INTRODUCTION This report transmits for city Council approval a Final Map for the following Tenant-Participating Conversion project: Tract No. TPC NO. ADDRESS OWNER UNITS 51071 192 630 Idaho Avenue Page Properties 23 BACKGROUND On March 4, 1992, the City Planning Commission approved the Tentative Map and the Tenant-Participating Conversion for the above project on 630 Idaho Avenue after a public hearing and a careful review of the record and staff recommendations. The action of the Planning Commis- sion was based on the Commission's findings that the proposed Tenant- Participating Conversion meets the requirements of Article XX of the City Charter and that the proposed subdivision is consistent with applicable general and specific plans as adopted by the City of Santa Monica along with all mandatory requirements of the Subdivision Map Act of the State of California. The O\vners have submitted to the city a written Consent Agreement binding the owners and any successors in interest to each condi tion imposed in connection with approval of this Tenant-Participating Con- version. This written Consent has been approved by the City Attorney - 1 - 6-/) <- . ,. I 1 Staff has indicated that the principle of grandpa rented parking, as 2 articulated above in paragraph 3, and as applied by the city under 3 its prior Zoning Ordinance, continues to apply under the City1s 4 current Zoning Ordinance. 5 16. The Santa Monica city Attorney's Office has recently 6 issued an opinion regarding Section 9044.3{e) of the Zoning 7 Ordinance. This opinion indicates that every time the use of a 8 property or building, or any portion thereof, is changed, the 9 entire parcel must provide the number of parking spaces for the 10 uses thereon as currently set forth in the Zoning Ordinance. I II Ironically, as illustrated by the examples below, the City 12 Attorney's opinion may stimulate redevelopment of properties and 13 prohibit appropriate changes of use which decrease parking demand. 14 I 15 A. Chanqes of Use Which Decrease Parkinq Demand will 16 Be Prohibited by the city Attorney's Opinion. I 17 (I) Example 1. IB Assume a property is improved with a 1,000 square 19 foot bar. This use would require 20 parking spaces under the 20 City's current zoning Ordinance (i.e. , 1,000 square feet of floor 21 area at a parking ratio of 1 parking space for every 50 square feet I 22 of floor area equals 20 parking spaces). Assume further that the I 23 bar only provides 2 parking spaces. 24 The property owner would be precluded from changing 25 the use of the property from a bar to a retail use or office use. i 26 Such uses would require 3 parking spaces (i.e. , 1,000 square feet I ! 27 of floor area at a parking ratio of 1 parking space for every 300 ; 28 square feet of floor area equals 3 parking spaces). Pursuant to I 7 , OQCL0 in the future, Tenant-Participating Conversion Taxes will be col- lected pursuant to the provisions of Article XX of the City Charter and some increased property tax revenues may be generated. RECOMMENDATION It is respectfully recommended that the Final Map for this Tenant- Participating Conversion be approved by adoption of the accompanying resolution. Prepared by: D. (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ACCEPTING AND APPROVING A FINAL SUBDIVISION MAP FOR TRACT NO. 51071 FOR A PROJECT AT 630 IDAHO AVENUE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Final Map for Tract No. 51071 in the City of Santa Monica hereby is accepted and approved. SECTION 2. That the City Clerk hereby is authorized and direct- ed to endorse upon the face of said Map this order authenticated by the Seal of the City of Santa Monica. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
