INTRODI7CTI~N
On December 8, 1992, City Council directed staff to evaluate
possible changes ta th~ starting time of City Council meetings.
As stated by the Council, the primary purpose of starting the
meetings earlier is to complete the proceedings earlier. This
report presents information an options available to the Council
regarding modification of the starting time af Council meetings.
$ACKGROUND
At the December 8 meeting, a proposal was presented to change the
starting time for City Council meetings. The original prflpasal
presented to the Council involved hearing a number of more
routine agenda items starting at an earlier time and then waiting
unt~1 7:30 p.m. to hear agenda items that generate greater public
input and znterest. This proposaZ would require the Council to
wait until 7:30 p.m. to hear ag~nda items such as appeals and
ordinances regardless of what time the Council completed its
action on the routine matters. The Council discussed this

BACKGROUND
The Planninq CDm~~66~0II denied the applicants~ request for
Tentative Parcel Map 21159 and Varianca 9Z-013 on June 3, 199~ to
allow the subdivi6ion of an 11,518 sq.ft. pa~ce3 in the R1
(Single Family Residential) Di~trict with two existing on-site
single family dwellings into two parcels, one equal to 6,243
sq.ft. (Parc~l 1) and th~ other ~qual to 5,Z~5 sq,ft. (Parcel 2y
(Attachment H). -
The existing 11,518 sq.ft. parcel fs locatad on the northwest
corner of 23rd Street and Dewey street in tY~e R1 District. An
alley is located to the north. A radius and location map is
included as Attachment F. The exi~tinq parcal dimensione are
shown an Attachment J. As indicatad on the Tantative Parcel Map,
the parcel has a elightly frreqular trapezoiaal shape. Two
existing, one-story single family structures af 1,453 sq.tt. and
1.125 sq.ft. exi~t on-site. A two car qaraqe with alley acce~s
exists for the residance at th~ rear. An attach~d two car qarage
exists for the residence at tha front of the property with
existing acc~s~ ~rom 23rd Street. No chanqes are proposed to
existing on-site structurea.
The subdivisioa of the sxistinq parcel ~nto 2 paraels is proposed
so that separata owr~erahig may be obtainad (Attnchmant A) , with
one residence on each parcel. Parcel 1, with frontaqe along 23rd
Street and the alley~to the north, hae a 59' dapth and a 107'
width for a tatal of 6,293 sq.ft. (Attachment I). Proposed
setbacks include a 12~ trant yard (along 23rd Street), 7' ar~d 34'

side yards, and a 25' zear yard. A 20' front yard, 7~2" side
yard and 25' rear yard setback is required for the proposed
parcel. A variance is required For the subBtandard 59' depth;
tha parcel w~uld have a r,oncoafcrming 12' front yard and 7~
north sideyard. Cade r~quires a minimum width of 50' and depth
of 100'. Parce3 2, with frontage along 23rd Street and Dewey
Street~ has an 88' depth and a 59' width for a total of 5,225
sq.ft. Propoeed setbacks include an exi~ting 32' front yard, 12'
and 18' sid~ yards and a 5' rear yard. A 2a' front yard. a~.9'
side yard and 25~ rear yard setback is raquired for the proposed
parcel. A varianoe is required for the substandard 88' depth;
the parcel would have a nonconforming 5' rear yard setback. The
parcels meet the minimum lot size requirement af 5,400 ~q.ft.
{Attachmant C).
The Santa Mflnica Municipal Code allaws modification of minimum
parceZ dimensions (Section 9113.3 (a). The applicatfon was
denied by the Plann~ng Cam~+issian based on findings that the
praposed subdivision is not similar to the prevailing pattern of
deve~opment in the area, that substandard ~etbac]c~ would exist,
and that the proposed parael 6i,z~ and configuration wouid not
conform te the e~tablished pattsrn of deve~apment (Attaehmant B).
APPEAL ISSUES
The applicant appealed the denial of the tentat~ve map and
variance appliaatian, st~-t~ng that the findings of di8eimil.ar
develogment pattern of the proposed parce~s and incansistency
with the General Plan are not ~ubstantiatsd with text or mape

from the General Plan (Attachment A). The applicant al~o stat~s
that the density and land use ef the property i~ consi$tent with
the Genera]. Plan and that the ex36ting parcel has twice the
required parcal area in the R1 distrfct. Tha applicant presents
examples of biocks tc the southwast cantaining parce~s M...which
are reversed corner lots." The appZicant points aut that there
are two lots at the west end of the b3.ock with homes und~r
,~eparate own~rship which are or~ented in a eimi~ar fa~hion to the
proposed subdivision. Ths appliaant contende that there was no
review of lots acros~ tha Lo~ Angeies City boundary which are
similar in orientation to the prapa8ed subdivision. The
applicant stated that a variance, grant~d in 1945 which allowed
construction of the gecond dwelling on-~ite, wa~ not addressed in
the findings. The applicant aleo auggests th~t a daed
restriction running wtth tha property to raquire a Conditional
Uae Permit fcr further expansion of ths existing homaB be
recorded as a condition of approval.

, The two existing 6ingle family structures are coneidered to be
legal nonconforming uses pursuant ta the Municipal Code. If
substantial alterations were made to either one o€ the structures
(a "substantial remodel" under the Muni.cipal Code},one of the
structures would be required to be demolished. Approval of the
subdivision would allow permanent development rfghts for a s~.nqie
fa~nily structure an ~ach new parc~el. The applicant's proposal ta
require recordation of a deed restriction requiring a Conditiona2
Use Permit for e~cgansian af the s~tructura wauld not mitigate the
impacts of increased deve].apment rights.
Review of original building parmit app~ications reveals that a
Varia~ce (#682-Y) w~zs granted to allow the construction of a
second dwellinq unit ta the rear af the site in 1966 (Attachmant
G}. The first unit on the site was built iri 1955. It appear~ on
the plot plan for the 1965 appiicatian that was for subdivision
into two parcels. This ~966 application was not approved
(Attachment G),
The applicant peint~ out that twv other lots facing 21st Strest
and Dewey 5treet contain sinqle fainily structures that are
oriented tcwards 21at Street (Attachiaent H). The a~se~ser's map
shows that a waiver of parcal map line divideB the two lats inta
paraele witYi dimensions and lot sizes conforming to code
req~irements. St is important to r~ota that i~ this cas4~ two
parce2a were reoriented from facing Dewey street to 21st street
with no net increase in nu~her of parcelB. However, in the
proposed subd3v3sion~ the parcel would be reorieated from Dewey

Street to 23rd Street with an inarensa fram on to twa parcels,
thus effecting an increase in density.
The applicant has submitted copies of th~ bui~ding permit
applications for 322~ and 3233 21st Street (Attnchment I). A
single family dwelling was constructed on-Bite in 1948 oriented
towards 21st Street. The second dwellinq wa~ constructed in 1988
and is also oriented towards 21st Street. A requ~red 25' front
yard setback is provided for both structures (Attachment H& I).
A reversed carner lot is defined in the Code a~ a corner parcel,
the side street line of which is substantially a continuation of
the front parcel line of the first parcel to its rear. The
subject carner parcel ~s not cansidered a reversed corner lot.
Therafore, this ha6 no bearing on the ff.ndiags for the proposed
subdivisian as mainta~.ned by the applicant.
The applicant contends that there was no review af lots over the
City boundary line in Los Angeles. The Santa Monica Municipal
Code does not suggest taking into account the development pattern
of a neighbcring ~urisdiction.

variance permitting the construction of the seccnd structure
on-site was not addreased. The npplicant also proposes ti~at a
deed restriction requiring a CUP for any davelopment ta the
existing structures be recarded as a condition af approval.
Approval af the Tentative Parael Map and Variance applications
would increase the permitted intensity of land use and density of
the existing Rl parael and proleng the existing nonconforming
nature of the structures on-site.
Although a variance wa~ granted to permit canstruction of a

second dwelling unit an-site, a substantial remodel conBisting af
50~ or mare demolition af axisting and laad-bearing walls would
requ~.re that the nonconforming density of the property be brought `
into conformance with the Code.

teristics applicaY~le to the property involved, including
size, shape, topoqraphy, lacation, ar eurroundings, or to
the intended use or development of the property that dc

identical zoning claesification, in that the oriantation
of the parcel as currently existing is similar to sur-
rounding praperties and in that the rr+~~~r of on-~ite

the General Plan, 'Fhis is the only lot in the neighborhood which has more than twice the

PROJECT DESCRIPTION
The applicant is requesting a Variance and Vesting Tentative Par-
cel Map to subdivide an existinq 11,5I8 sq.ft. parcel into 2 par-
cels cf 5,293 sq.ft. and 5,225 aq.~t. Parcel 2, facinq Dawey
Street, has a eubstandard length of SSf and, dua to the proposed
lot split, the existing structure wil~ have a nonaonfarming rear
yard setback of 5'. Parcel l, facing 23rd Street, has a~ubstan-
dard length o~ 59' and, due to the proposed lot split, the exist-
ing structure will have a nonconferming front yard setback of 12~
and a nonconforming north ~ide setback of a 7 feet. A minimum
depth of ~.00 feet and a minimvm width of 50 feet are required for
an R1 parcel. Under Municipal Code Secticn 9113.3, a variance
may be granted to allow modification of minimum parcel
dimensions. -

parcel into two (Z) parcels in the R1 dietrict. The existing
parcel dimensians are appraximately 59' in width by 195~ in
~ength. This corner parcel ~ace~ 23rd Strset to the east, Dewey
Street to the south, and an alley to the north. There are two
existing vae stQry eingle ~amily structureB on~-site. No changes
are propoBed tv tha structures. Access to an exi~ting two car
garage exists ~rom the alley far Parcel 1. Dr~veway access ta
Parcel 2 exists frcm 23rd Street. No chanqes to existinq access
are proposed.
Two parcels ars proposed. Parce~ Z. with frontage along 23rd
Street and the north alleyr has a 59 ~aot depth and a 107 foot
width for a total of 6,293 eq.ft. Praposed setbacks inc~ude a
12~ front yard (along 23rd Street), 7' and 3+4' sid~ yards, and a
25~ rear yard, A variance is required for the substandard 59~
depth and nonconfarming 12' front yard and 7' north s~de~ard.
Parcel 2, with frontage a~ong 23rd Street and Dewey Street, has
an 88 fcot depth_and a 59 foat width for a total of 5,225 sq.ft.
Praposed setbaaks include an existfng 32' front yard, I2' and 18'
side yards and a 5' rear yard. A variance is required for the
substandard 88! depth and noncanforming 5' rear yard setback.
The minimum dimensiona of 50 faet in width by lOfl' in length ~nd
a minimum size of 5,000 sq.ft. are required far parcels in the R1
Di6trict. Municipal Code Saction 9113.3 allows the modification
of minimum parcal dimensions and yard setbacks on parce],s with a
depth of 9o feet ar les~ or a width o~ 39 feet or less. The ~p-
plicant is requestinq a variance for both lot dimensions ~nd
front and rear yard 8etbacks. The parcals da meet the minimum
lat size of 5,000 ~q,ft. The orientation of the two parcels~ as
proposed however, are not s~milar to tha dominar~t orientation of
parcels in the surroundinq residential neighbarhoad. All oth$r

Strcct. At 3221 and 3233 21at Street, there are two houaas that facc 21st Strcet vory
much the same way as is propascd for the sabject psrcel an 23rd StreeL Tha origiaal
house was built in thc 1940s, Accoiding to its addreas end physical location, it has
always faced 21st 5treet. In 1988, t~e City iasued s buildiag permit for a new aingle
family house on t~~ aorthwesterly portian of tha aamc Iota that the ariginal housc was
built an.
