SUBJECT: Recommendation to Adopt Resolution Approving Final Map for
Tenant-Participating Conversion TPC-195 at 914 Third street
INTRODUCTION
This report transmits for city council approval a Final Map for the
following Tenant-Participating Conversion project:

BACKGROUND
The City Planning Commission approved the Tentative Map and the
Tenant-Participating Conversion for the above project on March 5,
1992, after a public hearing and a careful review of the record and
staff recommendations. The action of the Planning commission was
based on the commission's findings that the proposed Tenant-
Participating Conversion meets the requirements of Article XX of the
City Charter and that the propose.d subdivision is consistent with
applicable general and specific plans as adopted by the City of Santa
Monica along with all mandatory requirements of the Subdivision Map
Act of the state of California.
The owners have submitted to the City a Written Consent Agreement
binding the owners and any successors in interest to each condition

requesting that they be represented by Local 1109, the
City recognizes Local 1109 as the recognized
bargaining agent for employees in the Fire Prevention
Inspector job classification as of July 1, 1992.
Incumbents in the Fire Prevention Inspector job
classification as of July 1, 1992 shall be

shall be covered by the terms and conditions of this
Agreement. However, all vacancies in what would have
been the Fire Prevention Inspector job classification
shall be filled by Firefighters, with the Fire
Prevention Inspector job classification being
eliminated once all of the employees who have been
tlqrandfatheredu as Fire Prevention Inspectors have
vacated those Fire Prevention Inspector positions. In
addition, all incumbents in the Fire Prevention
Inspector job classification who are Ugrandfathered"
must obtain a Fire Prevention Officer III
certification from the state Fire Marshall by no later
than June 30, 1994. Any Fire Prevention Inspector who
fails to meet this position requirement by that date
shall have his/her employment with the city
terminated. Said termination shall not be considered
disciplinary in nature but shall be based on the
employee's failure to meet minimum job requirements.
As a result of a petition of accretion of the Fire
Prevention Engineer filed by Local 1109 and a written
statement signed by the current incumbent in the Fire
Prevention Engineer job classification requesting that
he be represented by Local 1109, the City recognizes
Local 1109 as the recognized bargaining agent for
employees in the Fire Prevention Engineer job
classification as of July 1, 1992. Incumbents in the
Fire Prevention Engineer jOb classification as of July
1, 1992 shall be "grandfatheredu as Fire Prevention
Engineers and shall be covered by the terms and
conditions of this Agreement. However, all vacancies
in what would have been the Fire Prevention Engineer
job classification may, at the discretion of the Fire
Chief, be filled by Fire captains, with the Fire
Prevention Engineer jOb classification being
eliminated once all of the employees who have been
"grandfatheredu as Fire Prevention Engineer, or who
are subsequently hired as Fire Prevention Inspector,
have vacated the Fire Prevention Engineer positions.
In addi tion, all incumbents in the Fire Prevention
Engineer job classification who are ngrandfathered"
must obtain a Fire Prevention Officer III
certification from the state Fire Marshall by no later
than June 30, 1992. Any Fire Prevention Engineer who
fails to meet this position requirement by that date
shall have his/her employment with the city
terminated. Said termination shall not be considered

in the future, Tenant-Participating Conversion Taxes will be col-
lected pursuant to the provisions of Article XX of the City Charter
and some increased property tax revenues may be generated.
RECOMMENDATION
It is respectfully recommended that the Final Map for this Tenant-
Participating Conversion be approved by adoption of the accompanying
resolution.

ACCEPTING AND APPROVING
A FINAL SUBDIVISION MAP FOR TRACT NO. 51090
AT 914 3RD STREET
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map for Tract No. 51090 in the City
of Santa Monica hereby is accepted and approved.
SECTION 2. That the city Clerk hereby is authorized and direct-
ed ta endorse upon the face of said Map this order authenticated by
the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be in
full force and effect.
