To support this assertion, they have submitted an operat~onal traffic study conducted by Kaku Associates (Attachment E} The study in~alved f~eld observations fram 7 3Dam to 5 QOpm on VIlednesday, April 16, 1997 to provide an assessment of the vehicular-pedestrian conflicts at the dri~eway and the merits of a dri~eway ciosure The conclusion of the study indicated that a relatively low numberofvehiclesusetheFourteenth Streetdnvewayw~th a minimal numberofvehicular- pedestrian confl~cts Fur#her, accident data indicates that no accider~ts have occurred over the past four years ta ~ehicles ar pedestrrans at the drf~eway The analys~s determmed that the closure af the Fourteen#h Street driveway will crea~e adclitional turn~ng movements (some potentially problematic) from the servECe station's Pico Boule~ard dnveways By retaining the Fourteenth Street dri~ewaywith a right-turn only restr~ction, dr~vers will be less mcl~ned #o e~rcle th~ resident~af neighborhood or cross multrFle traffic lanes on P~ea Baulevard to psoceed west o~ Psco Baulevard after exstmg the service statio~ ~ Parkinq and Traff~c Engineer Analysis In order to est~mate #he traff~c ~mpact of the praposed psosec#, the Park~ng and Traff~c Engineermg DivFSion compared actuaf peak hour traffic caunts of the existing Texaco service statron in Santa Monica with a Texaco station w+th convenience store at Ventura Boulevard and L~ndfey Avenue m the San Fernando Valley This Texaco stat~on was j~dged ta be comparable ta the praposed pro~ect because the site ~~ aiso located on t~e carner ot an intersection with access driveways on both streets and the station was renovated to its current configuration which includes eight p~mps and a car~ven~ence store The reta~4 sales axea of the proposed convensence stofe at P~co Bo~Is~arcS and 44'h Street is comparable in size with the existing Texaco stat~on at Ventura and Lmdley, buf overall is somewhat larger to accommodate mare storage, restrooms, and wider aisles The traffic counts at the exist~ng Texaco station a~ P~co Boule~ard were conducted on Tuesday, March 17, 1998 dur~ng a periad that Santa Monica Coll~ge was in sess~on The counts ind~cated that during the morr~ing peak hour, there were a total of B4 vehicle trips to and from the s~fe, dur~ng the afternoon peak haur, a total of 74 ~ehicle trips were observed to and from the site Average daily traffic volume informatron from 1996 ~ndicates that the #otal tra~c on Pico Boulevard is approximately 2 ~,40Q ~ehicles per day, tF~e traffic ~olumes on 14t~ Street are approx~mately 7,400 veh~cles ~er day The traffic counts observed at the Texaco station at Ventt~ra Boulevard and Lindley Avenue were conducted on Wednesday, July 15, 1998 Durmg the morning peak hour, a totaf af ~85 vehicie trips were obsei-ved t~ and from the srte; during fhe afternoon peak 5 hour, a totaf of 1~ 6 vehicle trips were observed #o and from the site Average daily traffic vaEumes from 'l99S ~nd~cate a tata{ of app~oximately 39,000 vehicles per day travel or~ Ventura Boule~ard En this area while approximately 11,000 ~ehicles per day on Lindiey Aven~e The companson of the two stations, whic~ are simiiar in their layout, configuration and retail sales area, shows that the Vent~ra SoulevardlLind[ey A~enue Texaco stat~on has 121 more ~eh~cle trips durmg the morning peak hour and 42 mvre vehicle trips during the aftemaon peak hour thar~ the ex~st~s~g vel~icle tr~ps associated wtitt~ the Pica Bo~se~ard station However, since the daily traffic volum~ counts in #his area are nearly doubl~ those at P~co Boulevard and 14~' Street, a greater number of peak ho~r trips is expec#ed at the Ventura Boufe~ard/Lindley Avenue stat~on In addit~on, the Ventura Boufe~ardlLindley A~enue stat,on has a muc~ higher percentage ot veh~cle ma~ements exitmg onto tne side street (Lindley Avenue) thar~ the P~co stat~on has ex~t~ng onto 14`h Street This ~s d~e to diffic~lties exit+ng onto Ventura Boulevard, which is a much bus~er stree# than P~co Boulevard Based an the mformation reviewed to date, staff contmues to recommer~d Irmited access to the Faurtsenth 5treet dr~~eway by prohibiting left turns mto and out of the driveway, allowmg ng~t turns oniy While the defineators originally proposed by the applicant are effecti~e in prohibitmg left-turn veh~cle movements, theytend to be unatt~active and requ~re frequent repair and repfacement As an alternative to the delineators, staff recommends redesign~ng the Fou~teent~ Street d~+~eway to ~r~stall a tr~a~gular-shaped channelization s is~and (Attachment G, Ger~eral Arrar~gement Draw~ng G-1) Th~s redesign would ailow right-turn ~ehide movements but would proh~bit left-turns entering and exiting the site at this locati~n By allowmg right turns out of the site onto Fourteenth Street, vehicles wifl be able to proceed west or~ Pico Boulevard wifhout c~rcling into the residentia! neighborhood or crossing multiple lanes of traffic on Prcfl Boufevard Staff belie~es this design resafves the Plannmg Commission concems regardrng traffic averflow mto the neighborhood Condition #24 reflects this recommendation GEQA STATUS The pro~ect ~s catego~icaEly exempt fram the pro~~sions of the California Env~ronmental Quali#yAct ~CEQA} pursuant#o Class 1 of the State Guidelmes in that #he proposed pro~ect includes the additron ot a con~enience store #o an existing service station by converting ex~st~ng service bay area resulting m no additional square footage, and therefore the pro~ect as proposed w~ll result in a negligible expansion of use PUBLIC NOTiFICATION In accordance with Section 9 Q4 20 24 030 (5MMC}, natice afthe public hearing has been sent ta the owners and occ~par~ts flf property w~th~n a 500` ~adws of the s~bJect pro~erky and ~as been ~ubl~shed in tne Argonaut at feast ten days prior to ti~e Councd hear~ng (Attachment F) BUDGET/FINANCIAL. IMPACT The recommendat~on presented in this report does nof have any budget orfiscal impacts ~ RECOMMENDATION It Es recommended that the City Cauncil averturn the determination of the Planning Commission, uphold the appeal and approve CUP 96-023 as currently proposed by the applicant, with the reduction in size of the outdoor seating area to 250 square feet, based upon the following find~ngs and conditians CONDITlONAL USE PERMIT FINDINGS The praposed canvenience store is condit~anally perm~tted within the sub~ect district and camplies w~th all of the applicabfe pro~isions of the "City af Santa Monrca Comprehens~ve Land Use and Zon~ng ~rd~nance," ~r~ that self-servECe gas stat~ons with con~en~ence stores are conditionally permitted witi~in the C2 Zaning District 2 The proposed con~en~ence store use would not impair the integrity and character of the distr~ct ~n which it is ta be established or located, ~n that the C2 Distnct allows a range of neEghbarhood-serving commercial uses ~nc{uding self-s~rvice gas stat~o~s with convenience stores 3 The subject parcel is physically surtable for t~e type of lar~d use b~mg proposed, in that the existing building will not be expanded in size, the sub~~ct prope~y is nearly double the minimum size required for a self-service gas station with a conWenience store and is a graded parcel w~th adequate ~ehicuiar access 4 The proposed uses are compatible wath the land uses presently on the sub~ect parcel, in that the site is currentlyoccupied by a small food mart within a self-service gas station and the expansion of the convenience stare is compatible with these on- site uses 5 The proposed uses are campatible with exis#ing artd perm~ssible land uses within the district and the general area in which the proposed uses are to be lacated, in that a self-ser~iee gas stat~on with a mini-market is conditionally permitted in the C2 Zoning District, and such uses provide a con~enient service for local r~s~dents which is consistent with t}~e purpose of the C2 District 6 There are adequate prflvis~ons forwater, sanitation, and public utifities and services to ensure that the proposed ~ses woulc! not be detrirnental to public health and safety, in that the proposed pro~ect utilizes existing square footage to accommodate the add~tion ofthe convenience store establishment requiring a minima! mcrease m the need for pub[ic utilities 7 Public access to the praposed use w~ll be adequate, ~n that vehicufar ingress and egress w~N be pro~tide~ f~om P~co 8oule~ard and F'aurtee~th Sfreet ar-d pedestr~ar~ access is provided from both Pico Boul~~ard and Fourteenth Street to the convenience store and a bicycle rack with four ~4) bicycle parkir~g spaces ~s provided 8 The phys~cal locat~an or g~aceme~t of the uses on tF~e s~te ~s compat~ble w~th and relates harmoniously to the surraunding neighborhaod, in that the proposed pro~ect wdl pro~~de a seif-servi~e gas station and convenience store which will serve the immedEate residential ne~gl~borhood as weN as the nearby businesses and institutions includmg the Y W C A lacated ad~acent to the sub~ect property and Santa Monsca College located two b~ocks ta the east SUbs#antial landscaping ~s propased w~ich will buffer the propo5ed uses on site from the ad~acent land uses 9 The proposed use is consistent wi#h the goals, ob1ectives, and policies of the General Plan, in that it is cansistent with l~and Use and Circuiation Element Ob~ect~ve #1 7 wh~ch sta#es that the City shal{ "Protect a~d ~xpand uses that provide for the day-ta-day shopping and service needs of nearby residents," and that "The City shaA encourage the pro~~sion of neigh~arhood cammercial services w~thin walking distance of alf neighborhoods " The proposed pro~ect provides a service station wF~ich serves, in part, the day to day ~ehicular needs of the nearby commun~ty and a convenience store is pro~ided ~~ a walkable, co~~en~ent lacat~or~ for nearby residenfs 10 The proposed us~ would not be detrimental to the ~ublic ~nterest, health, safety, convenience, or general welfare, in that service station w~th a con~en~ence store is cond~t~ona4ly perm~tted w~th~n the C2 Zfl~mg Distr~ct and ~s tin compliar~ce, as approved, with the appEicable standards and spec~af conditions contained rn Subchapter 9 04.~4 of the City of Santa Monica Comprehensi~e Land Use and Zoning Ordinance and that ~he proposed prolect involves the creatron of a con~enience store within the service staf~on which ~s conditioned wfth landscaping and screenmg wal{s to buffert#~e use from adjacent res~cie~t~af and ~nststut~ona! uses and is campatible with the adJacent residentiai, business and mstitutional uses in the area 11 The proposed t~ses cornply precisely with the appl~cable standards and special cond~t~ons eonta~ned m Sub~hapter 9 44 14 0~ the C~ty af Santa Mon~ca Comprehensive Land Use and Zoning Ordinance regarding serv~ce stations with convenience stares and those standards are included as cond~tions of this approval, in thatthe proposed proJectwill pro~idethe required landscap~ng, waifs, parking and traffic c~rc~la#ion, trash and recycling areas, fitter removal, air and wafer dispensers, I~gt~t~s~g, and telephones and assoaa~ed ~a~se and vehticu~ar congesttian wiN not impact surrounding residential uses as the hours of operatian of the convenience store are cansistent with the hours of operatian of the serv~ce station s 12 The proposed ~ses wifi not result m an avercancentration of such uses ~n the immediate v~cinity in that the pro~ect ~nvolves the creafion of a can~enience store within an service station and this cambination of uses is m fimited numbers in the vicinity. CONDITIONS Plans This appr~val is for thos~ plans dated December 19, 1997, copies of which shall be maintained in the files of the City Plann~ng D~~ision.
