SR-6B (6) - 61:J APR 2 5 1995 PCD:SF:RF:db:24526sr2/winword Santa Monica, California council Meeting, April 25, 1995 To: Mayor and City Council From: City staff Subject: Ordinance Adding section 3.08.420 to the Santa Monica Municipal Code To Establish Preferential Parking Zone DD Introduction At its meeting on February 28, 1995, the city council introduced for first reading an ordinance establishing a preferential parking zone on 24th, 25th and 26th streets between pica Boulevard and Pearl street, on Pearl street between Cloverfield Boulevard and 26th street, and on 24th Street north of Ocean Park Boulevard to Grant School. The ordinance is now presented to the city Council for second reading and adoption. Discussion Since the first reading of the ordinance, the residents in the south half of 24th street between pico Boulevard and Pearl street have petitioned against the implementation of preferential parking in their section of 24th street. The residents indicated they did not want preferential parking if the restrictions allowed for "two hour" parking. Staff has contacted a representative of the petitioners and advised them if they did not want preferential parking~el:tty [ J APR 2 5 1995 - --- would not install the preferential parking signs. However, the ordinance should be adopted in its current form, and if in the future the residents want two-hour preferential parking, they can petition and the City can implement preferential parking with little delay and not require the long preferential parking process. This representative of the petitioners agreed with staff's recommendation. All of the other signers of the petition were advised of this by letter, a copy of which is attached. staff has only received one response to the letter and the resident expressed concurrence with staff's approach. Recommendation It is respectfully recommended that the accompanying ordinance be adopted. The City can comply with your request for thIS portion of 24th Street and will not Install preferential parking signs at thiS time. However, 24th Street Will stIli be Included In the ordinance so that If necessary the residents can petItion In the future and preferential signs can be posted without the need to go through the long preferential parking process To reiterate, preferential parking will not be Imposed unless signs are posted even If the ordinance IS adopted If you have any questions, feel free to call Doug Biagi of my staff , , onald K Fuchlwakl, P E City Parking & Traffic Engineer cc Mayor and City Council , I CA:f:\atty\muni\laws\jl\prefpkg.dd3 City council Meeting 4-25-95 Santa Monica, California ORDINANCE NUMBER 1797 (CCS) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3.08.420 TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE DO WHEREAS, the parking and Traffic Engineer has received a petition requesting establishment of a preferential parking zone in the area on 24th, 25th, and 26th streets between pico Boulevard and Pearl Street, on Pearl Street between Cloverfield Boulevard and 26th street, and on 24th street north of Ocean Park Boulevard to Grant School; and WHEREAS, the petition has been verified to be signed by residents living in two-thirds of the dwelling units comprising not less than fifty percent (50%) of the developed frontage of the proposed preferential parking zone; and WHEREAS, the parking and Traffic Engineer has undertaken such .. studies and surveys deemed necessary to determine whether a preferential parking zone should be designated in the area; and WHEREAS, the City Council is satisfied that the proposed area meets the designation criteria set forth in Municipal Code Section 3.08.040, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: - 1 - --- -- ----- -- T SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from its adoption. After giving due consideration to the construction activities occurring at Grant School, the City's Traffic Engineer shall determine in his or her sole discretion the date that the regulations governing Preferential Parking Zone DD shall commence.
