INTR~DUCTION
This report recornmends Chat the City Council introduce for £irst
reading an ordinance proposed by the applican~ to a11ow

Distr~ct It also recomrnerds that the Council deny the appeal
and uphold ~hz Piann~ng Cammission's unanimous approval of
Candztzonal Use Perrnit 94-~23 ~o al~ow service an Sundays at the
~xisting Ji~fy Lube locatea at 2344 Pico Boulevard. The CUP is
cont~ngent upon approva~ of the ordinance amendment No physical

Present Zoning Ordinance prov~sions prohibit any type of auta
repair act~vity an Sundays for pro~ects requir~ng a Canditional
Use Permit (CUP). The proposed Zoning Ord~nance amendment would
allow minor auto repair activities on Sundays such as oil
changes, with approval of a CuP. The appl~cant has applied for a
CUD which will ~nly be valid if the ordinance arnendment is a~so

BACKGROUND
Plann~nq Commission Action
On February 8, 1995, the Planning Comm~ssion unanimously voted to
recommend Cou~cil approval of the Zoning Ordinance amend3nent. At
that hearing, one rnember of the public spoke in favor of the
proposal and four rnemlaers of the public spoke against it.
Planning Commissian discussion centered around ~he ievel of
additional activity that would be generated ~f Sunday operation
were conditianally permiCt~d at the Pico Boulevard Jiffy L~be
facili;y. In recommending approval of the ordinar_ce amendment,
the P~anning Comm'ssion recornmended amending the arigznal
proposal to limit Sunday operation to 9:00 a.m. to 5:00 p.m., to
Iimit Sunday operation on~y to facilities which exclusively
perform the identified lubrication and maintenance services and,
for projects which operate on Sundays, to prohibit access to or
from residential streets The applicant has agreed to these
modif~cat~ons and the amended language is eontained below. At
the same hearing, the Planning Commission approved CUP 94-023
am~nding CUP 92-05~ to allaw the existing Jiffy Lube facility at
234~4 Pa.co Bo~.~levard to operate on Sundays between the hours of

ord~nance amendment.
A~~eal
Qn February 22, 1995, Richard Bloom, on beha~f of the Friends of

Sunset Park, appealed the Planning Cornmission approval o~ CUP 94-
023. As sta~ed in Attachment F, the appeal is bas2d on concezns
regarding the impact o~ noise and traffic to tre ad~ac~nt
neighborhood and the possibility that ~he ordinance amendment may
resalt in spot zoning (although, because the Plar.ning Commission
acted only in an advisory manner lr~ recommendir.g approval of the
ordinance amendment, this was nat an act~on sub~ect ~o appeal},
Hawever, given the limited condit~ons under which Sunday
operations would be allowed at 2344 Pico Boulevard, s~aff
believes ~hat the appellant's n~ighborhood concerns are
unwarranted. In response to the appellant's concern regard~ng
spot zonir_g, it shou~d be noted that the ordinance amendment
would apply to al'_ new or existing cond_tionally permitted
auto~obiie lubricat~on faczZitzes in the City and would not be
lirnitzd ~o any sing~e property.
Proposed Ordinance Arnendment
The follow~ng Ordinance amendment is proposea by the applicant ta
allow certain autornabile serv~ce o~erations to be conducted on
Sundays (bold ind~cates new text; italics indicate related text
revisions which have been reviewed by the Planning Commission
previous~y bu~ have not yet been approvad by the City Council):
9.04 14.050 Automobile repair facilities.
(1) Hours of Operation. In all districts except on parcels
which are more than 100 feet from a residential District,

automobiles 7aetween the hours of 8.~~ p.m. and 7:04 a m,
Monday thraugh Saturday, and no work shall be perfarmed on

Sundays, except as fallaws. In the C4 district, in
app~oving a Conditional Use Permit, the Plann~ng
Commission or City Council an appeal may authorize Sunday
aperations if all of the following are met:
(1) The facility`s daily business is limited to
automobile lvbrication and fluid maintenance
services, air filter replacement, and/or windshield
wiper replacement services;
(2) The facility has no vehicular access to or from a
residential street;
(3) Sunday operativns are prohibited befare 9:00 a.m.
and after 5:00 p.m.;
(4} If the facili~y is located adjacent to a
residential district:
{i) The facility is separated from the residential
distric~ by a public alley or other public right of
way, an appropriate physical barrier such as a
brick or block wall which buffers adjacent
residences fram noise, and an appropriate landscape
buffer; and
(ii) The garage doors to the service bays do not face
the residential district.
Proposed Amendment to CUP 92-051
In order ~o allow the Jiff~ Lube at 23~4 P~co Boulevard ~o
opzrate on Sur,days, tne applicant proposes ~o amend Condition 23
of CJP 92-051. The proposed language to replace the original
Condition 23 is contained in Condition 23 of this report and is
consistent with the proposed ordinance amendment ~«nguage. Two
additional conditions are proposed requiring that the
rnodification to Cond~tion 23 is contingent on Council appraval of
the ordinance amendmEnt and requiring that a deed restriction
stipulated by Condition 22 af the original CUP shall be recarded
prior to operation ot the sub~ect business or~ Sundays.

General Plan Con~zstency af Text A~endment
The praposed ordinance amendment would a~~ow only specific
autorcabile maintenance pracedures to be performed on Sundays and
these procedures do not require the use of excessive naise-
generating equzpment or 4he creation of noxious odors.
Additionally, adjacent residential uses are proteCted by the
noise-buffering and landscaping requirements. Based on these
factors, the proposal is consistent w~th Land Use and Circulation
Element Objective 1.6 for Commercial Corridors, which states that
tre City shall "accommodate commercial uses which se~ve regional,
community, and local needs while respectzng the adjacent
r~sidential us~s."

Conclusion
The prohibition o~ au~omobile repair wark on ,Sundays was adopted
in order to prevent the noise and odor associated with repa~r
from impacting neighborhoods. The propased ordinance amendmenti
and CUP arrendrinent would allaw lirnited automobile service
functions to be performed on Sundays which are not associated
with ~xc~ssive no~se and odors. Therefore, staff recommends that

cantained ~n Attachment H and that `he Council deny the appeal of
CUP 94-023 and uphold the Plannzng Commission approval of same.

Plans
1. This approval is for those p~ans da~ed April 27, 1~93, a
copy o~ which sha~l be mainta~ned zn the fi~es of the Cz~~
Planni=lg D~visian. Pro~ect developrnent shall be consistent
with such plans, except as ctherwise specified in these
cond~tlons of approval
2. The Plans shall comply with a11 ather provis~ons of Chapter
l, Article IX of the Munic~pal Cade, {Zoning Ordinance) and
az1 other pertinent ordinances and Generaz P1an paZic~es of
the City of Santa ~onica.
3. Fina1 parking lot layout and speci~ications shall be subject
to the review and approval of the Par~ing and Traffic
Engxneer. The site shall b~ clearly marked ~o indiCate
traffic flow.

consideratzan made ~o the build~ng's roof form.
9. Landscaping plans shaZl carnpZy with Subchapter SB and
Section 9 04.14 a~a(e) (Landsca~ing Standards) of the Zoning
Ordinance including use of water-conserving landscaping
materials, landscape maintenance and other standards
contained in the Subchapter The Architectural Review
Board, in its review, shall pay particu~ar attention ~o the
width of the landscape strips and the number and types of
tress planted to assure that the aNea can support the
proposed landscaping A manimum of S trees shall be
provided ~n accordance with Section 9 04 1Q.04 070 of the

10 Refuse areas, storage areas and mechanical ~qaipment shall
be scr~ened in accordance with SMMC Section 9.04.10.02 150

Construction
11. During constructian a security fence, the he~ght of which
shall be the maximum permitted by ~he Zoning Ordznance,
sha11 be maintained around the perimeter o~ the lot. The
lot shall be kept clear of all trash, weeds, etc.
12. Unless otherwise approved by the Departmer~t of Environmental
and Public Works Management, all sidewalks sha11 be kept
clear and passable during ~he grading and construction phase
of th~ proj ect .
13 S~dewalks, curbs, gutters, paving and driveways which need
rep3acing or removal as a resu~t of the pro3ect as
deterrnined by ~he Department of Environmental and Pu}alic
Works Management shall be recor.structed to the satisfact~on
of the Departm~n~ a~ Environmental and ~ub~ic Works
Management. Approval for this work shall be obtained frorn
the Denartment of Environmental and Public Works
Manageme~t priar to issuance of the build~ng pezmits.

14. Vehicles haul_r_g dirt or other construction debris fxom the
s~te shall cover any cpen load with a tarpa~lin or other
secure covering to mini~ize dust ernissions.
15 Street trees shall be ~aintairea, relcca~ed or provided as
required in a manner c~nsistent w~th the City`s Tree Code
(Ord. 1242 CCS), per the specifications of the Department of
Community and Cultural S~rvices and the Department of
Env~ronmental and Public Works Management No street tree
shall be removed wi~hout *he approval o~ the Department of
~omrnunity and Cu~tural Serv~ces.
16. A car_sLruc~~on period rnitigatian plan shall be prepared by
th~ appllcant for approval by the Depa~tment of
Environmental ard Publi~ Works Management prior to issuance
of a bailding permit. The apnroved mitigation plan shall
be posted on the canstruction site for the duration of the
pro~ect construction and shall ~e produced upon request. As
applicable, this plan shall (1; Spec~fy the names,
ad~resses, telephone numbers ar~d business license numbers of
all contractors and subcontractors as well as the developer
and architect; {2? Describe how demolition of any existing

faucets shall be installed on all sinks unless otherwis~

Department.
20. To mitigate soiid waste zmpacts, prior to issuance of a

to conduct a survey of the affected area at project's
owner's expense. A determinat~on shall then be made by th~
~irector of Planning ta determin~ the significance of the
survey findings and appropriate actions and requirernents, if
any, to addrzss such findings.
25. Strezt and/or alley lighting shall be provided on public
rights-of-way ad~acent to the project if and as needed per
the specifications and w~th the approval of the Department
of ~nvzronmental and Public Works Management.
30. Automotive repair facilities and dealerships, parkzng areas
and structures, autarnotive paint shaps, gas stations,
equipment degreasing areas, ar~d other facilities generating
wast~wa~er with significant oil and grease content arz
r~quired to pretreat these wastes before discharging ~o the
City sewer or storm drain system Pretreat~ent will require
that a clarifier or oil/water separator be installed or
maintair_ed or. site. In cases where settleable salids are
present (oY expected? in greater amounts than floatable oil
and grease, a clarifier unit will be required. In cases
where the opposite waste cha~acteristics are present, an
oil/watzr separator with automatic oil draw-off will be

Validity of Permits
36. In the ever~ permittee vio~ates or fails ~o comp~y wlth any
ccnditions of approval of this perrnit, no further permits,
licenses, approvals or certificates ot occupancy shall be
issued ~ntil such violation has been fully re~edied.
37. Within ten days of Planning Division trans~ittal cf the
S~atement of Official Act~on, praject applicant sha11 sign
and re~urn a copy of fihe StatemenL of Official Action
prepared by the Planning Division~ agreeing to the
Condit~ons of approval and acknowledging ~hat faslure to
comply with such conditions shall consti~ute grounds fcr
poten~ial revccation of the permit approval. By signing
same, app~icant shall not thereby waive any legal rights
applicant may possess regarding said conditions. The signed
Statement shall be raturned to the Planning Division.
