'" iY: A.J _ ij'~L Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: Recommendation to Adopt Ordinance Renumbering and Amending All Sections of the Santa Monica Municipal Code INTRODUCTION This report recommends that the City council introduce for reading and ultimately adopt the attached ordinance to renumber and amend in its entirety the Santa Monica Municipal Code. The proposed ordinance affects no substantive changes in the Code, but will make the Santa Monica Municipal Code easier to use and to update. BACKGROUND For several years the City Clerk in conjunction with the Information Systems Department and the city Attorney have been exploring ways to change the format of the current Santa Monica Municipal code. The Code, at present, is often difficult to use and because of its sequential numbering pattern, presents a confusing array of section numbering patterns. The renumbered Santa Monica Municipal Code offers several advantages. First and foremost, is ease of use. The amended version will be cross indexed and significantly, can be placed into an electronic format. Computer searches of the Code will be - 1 - 8-1) SEfi 2 ~ "''17 possible under this electronic format which will greatly assist city staff and the public in finding relevant Code sections. In addition to making the Code easier to use, the renumbering offers the advantage of making future Code changes less difficult. At present as laws are updated or added to Code, it is common to find that section numbers for the new ordinances are unavailable. As a result, a bewildering array of numeric sections combined with alphabetical letters often are necessary to differentiate the new provisions. The new numbering system, with its use of decimals, will permit a uniform numbering system to be used. since the proposed ordinance only renumbers and recodifies the current Santa Monica Municipal Code it has no effect on any substantive rights. BUDGET/FISCAL IMPACT The adoption of the proposed ordinance will have no immediate budget impact. In the future, City signs and forms will need to be rewritten to incorporate the new numbering system. RECOMMENDATION It is recommended that the City council approve and introduce for first reading the attached ordinance to renumber the Santa Monica Municipal Code. Prepared by: Joseph Lawrence, Acting City Attorney Clarice Dykhouse, City Clerk - 2 - CA:RMM:jld747/hpcal/pc city Council Meeting 9-22-92 Santa Monica, California ORDINANCE NUMBER (City council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA RENUMBERING AND AMENDING ALL SECTIONS OF THE SANTA MONICA MUNICIPAL CODE AND ADOPTING THE SANTA MONICA MUNICIPAL CODE BY REFERENCE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Findinqs and purpose. The City council of the city of Santa Monica finds and declares that: (a) The City council desires to renumber all provisions of the Santa Monica Municipal Code, without substantive amendment to any Code provision, as permitted by Santa Monica City Charter Section 618 and Government Code section 50022.10. (b) The purpose of the renumbering is to make the Santa Monica Municipal Code easier to use, update and amend. This change will permit the Santa Monica Municipal Code to be reproduced in an electronic format, thereby making the document more accessible to the public. SECTION 2. The Santa Monica Municipal Code in its entirety is amended, recodified and renumbered as is provided for in the attached copy of the Santa Monica Municipal Code, which is incorporated by reference into this Ordinance. - 1 - SECTION 3. (a) This Ordinance shall not affect or impair any act or right or any proceeding, suitor prosecution had, commenced, or pending in any cause. No offense, liability, penalty, or forfeiture, either civilly or criminally incurred prior to the time when this Ordinance takes effect shall be affected in any manner by this Ordinance. (b) This Ordinance shall not in any manner affect any signs, forms, or other documents of the city of Santa Monica which refer to, or otherwise incorporate, ordinances which are or have been specifically designated by number, and which are included within the scope of this Ordinance. Any such references in any signs, forms or other documents shall be construed to apply to the corresponding provisions contained within this Ordinance and the attached copy of the Santa Monica Municipal Code. SECTION 4. The City Clerk shall make available for public inspection and use at least three copies of the Santa Monica Municipal Code as amended and adopted by reference by this Ordinance. Such copies shall remain on file and open for public inspection while the Code 1S in force. SECTION 5. Any provision of the Santa Monica Municipal Code or appendices thereto lnconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. - 2 - SECTION 6. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The city council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 7. The Mayor shall slgn and the city Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from its adoption.
