SUBJECT Resolution to Set a Public Hearing on February 9, 1999 to Confirm
Assessment Costs for the FY 1996-97 Annual Street Resurfacing Program
and Appurtenant Work on Various City Streets
Introduction
This report recommends that the City Council set a public hearing on February 9, 1999 to
confirm the assessment costs for the Annual Street ResurfaCing Program and hear
protests regarding the completed work These Improvements were performed In
conjunction with the FY 1996-97 Annual Street ResurfaCing Program at vanous
commercial, Industnal, and residential locations
Background
The FY 1996-97 Annual Street ResurfaCing Program Includes gutter construction, street
resurfacing, alley Improvements, slurry sealing, parkway pavement removal, curb ramp
construction, curb and gutter repairs, bus pad construction, and Sidewalk and driveway
repair and construction at vanous locations In the City The cnterla used to determine the
streets and alleys Included In the program and the method of repair Include. age, drainage
problems, surface and subsurface conditions, complaints received, type of use (I e ,
commerCial or residential), current traffic volume, and projected change of use or traffic
volume

Consistent with the Sustainable City gUidelines, 100% of the eXisting pavement was
recycled and approximately 30,000 used tires were added to the asphalt mix used In the
resurfacing
In accordance with the 1979 City Council policy, reSidential properties are assessed at one
half the cost of removal and replacement of damaged curbs, Sidewalks, dnveways, and
parkway pavement Commercial properties are assessed the full cost of the repair of this
work Residential properties are not assessed for new concrete gutter construction or
street resurfaCIng, however, commercial and Industnal property owners are assessed the
full cost of the repairs The assessments are calculated such that all commercial and
Industnal property owners pay the same unit cost regardless of the Width of the street
affecting their properties. A tYPical assessment for a commercial or Industnal property
owner with a 50-foot lot IS $1,075 for street resurfacing and $900 for new gutter
construction Consistent With recent City policy, assessments Will be waived for non-profit
organizations that can prOVide eVidence of receiving a welfare exemption from the Los
Angeles County Tax Assessor.
DISCUSSion
On September 25, 1997, notices of the City's Intent to form a street resurfacing
assessment dlstnct and hold public hearings were posted and mailed In accordance WIth
State law to all affected property owners The public heanngs were held on November
11,1997, and November 25, 1997 After clOSing the public hearing, the City Council

ordered the work to commence
The 1996-97 Annual Street ResurfacIng Program IS complete and property owner
assessments are now due A public heanng to confirm the assessment costs must be held
pursuant to Section 5882 of the Callforma Streets and HIghways Code The attached
resolution sets the public heanng for 7 00 P m on February 9, 1999 All affected property
owners will be notified of the public hearing date and the assessment amount at least 45
days prior to the public heanng A list of property owners and assessment amounts will
be available to the City Council at the time of the publIc hearing

Assessment" after construction costs have been confirmed Additional revenue In the
amount of $117,424 38 for the repair of Sidewalks, dnveways and curbs, and parkway
restoration Will be deposited In revenue account no 01-500-421-00000-0179-1 DODO,
"Sidewalk Repair Revenuen after construction costs have been confirmed Any unpaid
assessments Will be placed on the 1999-2000 property tax roll by the los Angeles County

Recommendation
Staff recommends that the City Council adopt the attached Resolution setting a public

SECTION 1 The Supenntendent of Streets Will file a report of work pursuant to
Section 5882 of the Streets and HIghways Code of the State of California, relating to the
construction of certain Improvements as follows

roll by the Los Angeles County Assessor's Office
SECTION 4 All protests or objections must be In wrltmg and filed with the CIty
Clerk on or before the tIme set for the hearing of the protests and objections
SECTION 5 City Staff IS hereby directed to mall notices, pursuant to Government
Code Section 54954 6, In the manner and form prescribed by law, of the cost of the
Improvements and the adoption of thiS Resolution to all persons ownmg commercIal,

SECTION 6 City Staff IS directed to publish thiS Resolution, In accordance With
Government Code Section 6063. In a newspaper of general Circulation printed and
published In the City, once a week for three weeks With at least five days mtervenlng
between each date of publication The first publication IS to be made not less than 45 days
