SUBJECT: Award of Contract to Repair Various city Roofs and to
Construct Miscellaneous Building Improvements
Introduction
This report recommends that city council award a contract to repair
various roofs at City facilities, replace the air conditioning system
at Information Systems Department in City Hall and install a fire
sprinkler system at the Santa Monica Municipal P~er to J. Cab and
Sons, Roofing Contractors, the lowest responsible bidder, in the
amount of $175,762.00.
Background
During the FY 1991-92 budget process, City Council approved funding to
replace and repair various City facility roofs. The criteria used was
based on age and the frequency of leaks noted by staff and maintenance
crews in addition to evaluations by an outside roofing consultant.
The roofs to be replaced and or repaired are:
- Arcadia Water Treatment Plant, which includes the following:
Lab and Garage
Mechanical and Storage Buildings
Industrial Waste Office
Control Building
Regeneration Pump station

The scope of work also includes replacing and upgradlng the air
conditioning system in Information Systems Department at City Hall,
which serves the existing office area, and installing fire sprinklers
at the Santa Monica Pier as requested by the Santa Monica Fire
Department.
A Notice Inviting Bids was published on May 6 and 7, 1992, in The
Outlook. Plans and specifications were sent to five construction
journals, and was sent to seven WMBE associations. Plans and
specifications were issued to nine contractors. On May 18, 1992, five
bids were received, publicly opened and read aloud by the Deputy City
Clerk.
The Bids received were as follows:

City Engineer's Estimate $176,000.00
The low bidder, J. Cab and Sons, Roofing Contractors, supplied the
City with five references. All references reported that the
contractor's work was satisfactory. The California State Contractors
License Board (CSCLB) has verified that the prime contractor, J. Cab

and Sons, Roofing Contractors, has a "C-39" License and it is in good
standing.
The CSCLB verified the subcontractor for the air conditioning work,
LEC Service, Inc.'s license as "C-20" (Warm-Air Heating, Ventilating
and Air-Conditioning Contractor) and it is in good standing. The
CSCLB also verified the subcontractor for the fire sprinkler work,
Kimble & Company's license as "C-1611 (Fire Protection Contractor) and
it is in good standing.

Recommendation
It is recommended that City Council:
l. Award a contract to J. Cab and Sons, ROOfing Contractors, to
repair various City facility roofs, replace the air conditioning
system at Information Systems Department in City Hall and install
a fire sprinkler system at the Santa Monica Pier.
2. Authorize the city Engineer to issue any necessary change orders
to complete additional work in conformance with the
Administrative Instruction on change orders.

The alternative would require that at least 50% of the required
front yard be unexcavated without requiring that the area be
provided along the front half of the required front yard. staff
believes this alternative is preferable for several reasons:
- Parking requirements often pose a constraint on the
number and/or size of residential units permitted to be
developed on a site. Particularly in light of the
recent Proposition R Ordinance requirements for on-site
inclusionary housing, it may become a trend that
increasing numbers of projects elect to apply the state
density bonus, in which case parking becomes an even
more crucial development constraint. A simple 50%
requirement would allow more flexibility in
subterranean parking design.
- The flexible placement of the 50% unexcavated front
yard area would enhance the overall percolation and
drainage capacity of City soils above the proposed
Ordinance because it would not allow the exemption of
required driveway areas within the front yard.
- The flexible arrangement of the front unexcavated area
would permit correspondingly greater flexibility of
landscape design, particularly as relates to the
placement of mature trees. In this manner, the
Architectural Review Board would have greater
discretion in requiring specimen trees and other
deep-rooted landscaping to be placed closer to the

are assessed for streetlighting based on the property size.
Residential owners are assessed 50% of their front footage and for
corner lots, 20% of their side footage costs, with the city paying the
remaining 50% and 80%, respectively. commercial property owners are
assessed 100% of their front footage and 40% of the side footage costs~
with the city paying the remaining 60% of the side footage costs.
Successful streetlight petitions contain the signatures of a minlmum of
sixty percent (60%) of each block's residents.
Petitions are then presented to City Council and a pUblic hearing to
hear protests is set. After the public hearing the City Council
orders the work to begin. The project is competitively bid by private
contractors, a contract is awarded by City Council to the lowest
responsible bidder and bonds are authorized to be sold. Owners may pay
for the improvements over ten (10) years at an 8.8% interest rate..
The petitions for Streetliqht Installation
At the request of residents, staff prepared streetlight petitions for:
ARIZONA AVENUE - From Franklin street to Centinela Avenue
CALIFORNIA AVENUE - From Twenty Fifth st. to Twenty sixth st.
THIRTIETH STREET - From Pearl street to Ocean Park Boulevard
YALE STREET - From wilshire Boulevard to Washington Avenue
A minimum of sixty percent (60%) of residents of these streets
requested installation of streetlights. Rent Control staff has
reviewed the petitions and determined that they conform with Rent
Control Regulations for pass-through of assessments.
A meeting between staff and petitioners was held on April 1, 1992, to
discuss the location of the streetlights, types of streetlights
(decorative vs. standard) available and the approximate costs to the
property owners. Only the property owners on Yale Street requested the
more expensive decorative streetlights for their block. Hence, their
share of assessments will be higher than the other blocks that
requested the standard streetlights. The City pays only 50% of the
cost for the standard streetlights and property owners choosing the
decorative streetlights will be required to pay the difference between
the standard streetlighting and the decorative streetlighting.
Staff is presenting these petitions to City Council for acceptance and
requesting that a public hearing be set for July 28, 1992, to hear
protests, if any, and approve the establishment of an assessment
district in accordance with the Improvement Act of 1911 of the streets
and Highways Code. Notices will be posted and property owners and
residents will be notified by mail 15 days in advance of the public
hearing, of the time and place of the public hearing.
Copies of the signed petitions and a map of the proposed assessment
district will be available in the Council Chambers at the tlme of the
Public Hearing.
The Proposed Streetlight Replacement on San Vicente Boulevard
The Capital Infrastructure Needs Assessment study, completed in
February of 1984 and presented to city council, recommended that
deteriorated and energy-inefficient streetlights be replaced at various
locations throughout the city. Several streets needing circuit and
pole replacement were identified in the study and staff has determined
that the streetlight system on San vicente Boulevard from Fourth Street
to Seventh Street is in most need of replacement. This determination
was based on the number of actual repairs made and the number of

repairs planned to maintain the 72 year old, badly deteriorated system
on San vicente Boulevard.
Staff held a meeting with property owners and residents on February 20,
1992 and they were in support of this project. Assessments for San
vicente Boulevard are proposed to be the same as those on Yale Street,
since decorative streetlights will be installed. staff is recommending
that streetlights be installed on these streets for the safety and
convenience of the residents. Notices will be posted and property
owners and residents will be notified by mail 15 days ln advance of the
public hearing, of the time and place of the public hearing.
The City's portion of the assessment costs will be financed out of the
annual streetlighting Capital Improvement Project account. A grant
program will be available for low to moderate income households.
BUDGET/FINANCIAL IMPACT
The total estimated cost for the project is $220,000.00. The total
estimated assessment is $26.80 per foot of property frontage. The
estimated prorated assessment for residential property owners is $13.40
per front foot. Property owners on Yale street and San Vicente
Boulevard will be assessed approximately $17 per front foot.
city council previously held public hearings and approved the
construction of streetlighting on Twenty Fourth street between Wilshire
Boulevard and Arizona Avenue and sixth street between Santa Monica
Boulevard and Arizona Avenue and these two blocks in addition to the
blocks mentioned in this report, will be combined into a single
construction contract.
The estimate for a typical residential property owner's share is
approxlmately $690 for a 50 foot lot frontage with the City's share
being an equal amount. Yale street and San vicente Boulevard property
owners will pay approximately $850 for a 50 foot lot and the City's
cost would be $690. The proposed breakdown is as follows:
Estimated property owner assessments $119,300.00
Estimated City contribution 100,700.00
Total project estimate $220,000.00
Appropriation authority for the City's contribution is avallable in CIP
Account No. 01-770-453-25491-8917-99155, "New streetlight Systems" in
the amount of $68,800.00, for the new streetlights and account no.
01-770-453-20092-8900-99154, "streetlight circuit Replacement" in the
amount of $46,100.00, for the streetlight replacements. The remaining
costs for the project will be paid through property owner assessments.
Assessments will be paid upon completion of the work and will be held
in a trust account #80-000-000-00000-9750-04289 pending payment to the
contractor who installs the lights. Bonds are then issued for any
unpaid assessments. Bond proceeds are paid to the Contractor and the
property owner(s) then payoff the bond holder(s) over time.
RECOMMENDATION
It is recommended that City Council:
l. Accept the streetlight petitions for the installation of
streetlights on:
Arizona Avenue - from Franklin Street to Centinela
Avenue;
California Avenue - from Twenty fifth Street to Twenty
sixth street;
Thirtieth street - from Pearl street to Ocean Park
Boulevard, and
Yale street - from Wilshire Boulevard to Washington
Avenue.
2. Approve the replacement of streetlights on:
San vicente Boulevard - from Fourth street to Seventh street
3. Adopt a Resolution of Intention which sets a public hearing
for July 281 19921 and declares the City'S intention to assess
property owners for costs and issue bonds as security for unpaid
assessments.

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC HEARING ON JULY
28, 1992 FOR THE PURPOSE OF DETERMINING WHETHER OR
NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF STREET LIGHTING AND DECLARING ITS
INTENTION TO CONSTRUCT STREETLIGHTING, REPLACE
DETERIORATED STREETLIGHTS AND APPURTENANT WORK ON
VARIOUS CITY STREETS AS SHOWN ON CITY DRAWING NO.
10042 WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City council of the City of Santa Monica proposes
to initiate proceedings under the Improvement Act of 1911 for
streetlighting improvements~ and
WHEREAS, Section 19 of Article XVI of the Ca11fornia
const1tution provides that certain specified debt limitation and
majority protest provisions shall not apply, if after the giving of
such reasonable notice by publication and posting and the holding of
such public hearing as the city council of the City of Santa Monica
shall have prescribed, the city council by no less than four-fifths
vote of all members thereof finds and determines that the public
convenience and necessity require the proposed improvements to be made~
and
WHEREAS, Streets and Highways Code Section 2804 provides that
the "Special Assessment, Investigation, Limitation and Majority Protest
Act of 1931" shall not apply to any proceeding otherwise subject
thereto when said improvement proceeding is by a charter city and said
city has complied with the provisions of Section 19 of the Article XVI
of the California Constitut10n; and
WHEREAS, the City of Santa Monlca is a charter city of the
State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The city Counc11 proposes to initiate proceedings
for the lnstallation of streetlighting and appurtenant work on the
streets shown on City Drawing No. 10042 and generally known as, Phase
VI - Construction of High Pressure Sodium streetlight systems on :
ARIZONA AVENUE - from Franklin Street to Centlnela Avenue~
CALIFORNIA AVENUE - from Twenty Fifth st. to Twenty Sixth st.:
THIRTIETH STREET - from Pearl Street to Ocean Park Boulevard:
YALE STREET - from wilshlre Boulevard to Washington Avenue,
all wlthin the City of Santa Monlca.
SECTION 2. The City Counc11 proposes to initlate proceedings
for the replacement of deteriorated streetlighting and appurtenant work
on the street shown on City Drawings No. 10042 and generally known as:
SAN VICENTE BOULEVARD - from a portion of Third st. to Seventh st.
SECTION 3 . The total estimated cost of the proposed
improvement is Two Hundred Twenty Thousand Dollars ($220,000) .
SECTION 4. Improvements shall be conducted under the
Improvement Act of 1911, which 1S Division 7 of the streets and
Highways Code of the state of California.

SECTION 5. The proposed work or lmprovement in the opinion of
Clty Councll of the City of Santa Monica is of more than local or
ordinary public benefit, and City Council hereby proposes that the
district in the City of Santa Mon1ca to be benefited by said work or
improvement and to be assessed to pay one-half of the cost and expense
thereof, is shown upon a certain map indicating the exterior boundary
thereof, which said Drawing No. 10042-A is on file in the Office of the
City Englneer. The map hereby is referred to and shall govern for all
detal.ls as to the extent of said assessment district. The assessment
district l.ncludes in general the lots and parcels described in section
1 above but reference hereby is made to said Drawing for all details as
to the extent of sal.d assessment district and for any variation between
the last mentioned general description and the extent of said
assessment district as shown on said map. All public streets or
alleys, or portions thereof, hereby are excepted from said distrl.ct.
SECTION 6. The City wlll pay a portion of the cost and
expenses of the work described herein, and the city Controller is
authorized and directed to pay the same lmmediately upon confirmation
of the assessment by City CounCl~.
SECTION 7. Serlal bonds bearlng lnterest at the rate of 8.8%
per annum shall be issued to represent each assessment of One Hundred
Fifty Dollars ($150.00) or more remaining unpald for thirty (30) days
after the recording of the warrant. Said serial bonds shall extend
over a period ending nine (9) years from the second day of January next
succeedlng the next September 1st following their date. Payments on
the principal of unpaid assessments and interest shall be made by
property owners to the City Treasurer and the same shall be disbursed
by hl.m or as provided in the II Improvement Act of 1911" herelnafter
referred to. In accordance Wl.th Streets and Hl.ghways Code
Section 6442, the first two percent delinquency penalty authorized by
such section shall be retained by the City Controller as the cost of
servicing the delinquency.

Clerk.
SECTION 11. The city Clerk hereby is directed to publish this
Resolution in The Outlook on two successive dates, the first
publication is to be made not less than fifteen (15) days prior to the
date of the above public hearing.
SECTION 12. Pursuant to Public contract Code section 20433,
the City Council hereby states that the property owners may not
contract for the improvements and that the City shall be responsible
for lett1.ng and administering the construction contract for this
district.
SECTION 13. The City hereby declares that Commun1.ty
Development block Grant funds may be applied for payment of assessments
on property owned or resided in by low to moderate income households.
SECTION 14. The C1.ty Clerk shall certify to the adopt loon of
this Resolution, and thereafter the same shall be in full force and
effect.
