Beach and Costa Mesa. This approach
requires private solid waste haulers to apply for an annual permit
which is accompanied by regulations which outline the mechanisms
and performance quality criteria for daily operations. Santa
Monica's permit regulations are described in greater detail below.
Santa Monica's proposed Ordinance empowers the General Services
Department, Solid Waste Division to regulate the performance of
private solid waste handling firms operating within the city. It
asserts that the 1ntroduction of a formal process for permitting
private solid waste handling service providers is specifically
outlined in the City Council's adopted SRRE document as submitted
to the state's Integrated Waste Management Board. It also asserts
that the disclosure and performance requirements of a permit system
will enhance the city's ability to attain the degree of quality
service from private haulers which is commensurate with city-
provided services. Additionally, the City will be able to ensure
compliance with the goals and objectives of AB 939 as well as the
city's own Solid Waste Master Plan. This proposed policy has been
specifically endorsed by the City's Task Force on the Environment.
Finally, the Ordinance empowers the City council to adopt a
resolution requiring private commercial refuse haulers to implement
a volume-based rate structure which will encourage not only a
reduction in refuse generation but also induce the commercial waste

generator to opt for recycling/diversion alternatives. Volume-
based rates are a key concept in the city's Source Reduction and
Recycling Element. Since city staff has not yet finalized the
proposed volume-based rate matrix for private commercial haulers,
the resolution accompanying this staff report does not contain
these rate provisions. This rate concept has already been adopted
by Council for the City-serviced residential and commercial
customer base.
It is anticipated staff will request Council to approve such a
volume-based rate structure for private commercial haulers within
the next few months, likely in conjunction with a proposed
commercial recycling program.
The draft Solid Waste Handling Permit Regulations document
(attached) contains the specific disclosure, reporting, procedural,
and verification requirements along with the permit application
form. Some of the new conditions and audit mechanisms incorporated
in the new permit process are:
1. Submittal to the General Services Department of refuse and
recycling volumes data in the form of a monthly report which
shall contain information on total tonnage collected and
recyclable materlal diverted.
2. Permittees' agreement to allow the city staff to access

recycling processing and waste transferring stations in order
to monitor compliance with regulations, and city's agreement
to grant permittee 24-hours to respond to complaints of non-
compliance.
3. Posting of a performance deposit in the amount of $2,000.00
for refuse haulers and $1,000.00 for recycling haulers to be
held in the city Treasury and replenished should costs arise
in time or materials related to corrective action taken by the
city for any instances of non-compliance on the part of the
private hauler of permit conditions.
4. Acceptance of the condition whereby hauler accedes that,
through persistent or flagrant transgressions of any permit
conditions relative to performance, his/her permit is subject
to suspension, revocation, or non-renewal as determined
through an administrative hearing.
5. provision for payment of an annual permit application
processing fee of $300.00.
FINANCIAL/BUDGET IMPACTS
It is anticipated that total revenues to the city from the new
permit requirements will be less than $4,000 per year, and will be
used to offset administrative costs associated with the issuance
and monitoring of permits. No budget revisions are therefore

recommended at this time. It is expected that the start date for
the new permit system will be April 1, 1994.
RECOMMENDATION
It is recommended that city Council introduce for first reading the
attached Ordinance Requiring Solid Waste Permits for Solid Waste
Enterprises and approve the Resolution setting an annual permit
fee.

replacement, remodeling, repair, or demolition
of structures, and includes, but is not
limited to, such rejected materials and
fixtures as earth, stones, bricks, plaster,
glass, lumber, roofing materials, shingles,
concrete, plumbing fixtures, pipes, heating
systems, and electrical materials.

section 18. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent with the provisions of this
Ordinance, to the extent of such inconsistencies and no further,
are hereby repealed or modified to that extent necessary to effect
the provisions of this Ordinance.
section 19. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance.
The City Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the Ordinance would be subsequently declared invalid or
unconstitutional.
Section 20.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
This Ordinance shall become
effective after 30 days from its adoption.

REFUSE, SOURCE-SEPARATED RECYCLABLE AND DEMOLITION
~~TERIAL HANDLING PERMIT REGULATIONS
As allowed by Sections 5.08.430c and 5.08.400 and 5.08.440 of
the city of Santa Monica Municipal Code, the following are
addltional regulatlons attached to the issuance of any
enterprise permits assoclated with any solid waste handling
serVlces or source separated recycllng services performed in the
city of Santa Monlca.
1. The permlttee shall co~plete an application for an Enterprise
Handling Permit. The application shall be completed in full and
lnclude all additional documents and information requested.
2. The permittee shall provide proof of a valid and current City
business license, plus a statement of previous year's
tonnage of materlal/services rendered within city.
3. The permittee shall provlde certlficates of insurance ln the
amounts specified and of the types specified in the above
sections of the Municipal Code and applicable provisions of
Resolutions of the Clty council. All certificates must be
provlded in a form or format required by the city.
4. The permlttee shall provide eVldence of submission of the
performance deposit specifled by City council Resolution
according to the above sectlons of the Municipal Code prior
to the lssuance of an Enterprlse Permit.
5. The permlttee shall be responsible to provlde information on
all regular accounts for audlt purposes wlthin 5 days notice at
permittee'S place of business wlthln the County of Los Angeles
6. The permittee shall provlde the Clty with informatlon
regarding all materlals collected. This information shall
lnclude, but not be limlted to, the following:
A. An annual estlmate of tons of refuse, demolition materlal
and source separated recyclable materials collected in the
previous 12 months.
B. A monthly report of serVlces provided, tonnage collected,
recyclable material diverted and dlspositlon of all materials.
Information shall be sub~ltted by the 15th of each month in a
form or format deslgnated by the Director of General Services.
The permlttee wlll be required to keep adequate records on all
data submltted to the Clty so as to allow the City to audit and
verlfy thlS data if so necessary.
7. The permittee shall conduct all solid waste and source
separated recyclables handling operations in accordance with
all appllcable federal, state and local laws and ordinances. In
addition, the permittee shall comply with the following
requirenents:
A. The perm1ttee shall enploy an adequate number of vehicles
to provide services contracted with their customers.
B. The permlttee shall provide a proper and adequate
capacity and frequency level of service to each customer as
determ1ned by the Director of General Services , and at a
MINIMUM service frequency level of 1 X (once) per week for
refuse contalners and a MINIMUM of IX (once) per month for
source-separated recyclable materials.
c. All SOlld waste collection vehlcles shall clearly display
the permlttee's name, address and telephone number in legible
letters on both sldes of each vehicle.
D. Permittee shall be aware of and in compliance with all
limltations on hours during which solid waste handling
operations may be conducted. Current permitted hours of
operation are 7:00 AM to 8:00 PM, except in the M-l zones
where operations are permitted after 3:00AM unless with1n
500 feet of a residence.
E. All containers used by the permittee shall clearly
dlsplay, the permlttee's name, address and telephone number in
leglble letters. Containers shall be placed ln a manner which
does not interfere with pedestrian or vehicle safety or welfare.
Permittee shall at all times keep and maintain all containers
and container lids in good repair and in a clean and sanitary
condition. Permittee acknowledges City's right to temporarilly
install serVlce frequency monitoring devices on containers to
monitor for regulatlon compliance.
8. All recycling servicesl including intermediate processing
and transfer, shall be conducted ln a manner conSlstent with the
recycling requirements of the City as mentloned in the above
sections of the Munlcipal Code.
9. Any permittee collectlng, processing or transferring
recyclable material must agree to allow access by city employees
or its designee to monitor these processes including locations
where separation and marketlng of recyclable materials occurs.
ThlS shall also apply to subcontractors of the permittee who are
provlding a recyclable processing or marketing service.
10. The perMlttee shall have 24-hours to respond to
complalnts of non-service, unless health or safety concerns
necessitate clty-provided remedial intervention. In such
cases the enterprise permlt shall be revoked or suspended unless
the per~ittee agrees that lts security deposlt may be attached,
per conditions contalned in the Municipal Code, on a time and
naterial bllling basis.
11. Any non-compliance by a permlttee with any conditions of
these regulations or those mentioned in the above sections of
the Munlclpal Code or resolutions of the Clty council shall be
grounds for city to suspend or revoke an enterprise permit or in
lleu thereof to take adminlstratlve action against the
performance deposit. Any reductions in security deposit balance
occasloned by Clty admlnistrative action must be replenished
wlthin 30 days of official notice (SMMC section 5.08.470c).

All companies involved in the direct handling of solid
waste or source-separated recyclable materials within
the City must obtain an enterprise permit. This
includesInstitutiona1/Industrial/Commercial (ICI)
haulers, recycling contractors, demolition contractors,
etc. Only ONE permlt need be applied for lf contractor
is 'engaged in more than one of these services in the
City. A company does not need an enterprise handling
permit lf services are perforMed by one of the private
haulers already llcensed and permltted by the city.

In order to obtain an enterprise permit you should read
the regulations, complete the application. The

A RESOLUTION OF THE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
ESTABLISHING REGULATIONS REGARDING ENTERPRISE PERMITS
WHEREAS, the city Council of the City of Santa Monica has
enacted an ordinance requiring enterprise permits for enterprises
providing solid waste, refuse and source separated recyclable
material services; and
WHEREAS, the ordinance requires that certain standards for the
enterprise permit be set by resolution;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Santa Monica Municipal Code Section
5.08.420, the application fee shall be Three Hundred Dollars
($300.00), payable annually with the application for an enterprise
permit or renewal thereof.
SECTION 2. Pursuant to Santa Monica Municipal Code Sections
5.08.430 and 5.08.470, a solid waste enterprises shall post with
the Director of General Services a performance deposit of Two
Thousand Dollars ($2,000.00) and a recycling enterprises shall post
with the Director of General Services a performance deposit of One
1
Thousand ($1,000.00).
SECTION 3. Prior to the issuance of an enterprise permit, and
at all times during the period that the enterprise permit is in
effect, the applicant shall obtain and maintain the following types
and minimum amounts of insurance coverage:
(a) Commercial General Liability
Insurance: One million dollars,
$1,000,000.00, combined single limit per
occurrence for bodily injury and property
damage.
(b) Comprehensive Automobile Liability
Insurance: One million dollars,
$1,000,000.00, combined single limit per
accident for bod1ly injury or property damage.
Coverage shall include environmental
restoration (pollution liability) which would
protect against loss, damage, or destruction
of natural resources arising out of accidental
disCharge, disposal, release or escape into or
upon the land, atmosphere, watercourse, or
body of water, of any commodity transported by
a solid waste enterprise.
(c) Workers' Compensation: Workers'
Compensation limits as required by the Labor
Code of the state of California.

(d) other Insurance provisions:
(i) The city of Santa Monica;
members of its c~ty Council, boards
and commissions, officers, agents
and employees are to be covered as
insured as respects liability
arising out of activities performed
by permittee related to the solid
waste permit.
(ii) Insurance is to be placed
with insurers admitted and licensed
in the state of California; or in
the case of non-admitted insurers,
must be rated A:6 or better as
determined by A.M. Best's rating
service.
(iii) Each insurance policy
required by this Section shall be
endorsed to state that coverage
shall not be suspended, voided,
canceled, reduced in coverage or in
limits except after thirty (30) days
written notice has been given to the
Director of General Services of the
city of Santa Monica.
(i v) Permittee shall furnish

the city with certificates of
insurance
of
specific
coverage
required herein.
The certlficates
are to be on forms signed by a
person authorized by that insurer to
bind coverage on its behalf. The
certificates are to be on forms
provided by the city and are to be
received and approved by the city
before the enterprise permit is
issued.
SECTION 4. The city Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.
