TNTRODUCTION This report recommends that the City Council conceptuaZly apprave the draft Baysid~ District Specific Plan with the revisions as recommended in thi.s report, direct staff to initiate the environmental review process, and direct the Planning Commission to initiate a Resolutian of Intention to amend the Zoninq Ordinance in order to create a Bayside Zoning District. In addition, at tha August 11, 1992 Cotlncil meeting, the Council dir~cted staff to prepare an interim ordinance which would impose limitations an th~ total number af alcohol autlets and eating establishments in the Bayside District as well a~ examine a limitation on the total number af seats in these bus~nesses on a b~ock by black basis. As directed, the ordinance alsa prohibi~s game arcades in the Bayside District. The City Attorney's s~aff repor~ is cantained in Attachment A and the ordinanc~ is included - 1 - ~ ~ ~N~, -~ J -~;- y ~J~i as Exhibit A of the city Attorney report. The Council further requested that staff address in this fo11Qw tzp staff report the faZlowing key issues: iimitatians on alcohol outZets, limitations an faod serving establishments, the location and size of the Passageway Overlay Zones, provisions far housing in the Bayside District, and establishment of a Transfer of Development Rights program. Other miscellaneous issues also are discussed. HACKGROIIND Prev~ous Council Action At the August 1Z, 1992 meeting, Council agreed to limit the discussion to a review o£ the issues and delay deliberations and final action an the draft Specific PZan until the September ~5, ~992 Council meeting. While Councilmemb~rs identif~ed a number of key concerns as we7.1 as made suggestions on how to address these issues, no motions were adopted directing staff to prepare specific policy changes ta the draft plan. Therefore, the reco~nmendations presented in this report were prepared with considerativn to the range flf concerns e~ressed by the Council. Cauncil Comments an Staff's Recommendations Regarding A~cohol outlets and Rest~urants Council disagreed with ~he staff recominendation to place a block by block limitation on all alcahol outlets, Instead, it was felt that a distinction should be made between the different types af alcohol serving estab].ishments. In particular, Councilmembers - 2 - felt that limitatians on bars and entertainment facilities should be separate fram the res~rictions placed on restaurants whose primary purpose is mea~ service. It was a~so stated that the Specific Plan shauld address whether or not there are restrictions on the sale of alcoho~ for off-premise consumption. The draft document is si~ent on this issue. Councilmembers also express~d the need to address the siae of the alcohol out~ets. There is a substantial difference between the approval of 200 seat restaurants and the approval of smaller, cafe-style restaurants with only 50 seats. It was suggested that, rather than limit individual restaurants to a specific seating numl~er, categories cou~d be estab~ished with seating ranges. Far exampZe, ane block might be allowed ~ restaurants, each with 50 seats or less, 3 restaurants could be permitted to have up to 125 seats, and 1 restaurant could be parmitted to have over 125 seats. In general, Council expressed concern that staff's praposal to allow a limited expansion of alcohol outlets throughout the district was overly broad, while the Planning Commission's recommendation to freeze the number of outlets at the existing total was too restrictive. The Bayside District Corporation proposed ta permit ona additional outlet on each side of the ~400 b~ock of Fourth S~reet, one outlet on the east side of the 1200 block af the Promenade, appro~al of the propased restaurant a~ 1333 Third Street Promenade and the Criterian Plaza Food Caurt at ~315 Third S~reet Promenade, and the opening of a new restaurant - 3 - on the 1400 black of Second Street. Some Councilmembers thought this to be a more reasonable proposal. In additian to the Iimitations on alcohol serving establishments, the Counci~ ~elt that limitatians should also be placed on the overa~l number of restaurants, with or without alcohol service, permitted within the District. The purpose of this limitation would be to reserve the remaining street level building frontag~ in the District for retail u~es. It was stated that many pxoperty owners prefer to lease to restaurants rather than retail tenants. Consequently, the rental rates have become tao expensive for many prospec~3ve retailers. Restricting the total number of faad serving establishments in the D~strict to a specific number would ser~e as a mechanism to encourage expansion of retail uses in the area. An inventory of a11 alcohol outlets and food serving establishments is contained in Attachment C. A map and list of alcahal outlets and food serving establishments i5 contained in Attachm~nt D. ANALYSIS AND RECOMMENDATION~ POLICY REC~Mi4iENDATIONS RELATING TD SEATING LIMITATIQNS Planning staff has cansidered variaus approaches to limiting the number of seats for restaurants in the Bayside District. While the cancept of creating seating categories addresses the issue of Zimiting the number of large establishments, an area wide poZicy, if site specific, wou~d eliminate the flexibility restaurants are entitled ta under their current CUP's or under those circumstances where the only limit is fire cade exiting - 4 - standards. It is also problematic to determine rational seating limits on a restaurant by restaurant basis. Zn addition, staff has signif~cant aancarns regarding the abilitp to maintain an accurate seating count and the impact this effort will ha~e Qn the City's iimited enForcement sta€f. The seating count compiled far this study was based up~n the seating Iimitatians imposed by Conditional Use Permit approvals as well as from a fie~d inspect~on count of seating in the many estabZishments that were not raquired to receive CUPs. The establishments without CUPs curr~ntly do not have any seating res~rictions other than fire safety. Therefore, while ~he seating count may be accurate at one point in time, there is no way to know when an establishment changes the number of seats. There is no practical reason for an operator to notify the City regarding a small seating increase and, far non-alcohol serving establishments, the aperator is not required to obtain any City approvals For the additional seats. In additian, the enforcement o~ seating limitations imposed by a CUP are typically conducted in response to a specific comp~aznt, The City does not hava suf~iciant enfarcement staff to inspect restaurants ragarding seating on a continuous basis. In addition, staff does nat be~ieve maintaa.ning a constant inventary of seating in Bayside District foad establishments is an effective use of enforcement staff. Ftirther, unlike Fire Department occupancy requirements, the prapased seating limitations do not invo~ve public safety issues, but rather perceptions regarding appropriate restaurant - 5 - size. Due to these issues, staff does not supporting the ad~ption of seating limitations i~ the Bayside District. There has also ~een discussian among Bayside District Corparation board ~embers and the Carporatian's City Council liaisons regarding establishing seating limits for the propasad four additional restaurants in the Bayside Dist~ict. Hawever, given staff's position regarding a block by block seating limitatian and the fact that the Planning Com~ission, in the review af a CUP, can limit seating based an the restaurant's Iocation and the nature of its aperat~on, staff also does not recommend adopting seating limits for the proposed additional restauran~s at this time. ALC~HOL OUTLET_LIMYTS PZanning sta~f recommends that the concerns regarding the establishment of different limitations for bars and alcohol serving restaurants be resolved by basing the limitation on license ~ype. Restaurants with either a Type 41 beer and w~ne ].icense or a Type 47 full bar license, both of which are license types granted only ta public eating places, would be grouped into ane category. Bars with an ABC Type 48 genera]. alcahol license, Urhich is an ABC license type granted ta public premises that serve a~c~hol but do not nscessarily serve foad, would be placed in a separate category. The proposed limitations are based on the existing number flf Type 41, Type 47, and Type 48 licenses in the Baysida District, plus the pending Criterion Food Plaza, which, although it requires 5 Conditional Use Permits, is - 6 -- cansidered herein as one restaurant out~et; the pending restaurant at 1333 Third Str~~t Promenade; and the faur additional restaurants with a~cohol licenses as recommended by the Baysid~ District Corporation. A map identifying the number of existing and proposed alcohol outlets permitted per block is contained in Attachment E. Policy Addition ~~ is intended to create such an incentive. Policy Addition #1 Existing bars with Type 48 licenses perm~tting general a~cohol service in public premises may receiva a 10 percent increase in seating, notwithstanding any other seating la.mitations set forth in this Specific Plan, if the business operataon canverts t~ a restaurant with a Type 41 license permitting beer and wine service in a public eating place or _ g _ a Type 47 ~icense permitting genaral alcohol service in a public eating place. The Planning Commission shall have the discretion to approve this aperational change through the Conditional Use Permit process. Palicy addition #2 is intended to address the need for a limited number of neighborhood serving uses in the District, particularly the need for a market to serve the narth of Wilshire residential neighborhoad. Policy Addition #2 Tha sale a~ a~coholic beverages for aft-site consumption shall be limitad to one neighborhvod serving food market located on the ~200 block of the Promenade and to one specialty food market lacated on the 14a0 black o~ Second Street. FOOD SERVING ESTABL~SHMENT LIMITS Two policies are propased to address the concerns expressed regarding the averall number af faod serving establishments in the Bayside District. Food serving establishments includes restaurants, co~fee houses, and sandwich shops, with or without alcohol s~rvices, but excludes the four establishment's in the Bayside District with Type 48 bar licenses. Policy revision #3 limits the tota~ number of faod serving establishm~nts on a b~ock by block basis. PoZicy revision ~4 further limits restaurant expansion by prohibiting axisting restaurants from expanding into - 9 - the first 50 feet of building depth of an adjacent structure as measured from the front property line. This portion af the building shall be reserved specifically for retail use. Planning staff recommends the following additions to the General Policies Section of the Specific Plan Land Use Element under the category of Types af Uses. Retail uses shall be encauraged to accupy this partian af the building. PASSAGEWAY ZONES The draft Specific Plan did not prQposa any changes to the existing policies regarding the location or nu~er of permitted pubZic passageways in the District. However, Councilmembers concurred with the Bayside District Corporation's recommendation to make the location of the pub~ic passageways on each block more flexible and to limit the tQta~ numher of passageways to one for each side of a block. It was suggested that the Passag~way Overlay Zone be expanded 150 feet in each direction ~rom the existing zone boundaries. Planning staff recon~ends that the concept autlined by Cauncil for expanding the size of the Passageway Over~ay Zone be achieved by locating the praposed Passageway Zone across the center partion of each block. The zone would exclude the area l~cated within ~00 faet of tha cross streets of Wilshire Boulevard, Arizona Av~nue, Santa Monica Boulevard and Broadway. Thzs wauld increase the number of parcels in each zone area from four to eight. It further focuses on the need for more mid-block connections from the alleys and parking structures to the Promenade. The cross streets can then serve as the end-block connectors to the parking structures as well as ta businesses and other us~s located on Second and Fourth Streets. Maps iden~ifying the existing and proposed Passageway Overlay Zone ara -ii- contained in Attachment D. The following pQlicy is recommended to describe the zone boundaries. Policy Addition #5 The Passageway overlay Zone ahal~ encompass all Promenade-fronting parcels located at least 100 feet from the corner of the nearest cross street. 4n1y one new p~blic passageway shaZl be permitted on each side of each block. Existing public passageways shall not count toward this limitation. HOUSING Councilmembers had a variety of comments regarding increasing housing opportunities in the Bayside Distric~. It was suggested that additional housing on the Promenade be encouraged by requiring the projects that receive a two story height bonus for providing a public passageway to devote the bonus fioors exclusively ~o housing. By both expanding the size of the Passageway Overlay Zone and requiring hvusing to be included in praj~cts that take advantage of the passag~way bonus, two high priority goals can be achi~ved. Other concerns regaxding housing in the Diatrict focused on protecting residential units from the impacts of noise generated by the high leve~ of pedestrian activity in the area. Policies zn the draft Plan currently address ~his concern. There was also discussion regarding allawing six story buildings on the west side of Second Street if housing is provided. Staff - 22 - has recommended that the existing 3 story height limit be r~tained. Council's cam~ments on this issue were mixed with some stating that creating housing oppartunities is a priority and that the additiona~ height would not impact views in the area. ~thers stated that retaining th~ existing height limits was appropriate and that they did not believe developmant standards should be intensified. The folZowing poZicy revisions are recommended to address the concern for providing additional housing on the Promenade. Palicy ReviSion ~2 Policy 4.1.23 There shall be no limitation on the number af stories af any structure which, at a minimum, ia all residential above the first floor, is located in the Passageway Overlay Zone and has received a height bonus far the provision af a public passageway, or is a detached public parking structure, 50 long as the height does not exceed the maximum number of feet permitted in this Specifie P~an for the subject Specific Plan land use zone or overlay. Such structures may ~nclude retail uses at the ground ~laor. Policy Revision #3 Policy 4.1.49 Permit structures ta be constructed to a maximum height of 6 stories, 84 feet when a passageway is providad. The fifth and sixth stories must be devated exclusively to residential use. A seventh story may be permitted within the 84 foot - 13 - height limit with Planning Commission approval, if sa~d story is dev~loped as the upper loft area w~th internal circulatian to the residential units on the sixth floar. In addition, in order to insure that ~he incentives i~cluded in tha recentZy adapted Affordable Housing Ordinance are ava~lable in the Bayside District~ staff recommends the inclusion of the following policy under the General Policiss section in the Specific Plan Land Use Element. Policy Addition #~ Natwithstanding any policies in this Specific Plan ta the cantrary, affordable housing projects as defined in 4rdinance 1&35 (CCS) shall be subject to the deveiopment standards set forth in said ord~nance. TRANSFER ~F DEV~LOPMENT RIGHTS Establishing a Transfer af Development Rights (TDR) pragram in the downtown was also discussed at length. In general, while additional incentives to encourag~ the preservation of historically significant buildings in the Bayside District was considered a pasitive goal, the TDR proposal as presented by the Bayside District Corporation was cansidered too broad. It was suggested that, while the gaal was apprapriate, the cancept should be more narrowly defined to add~ess th~ intent to preserve two specific buildings, the Mayfair Theatre and tne Europa Building. - 1~ - Planning staff, therefore, recommends that the following two policies be included under the Land Use palicies for Zone 1 and Zone 2. Palicy Addi~ion #7 The City shall encourage the preservation o€ the Eurapa Building by warking with the property owner through the De~elopment Agreement process to achieve the following goals: o Develapment of a single project that includes the preservatian af the Eurapa Building and the development of the two adjacent parcels that are under the same ownership; o Inclusion of a neiqhborhood serving food ~arket in the Europa Building; and o Canversion of the 360 seats approved for a single restaurant into three smaZler restaurants. These three restaurants shall caunt as one in the block by block limit. Pa~icy Addition #8 The City shall encourage the preservation af the Mayfair Theatre by warking with the property owner through the DeveZopment Agreement process to achieve the following goals: a Preservation of the Mayfair Theatre; o Establishment of a live theatre that contributes to the culturai divers~ty of the City and the Bayside District; and o Development of a strategy to identify ather appropriate theatre rela~ed uses for the building. - 15 - OTHER ISSUES The Council also addressed a variety of other issues. It was stated that amus~ments and game arcades sh~uld be prohibited in the area. This recommenda~ion, which excluded the pending application for a Virtual Reality center, has been incorporated into the interim ordinance. The potential of overflow parking impacting the Nor~h of Wilshire reszdential neighborhoad was also noted by some Councilmembers. As recammended, a pa~icy has been prepared stating that requests for a Preferential Parking District in this neighborhoad shali be quiekly processed. It was fur~her suggested that live theatre and cultural faailities and events be encouraged uses. This has been addressed in the policy raco~mending preservation af the Mayfair Theatre. Finally, the function and purpose of Fourth Street was discussed. The key concerns were how to generate additional activity on these streets, should the priarity be to make Fourth Street pedestrzan oriented ar should the street be retained as a traffic corridar. ~nee the Faurth Street on ramp is opened and new traffic patterns have been established, Parking and Traffic Engineering staff wi11 report back to the Bayside District Corporation and the City Caunc~Z regarding the BDC's requ~sts for on street parking, removal of left turn limitations on Santa Monica Boulevard, and loading zones on Fourth Street. In order to address the concern regarding parking in the north of Wilsh~re residential neighborhood{ the following policy is recommended for inclusion in th~ Parking Section of the Specific Plan Circu~ation Element. - 16 - Palicy Addition #9 In order to pratect the north of Wilshire residential neighborhood fram Sayside District related overfZow parking, the C~ty shall expeditously pracess preferential parkirig district requests. INTERTM ORDINANCE The limitations on alcohaZ outlets and food s~rving establishmants set forth in the attached dratt interim ordinance have been based upQn the recommended Specific Plan policy changes and additians dis~ussed in this report. The section by section analysis of the ordinance prepared by the City Attarney's office is contained in Attachment A. The ardinance establishes a limitation by block on alcahol serving restaurants and bars and establishes a limitation by block on the total number of food serving establishmen~s. In addition, th~ ardinance prohibits future game arcades in the Bayside District. BUDGETIFINANCIAL IMPACT The recomn~endation pr~sented in this r~port does nat have a direct b~dget or fiscal impact. Future land use changes permitted by impiementation of the proposed polici.es may have future fiscal impacts to the City which have not besn analyzed at this time. Upan completian of the City's FIND model, an analysis can and wiZl be done as pa~t af th~ environmental review process. The preparation of an enviranmerital impact report was not budgeted in the FY 92/93 budget. Once a consultant is selected - 17 - and the cost is finalized, staff will return with a recommendation as to appropriating the needed funds. RECOMMENDATION It is recommended that the City Council conceptually approve the draft Bayside District Specific P1an with the revzsed and added policies recommended in this report, authorize staff to begin preparation of an environmental impact repart and return with se~ection of a consultant and request ~or an appropriation to fund the EIR, direct the Planning Commission to initiate a Resolution af Intentian ta amend the Zaning Ordinanca to create a Bayside Zoning District, and adopt an ordinanee prohibiting game arcades and estab3ishing Iimitat~ons on the number of alcohol and food serving establishments in specified portions of the C3 and C3G districts on an interim basis. The Ordinance is attached as Exhibit "A." SECTION-BY-SECTION ANALYSIS SECTI~N 1. This Section sets forth the finding and purpase far the ordinance, including the findings necessary for interim and urgency ordinances. Section 2. This Section defines terms used in the Ordinance. This Sect~an establishes the number of food serving establishments, including existing establishments, which will be allowed on a block by block basis, and differentiates between those which do and do not serve alcahol. Section 7. This Section provides that no new game arcades will be allowed in the Proposed Bayside District. Section 8. This Section pravides that the Ordinance is effective for 45 days unless lawfu~ly extended. Section 9. Findings and Purpase. The City Council finds ~ and declares : ~°`' ~ {a) At its August Z1, 1992 City Council meet~ng, the City Counci~ held its fzrst public hearing regarding the establishment of a Bayside District zoning district ("District~~) which will encompass partions of the current C3 and C3C zoning districts. (b) At the same meating, the City Cauncil cons~der~d the adoption of the Bayside District Specific Plan which, among other things, proposes limits on the number of alcohol and foad serving establishments which wil~. be allowed in the District, and would prohibit entire~y the establishment o€ new game arcades. (c) Further action is needed lay the City council to establish the Bayside District zoning district and to adopt the - 1 - Bayside Di~tr~ct Specific Plan, inc~uding completion of enviranmental review under the Califarnia Environmental Quality Act ("CEQA"). Further, the City Council will consider at a later meeting the adop~zon of spec~fic zoning ordinances regulating permitted uses and praperty development standards in ~he District cons~stent with the Specific Plan. {d) If current develapment activ~ty is allowed to continue in the District pending such final approval, uses incompatible with the propased Bayside ~istrict 5pecific Plan and zoning ordinance impiementation will occur. (e) Pending the establYShment of the Bayside District and adaption of aoning ordinances implementing the pravisions of the Bayside District Specific Plan, to protect the pub~ic hea~th, f- safety, and welfare, it is necessary ta ~.imit ~the number of alcohol and foad serving establishments ~n the District and to prahibit uses incompatible with the proposed 5pecafic PZan and implementing ordinances on an interim basis. (f) The City wishes ~o limit the number af alcohal and food serving establishments as a way to control the recent proliferation of such establishments in the area and alsa to encourage other types of uses. Because of the praliferation of alcohol and food se~ving establishments, there exists a current and immediate threat to the public hea~th, safety, ar welfare, and the approval of additional administrative approvals, develapment review permits, conditional use permits, or any other applicab~e entitlements far use in the Distr~ct incompatible with - 2 - ~J„ .J the standards of this interim ordinance wauld result in a threat to pubiic health, safety, ar welfare. SECTIDN 2. Definitians. Appl~ca~i~ity. The provisions of this Ordinance apply only to applicatians for projects ta be l~cated in the Propased Bayside District, and only ~o proaects the application f~r which was filed after August 11, ?992. Any pro~ect which has received a conditzonal use permit, admin~strati~e approval, ar alcohol exemption determinatian on ar befare the effective date of this Ordinance shall be exempt from the provisions of this Ordinance. SECTION 4. Appraval of all new alcohol or food serving establishments to be located in the Proposed Bayside District which do not otherwise require the issuance af a canditional use per~~t, alcohol exemptian determination, or development review permxt, sha~l require the issuance af an administrative approval. For purposes of this Ordinance, an establi~~.ment shall he ~ considered a new alcaho~ or faod serving establishment if the prior alcohol or faad serving estab~ishment at that site has ceased operation for a continuous period af six months or longer. SECTION 5. SECTI~N 8. This ~rdinance shall be of na further force or effect 45 days from its adoptian, un~ess extendad in the manner xequired by law. SECTION 9. This Ordinance is dec~ared to be an urgency measure adopted pursuant to the provisions of Section 9120.6 of the Santa Monica Municipal Code and Section 6.15 af the Santa ~a'~ Monica City Charter. There is a current and immediate thzeat to the public health, safety, and welfare. It is necessary for preserving the public peace, health, safety, and wel~are and the urg~ncy for its adoption is set for~h in the findings above. SECTION 10. Any pro~islon af' the Santa Monica Munlcipal Code ar appendices thereta inconsistent with the provis~ons of this Ordinance. to the extent of such inconsistencies and no further, are hereby repealed or modified to that ~xtent necessary ~a affect the provisions of this Ord~nance. SECTION il. If any sectian, subsection, sentence, clause, or phrase of this ardinance is for any reason held to be ~nvalid or unconstitutional by a decision of any court of any competent - 9 - ~" ^ '7 L ,1 :. , i.. jurisdiction, such decis~on shall not affect the validity of the remaining pvrtions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every sectian, subsection, sentence, clause, ar phrase not declared inva~id or unconstitutianal without regard to whether any portion af the Ordinance would be subsequent~y declared invalid or unconstitutional. SECTION 12. The Mayor shall sign and the City Clerk shall attest to the passaqe of this ~rdinance. The City Clerk shal~ cause the same to be published once in the official newspaper within 15 days after its adoptian. This ord~nance shall become effective upon adoption.
