This Text Amendment is in~ended as a"cl~an-up" af Part
9.04.02.030, Definitions, of the Zaning ~rdinance. This Part pro-
vides definitians of terms used thraughout the Zoning Ordinance.
The proposed changes have several objectives, as follows:
1) To c2arify defiritions. Since the current Code was adopted in
August af 1988, staff has found that some definitians lack clari-
ty and may be interpre~ed differently by dif~erent parties.
Thraugh the praposed c~arifications, the Code definitians will be
more clear to C~ty s~aff and members of the public.

used in ather parts of the Zoning OYd~nancE are not defined in
the Definit~.ons part. 5ta~f proposes that definitions be adopted
far eertain terms that are used in other sections ~f the Code but
are no~ currently defined.

3) Ta modify existing requiremen~s. Staff has found ~hat some
definitions n~ed to be madified in order to meet the intent ar.d
purposes stated in oth~r ~ections of the Code.
4) Ta delete unnec~ssa~y ~err~s. Staff has found that same ternts
in the Definition sec~ion are nat used elsewhere in the code and
are therefore, nat necessary. In addition, some terms in the Def-
initian section, such as Condi~~onal L'se Perinit, have an entize
Pazt of the cade far that term. Therefore, a separate de~inition
is not needed.
MUNICIPAL CODE AND G~NERAL PL~AN CONFORMA1dCE
The propasad Text Amendment is consistent ~rith the Genera~ Plan.
CEQA STATUS
The praposed Text Amendment zs categorically exempt from the pro-
visions of the California Environmental Quality Act pursuant to
Class 5(10) of the City of Santa r~onica Guidelines for the Im-
plementation of CEQA.
PUBLIC NOTIFICATIQN
Because this proposa~, is not site-specific, na radius map,
signage or mailing noti~icatian is required. A legal notice was
publishad in the outlook in January for the adoption o~ the
Resolutian of Intention (Attachment A). Staff published a legal
notice in the outlook far this hearing of the text amendment.

Sectian-by-Section Analysis
Brie~ descriptions of the rationale of the proposed changes are
provided bel.ovr. A11 references are ta Attachment B, which shows
the existing code ~aith propos~d dele~ions in strike-out and pro-
pased additians in bold.
The de~initions section includes ~evisions from Ordinance 1635,
adopted on JuZy 14, 199~ by the City Council to faci~itate af-
fordable hausing in the City. These revisians to the defini.tions,
such as ~he addition of Cangregate Ho~sing and Domestic Violence
Shelter, were approved by the City Cauncil on June 16, 1993.
A modification which occurs throughout the clean up is a change
from the use of the tern~ "~at" ta "parcel". This is done in arder
to provic7e consistency throughout the code. A second modifica-
tion is the deletion af terms that have entare Parts in the Cade.
For example, "home occupation" has a part in the Code which de-
fines and explains hame occupations; therefare, a separate defi-
nit~on is nc~t needed .
In addztion, some of the defini~.ions far specific terms have been
moved and placed under the comman term. F~r axample, rather than
"Drive-Throuqh or Drive-In Restaurant" bein~ under "D" , this

term has been placed under "Restaurant, Drive-Through or Drive-
In". This is being dane in ordar to keep like terms together.
These terms have been included in the current ordsr but xn pare~-
thesis with a note that the term has been maved.
AcCessory Building. This is a modification to the current defini-
tion to add a notation that there is a distanc~ of 5 feet between
an accassory building and the principal structure on a parcel.
The definition pravides that an accessory building is "detached"
and the purpose of statzng a distance is to provide dixection on
what constitutes detached in this cantext.
Accessory Living Quarters. This is a clarification to the exist-
ing definition. In addition, rather than stating that the
quarters cannot have "coaking faci~~ti~s", the definit~on ~s
being clarified to read "kitchen, shower, o~ tub enc~osure". The
proposed change relates this definition ta that af "kitchen"
~ather than u~ing the term "caoking facilities" which are not
defined. The inclusion of show~r and tub enclosure is ta provide
clear direction as to what can and cannot be included in acceaso-
ry living quarters. The intent is ~hat accessory living quarters
can be used for short term gueats, but nat as a~iving unit. By
not allowing a kitchen, shower or tub it reduces tha possibility
that ~he quarters wi1~ be used as a living unit.
Accessory Use. The propased changes axe to clarify that an acces-
sory use is faund in connectian w2th the principal use an the
parcel.
Artist Studio. The proposed changes are to clarify that an artist
studia can be either an entire building or a partion of a build-
ing ~rhere an artist works. The proposed definition c~early ex-
empts perfarmance ar exhibitian space unless it is atherwise per-
mitted. This is ta separate out the exhibit space that is
generally considered a more retail type use than is xntended by
an artist live/w~rk situatian. Exhibition space will generate
some amount o~ ~raf~ic which is not intended in the residen~ial
setting ~f an artist ~ive/work sltua~ion.
Automobile Repair Facility. The words "trail.ers, or similar vehi~-
cles" is added to expand the de~inition and provide greater
clarity.
Automobil~ Sales Faeility. This definition is being deleted since
it is nat used elsek~here in the Code. The ter~n "Automabile
Dealership" is commonly us~d.
Automabile Storage. The phrase "off-site or on-~ite" has been
added to the definition for clarification purpases. The storage
can be ~n r~lation to an automobile dealership that either shares
the property or is lvcated an a separate property.
Bakery. A definition is being addad for bakery since it is a t~se
that is specifically identified as a permitted t~se in som~ of the
zona.ng districts, such as the C4. The definition includes lan-
guage that bakeries are cnnsidexed a generai retail use, which

will allow bakex~es to be located in zones in which general
re~ail use is allo~rec.
Bathroom, Ful1 & Ba4hroom, Half. Definitions a~e be~.ng added fo~'
full and half bathroams. There are instances, such as in accesso-
ry buildings, where only half bathroams are a1lQwad so that the
bui~ding is not used as a livinq unit. The addition of these dEf-
initions will provide clear direc~ion af what the City considers
a full and half bathraom ta include.
Bay Window. A definition is bezng added for bay window since it
is a term used in other sections of the Code~ specifically in the
projection section.
Bed and Breakfast Faci~ity. A timeframe is being added to the
existing definition to clarify t,~hat is meant by "temporary lodg-
ing place".
Boarding House. As in the above definition, a timeframe is being
added to the existing definition to clarify what is meant by
"temparary ~odging placa".
Building Coverage. This definition is maved uncler "Parcel
Coverage" and madified since that is the mare accurate term.
Buildinq Height. The word "existing" is deleted because i.t is
irrelevant to the definition. He~ght is measured from the average
natural grade, which i~ the averaging of the elevation at the
corners of the site.
Carport. A definition is being added since the term "carpozt" is
used in th~ Parking section of ~he Code. The definition requ~.res
that the structure is permanent, .is used for parka.ng, and a.s apen
on at least one side.
Change of Use. The proposed changes to this definition are for
clarification.
Church. This is a minor ciean-up ehange.
Club. This definition of c].ub is being deleted since it focuses
on the peopl~ and membership. Club is still defined, but rath~r
in land use terms rather ~han strictly in organizational terms.
The definition was previously under "pri.vate club or l.odge".
Conditiona~ Use Permit. This term is being d~leted from the de~i-
nition sectian since it is addressed in Part 9.04.20.12 of the
Code.
Co~valescent Hame. This is a new term which refers the reader to
"Rest Hame". This i~ added since the term is used by many pe~ple
and appears in other sec~ions af the Code, such as the parking
secti.on.

Delicatessen. This is a new definition which is being added since
_ it is a common term that comes up in discussions with m~mbers of
the public concerning uses al~owed in zoning districts.
Demolition. This is a new term that ~s being added to the cade,
referring the reader to "subs~antial remodel". Demolitian af a
struct~xe generally accurs as part af a substantial remodel, par-
ticularly in connection with nonconforming structures.
Driveway. This is a new dsfinition to define a term that is used
in the Code.
Duplex. A se~tence is being added to clarify that a d~plex is
considared to be a multi-fa~ily use.
Dwellingr Mu1t~~Family. The word "buiZding" is being used instead
of "dwelling" since that is what is meant. A santence is being
added ~o provide cZarity in the definitian.
Dwelling Lnit. The phrase "in a buzlding or portions thereof" is
being added since a dwelling unit can occupy an entire building
or only a portion of a building.
Facade. This i,s a c~arificatiion to make tha definitian I) more
general by using "an" rather than "the" and 2) more clear by
using "wall" instead of "side".
Family Day Care Small & Large. TheSe d~finitions have been moved
alpha3~eticaJ.].y from '"s" and "]." respectively so that they bath
appear togethex under "Family". The G»rd "to" has been changed to
"f~r" since care is provided for the chzldren.
Finished First F~.aor. The change is to spe~l aut "three" ra~her
than just using the n~mber. This is gramatically more cQrrect.
Floor Area. The only proposed change in the definition of f].~or
area is to clarify ~n section (5) what is meant by "exterior".
The ~aord "extezior" in this case is some~rhat ambiguous and "open
to the outside af a building" provides clarity in the definition.
Game Arcade. The phrase "establishment ar portion thereof" is
being added to the definition to clarify that a game arcade can
occupy an entire bu~l.ding or a portion of a building. The defini-
tion is alsfl being expanded to give further examples of the types
of devices that are considered ta be "games" faund in an arcade.
Garage. The proposed changes are ta clarify the definition. The
word "enclosed" is b~ing added for claritication and to distin-
guish a garage from a carport.
General RetaiZ. The proposed change is to make the definition in
the singular rather than plural, so "businesses" has been changed
to "business" . In addition, the word "may" has been added since
not all retaiZ businesses prov~de incidental services.

Grader Average Natural. The sentence referring ta theor~tical
_ grade used in OCean Park is simplified and refers the reader to
the de~inition tor thearetical grade, thereby simplifying the
defin3tion for average natural grade.
Grader Theoretical. The proposed change is to clar~fy that
theoretical grade is us~d ~n the ~cean Pa~k District5.
Hab~table Space. This definition is being deleted since it is not
needed in the Code.
Home Occupation and Hame Occupation Permit. These t~*o terFns are
being deleted fram the Definit~ons section since Part 9.04.20.04
of the Code addresses home accupations.
Incidental Fnod Service. A proposed Change is to clari~y that
incidental ~ood servicE include~ not only the sa7.e and consump-
tion of food but a1s4 beverages. A secand change is ta reduce and
provide more clear parameters as to the size of an area that can
be devoted to incidental food ~ervice. St~ff proposes that the
floor area be raduced from 250 to 15o square feat and that a
limitation af 15 sea~s be ~ncluded. In addition, a parameter of
the size ~f ~he incidenta]. use relative to the principal use a,s
being added. Staf~ experiance is that the incidental use should
be no more ~han 33~ of the primaxy use ~n arder for it t~ be tru-
ly incidental. The reason for the reduction o~" the square
footage, limitation on number of seats and area relati~e to the
primary use is to minimize the potential impacts that have arisen
from this type of use.
Kitchen. The term "intended to be'~ is deleted since it is not
necessary.
Liquor Store. This term is being added since it is used in other
parts of the Code.
Living Area. The propased change is to c~.ean-up the definition sa
that it reads bett~r.
Lot. Throughout the d~fa.nition section, a chanqe is being made
fr~m "Iot" to °parcel". Rather than delete th~ term, reference is
made to the term '~parcel".
Medical Use. This term is being added since it is u~ed in other
parts of the Code, both in uses allowed within di~'ferent dis-
tricts and in the parking section.
Mezzanine. This def~nition is modified to provide parametex's af
what can be located in a mezzanine. In additian, the detinition
is c~arified tha't the mezzanine can be open to "ona xoam" ra~her
than the "space below", A sentenc~ is added (pxev3ously under the
definitian for ~'story") to stata that a mezzanine zs consi.dered a
story if the me~zanine flaor area exceeds ~/3 ~f the total floor
area of the room below. This definition is the interpretation
that has been adopted by the Planning Commission.

Min~r Repair of Vehicles. This term is being deleted because
_ other sections af the code refer to automobile repair and do not
refer to minor repairs.
Mobi~ehome Park. Currently, the definitian far "Mobilehame Park"
is under "Trailer Court" and the reader is re~erred to that defi-
nition. Since the more common term is mobilehome park, the defi-
nition is being moved ta be located under this word. The word
"long-term" is baing added to the defini~ion since the intent of
the c~de is to provida long term habitation.
i~otel. A sentence is being added to indicate that motels are in-
tended to pxovide accommodations for short term periads, nat more
than 3D consecutive days.
Net Residential Area. This definitibn is being deleted since it
is not used in the Code.
Open Space, Common. This definition was previously und~r "comman
open space" and is being moved under "open space". The proposed
change of ~he detinitian itself is to pravide a more detai}.ed
definition of what canstitutes common open space.
Open Spacer Private. This term is being added since ~he provision
of private open space ~s required in some of the Ocean Park Dis-
tricts. The term was nat previously defined in the Cod~.
Parapet, The definition for this terxn is beinq modifa~ed to make a
more genera~ defi.nition and to i.ndicate that the paxapet extends
abave the ~~of. Sectian 9.D4.7.0.42.030, Building height and ex-
ceptions to heigh~ limit, allows parapets to exc~ed the height
limit by 42 inches in all zones excep~ the R1.
Parcel~ Coverage. A more clear definition is proposed ta clarify
what is included in parcel coveraga.
Penthause. The definition is being modified ta delete reference
to the height since that is more appxopriately addressed in Sec-
tian 9.04.10.02,030, Bui~dinq height and exceptions ta height
limit.
Performance Standards Permit. This term is being deleted fram th~
definitian section since it is addressed in Part 9.04.20.~8 of
the Cade.
Photocopy Shop. The word "retail" is being added to clarify the
intention that thi~ is a retail use.
Planning Commission. This tarm as being deleted because a sepa-
rate defin.ition in this part of the City Code is not needed.
Private Tennis ~ourt. This is a minor change to the de~znition.
R~sidential Facili~y. This definX~ion ~ras adopted by City Council
on June Z6, 1993. Hawever, a minor change, the deletion af the

word "care" in the ~ast sentence, is requir~d to be in campiiance
_ ~ith the State regulativns,
Rest Home. The proposed modification is to delete reference to
the relatzonship of the pat~ents ta the operators af the facili-
ty. This is not necessary in the definition.
Restaurant. The proposed change is to refer to "meals" being
served rather than "food" since that provides a more accurate
descript~on of what is sold in restaurants. ~n addition, a sen-
tence has been added ta distinguish "restaurant" from "incidental
food service".
Restaurantr Drive-Throuqh or Drive-In. As indi~ated above, the
proposed change is to describe a more accurate description of the
primary item that is sald in restatxrants.
Restaurant~ Fas~-Faod or Take Out. As indicated abave, the pro-
posed change ~s to describe a mare accurate description of the
primary item that is sald in restaurants.
5econdary Window. This ~.s a minor change to the definition which
does not affect the meaning.
Self-Service Storaqe Warehouse (Mini-Warehause}. This is a
clarification of the existing definition. The wvrding is essen--
tially the same with the additian of reference to varying sizes
of spaces. The change is ta provide a mare clear defin~tion.
Sid~waZk Cafe. This definition is modified to simp~ify the defi-
nition and delete the portion referr~ng to a barrier separating
the cafe from the public right of way. A sidewalk cafe can exist
without a barrier.
Story. This definition is modi~ied to delete the sentence refer--
ring ta mezzanine. Rather than de~ine mezzanine in th~s defini-
tianf the reader is referred to "£~tezzanine". In addition, in
d~termining whether an area is a story, th~ height of the
finished first floor is measured frdm ~ither average natural
grade or theoretica~ grade, whichever is appl~cable. This is
clarified with the proposed change.
Structure. The proposed modifications do nat change the defini-
tian but simp3y reorganize the words to make the definition more
clear.
Substantial Remadel. This is an expanded def~.nitian to clarify
wha~ constitu~es substantial remode~. Reference is added ~o the
definitian to indicate that removaZ af S~~ of the exterior walls
"for any duration Qf time" shall constittite a"stzbstantial rem~d-
eZ". This has been added b~cause af staff experience with persons
removing 50$ of the exterior walls for anly a short pe~iod and
stating that based an the shart ~~.me tha~ the pro j ect was not a
substan'tia~ remodel. The nonconforr~inq section of the Cade dis-
cusses 50°s of the rep~acement value as being demolished, which

have arisen wher~ people have maintained sma11 partians of a non-
confarm~ng structure so as to not comply with more stringent re-
quirements. Staff feels this is not in keeping with the intent of
the ardinance. zn addition, a sentence has been added to this
de~initian to indicate that a r~modeled structure shall lose any
lega~ nonconforming status that it may have had. If a nanconform-
ing structure is subs~antial~y remadeled or demolished, new con-
struction must campZy with current reqezirements.
Temparary Use Permi~. This term is being deleted from tha defini-
tion section since it is addressed in Part 9.04.20.fl6 a~ the
Code.
Theater. A portian af the definition is deleted to pravide a more
general definition and to simpZi~y the language.
Trailer Court. Rather ~han "trailer court or mobi~ehame park",
the reader is r~ferred to the more common term of "mobilehome
park".
Useable Open Space. This term is d~leted since it is not referred
ta in the Cade. The terms used referring ~o open space are "com-
man" and "private", wha.ch are, w~th the Text Amendment, both de-
fined in the Code.
Variance. This term is being deleted fram the d~finition section
since it is addressed in Part 9.04.20.10 of the Cade.
WholesaJ.e Trade. This definition is added sinca it is used in
other sectians of the Code and is not currently defined.
Yard, Front~ Reax~ Sider and Street Side. The last senterece in
each af these definitions is be~ng deleted. The sentence states
that the a~ea ~s to be unobstructed fram the ground upward except
as permitted by the Code and is n~t neaded.
Yard Sa1e. The word "unwanted" is be~ng deleted since it is not
needed in the definition.
Zoning Qrdinance. This term is being deleted since it is not
necessary. Ar~icle 9 of ~he I~Zunicipal Cade is entitled Planning
and Zoning and is re~erred ~o as the Zoning Ordinance.

The proposed Text Amendment is an improvement because it
clarifies commonly used terms and adds definitions in areas wheze
the code ~tas pre~riously sil~nt.
RECOMM£NDATION
It is recommended that the Planning CommiSSion recommend to the
City Cauncil adaption of the proposed Text A~mandment cancerning
de~initiQns as set ~arth in Attachm~nt B based on the falZowinc~
~indings:

1. The praposad Taxt Amendment is cons~stent in principle
with the gaals, abjectives, policias, land uses and pro-
grams spec~fied in the adopted General Plan, in that the
2aning Ordinance is the mechanism ta implement the Ganeral
Plan and it is therefare important that the Zoning Or-
dinance pravide clear explanation of frequently used terms
and us~s. The praposed Tex~ Amendment adds terms that aze
not current~y defined but are used throughou~ the Or-
dinance and clarifies terms that have been interpreted
differently by city staff and the public.
2. Th~ pub~ic health, sa~ety, and general ~lelfare requires
adoption of the pr~pased amendment, in that clear defini-
tio~s in the Zani~g 4rdinance are important in arder tQ
implement the City's goals and policies stat~d in the
General Plan. The praposed Text Amendment pravides greatar
clarity in the Definitians seetion of the Ordinance.

The ~'ollowing words ar phrases as used in thi5 Chapter shall

Accessory Building. A detached building y4piX~~i ~C~ lacated on

percent (100~} of the dwelling units are deed-restricted ar
restric~ed by an agreement appraved by the City for accupancy by
1Qw or moderate incame hauseholds. Such prajects may also
include non-residentia~ uses, as lang as such uses do not exceed
thirty-three pexcent (33%} of the f~oor area of the total
p~oject.
A~tered Grade. A change in the elevation of the ground
surface fram its natural state due to grading, excavation or
filling,
Arcade. A publie passageway or colonnade open alang at least
ane side. except for structural supports, usually cove~ed by a
canopy or permanent roafing.
Art Gallery. A raam ar struc~ure ir~ which original works of
ar~ or limited editians of original art are bought, so~d, loaned,
appraised, or exhibited to the general public.

dealerships offering a variety of automabile makes and madels
proposed as a single development prQject.
Automobile Dealership. Any business establish~en~ which sells
az ~eases new ar u~ed automobiles, trucks, van5, trailers,
~ecreational vehicles, boats or matorcycles or other similar
motorized transportation vehicles. An automob~le dealership may
maintain an inventory of the vehicles for sa~e or lease either
an-site or at a nearby location and may pravide on-site
faci~ities for the r~pair and service of the vehicles so~d or
leased by the dealership.
Automobile Display Lot. Any property used for the display,
lease and sale of new or used automobiles, ~ight trucks, vans,
trailers, recreational vehicles, motarcycles, boats ar ather
similar vehicles.
Autamobi~e Rental Agency. Any business establishment which
rents or 4therwise pravides matarized transportatian vehicles on
a short-term basis typically for pEriods of less than one month,
and which maintains such veh~cles an-site ar at a nearby
lacation. For the purpose af this Chapter, rental of trucks
exceeding ane ton capacity or rental of other heavy equ~pment
shall constitute dis~inct uses separate fram an a~tomobi~e rental
agency.
Automobile Repair ~acility. Any buildzng, structure,
impravements, or land used for the repaXr and maintenance of
autamabiles, motorcycles, ~~~ trucks, traxlers, or simiZar
vehicles including but not limi~ed ta body, fender, muffler, or
upholstery work, oil change and lubricatian, painting, tire
service and sales, ar the installation of CB radios, car alarms,
s~ereo equipment, or cellular te~ephones.

consumption off-site. The products may be prepared either on or

Balcony. A platform that projects fram the wa~l of a buildxng
and is surrounded on the exposed sides by a railing or wall up to
42 inches in height.
Bar. An establishment with a"public premises" liquor license
and restaurants with a liquor se~ving facility that is physically
separate from the dining area and is regularly ap~rated during

Basement. The portion af a structurE be~ow the finished first
floor. A basement sha1Z be considared a story if the finished
first flaor extends more than 3 feet above the average natural

Bathroom, Full. A raom aontaining a sink, ~ toilet, and a

Bay Window. An angular ar curved window which prajeats from

Bed and Breakfast Facility. A building or porti~n ~~ ~

Boarding House. A residentia~ building with cammon caaking and
eating facilities where a room or any portion of a room is rented
for periods af at least ~hirty (30) days to a person or persons

Amendment and changes recommended sancE the staff report
was written. Changes ~nclude maving the definition for

Vice Cha~r Pyne asked Mr Webster about changes to the
defin~taon for "incidental food service" Mr. Webster
explained the rationale behind the changes and
enforcement problems that have arisen regarding this
type af use.
Mr. Webstex explained changes to the definition for
"substantial remodel". This issue was discussed in
detail by the Commission.
One mernber of the gub~ic, Ch~istine Day, 2203 Azrport

Starbucks.

stations", and suggested the word "auto" be added

Mr. webster stated that the "day care" reference can be

definition for "club" on page five. Mr. Webster stated
that the definition is now under "private club".

~en of the staff report} , the Comrnission. had a series of
comments and questions. Commissioner Zinner asked about
referenCes to hoth allowable square footage and
percentage of floor area. Mr. Webster explained about
the primary use af s~te versus the incidental use and
the inten.tion to limit illegal growth of an incidental
use.
Commissioner Breisch asked about the total square
~ootage for incidental food service and parking
consaderations. Mr. Webster explained restaurant
restricta.ons on Main Street and the Third Street
Prornenade and pax'king requirements for restauran~s of a
certain size.
Commissianer Parlee asked about the definitaon for
seating and "fixed barriers or f~xed cha~rs or tables".
The Commission discussed the ~ssues of fixed seata.ng and
tabJ.es, as we11 as accessib3litiy issues as x'egards
barriers and fixed seating.
Commissioner Parl~e made a motion to direct sta~f to
rev~se the definition for incidental food service, and
that the definition will include reta~ning the 250
square feet for incidental food service, expanded fixed
barrxer, fixed ~ables and/or sea'~s, and define the
na~ur~ of food to be served.
Cam~nissioner Zinner seconded the motion. He asked about
outdoor seating. Commissioner Parlee felt the outdoor
d~.n~ng specifications ~or the Th~rd Street Promenade
would be adequate. Mr. Webster stated that the
allowable number af s~ats would change if a~tdoor
seatzng is included
There was a d~scussion regarding the number of fixed
seats inside an incidental food sErvice to be specified
in the definit~on. It was suggested ~hat twenty-five
would be a good figure.
Comm~ssianer Zinner asked that staff rEView the number
of fixed outdoor seats. Mr. Webster stated that these
issues will be reviewed and will be returned to the
Comr~iss~on prior to sending zt on to City Council.

Mr. Webster stated that the Building Code defines
mezzanines as not having walls ar partitians. He also
stated that the new definition includes no bathrooms or
closets. Commissioner Weremiuk stated that she would
want a closet in a mezzanine.
Commissioner Parlee expressed concerns regarding
mezzanines. Mr. Webster stated that staff`s concern is
that mezzanines, wzth amenities such as closets, may
become bedrooms, which changes the parking requirements.
Several Co~missioners expressed the need for closet
and/or storage space.

part, of a structure. A structure shall be deemed to have been
substantially remodeled ar demoliahed if at least 50% of exterior
walls have been removed ar rel.ocated for any duration o£ time. A

legal, non-conforming status which it may have had and may only

Comprehensive Land Use and Zoninq Ordinance
Santa Mcniua Municipal Code Section 9.04.20.34.030 {g} is
proposed to read as fal~ows:
~g) A~low a building to reta~n nonconfarrning setbacks when
substant-a??y remodelled provided all of the following criter~a
are met:
;l) The nonconformity of ~he setback(s) and building may
not ~e increased
(2} A~ least 350 of the wall sub~ect to the ad~ustment
shaz~ Yema;n as defined in Sectzon 9.04.20.030 If more than ane
wall req~si~es an ad~ustment, at least 350 of each wall shall
remain
(3; Thzre has been na ~rior addition under this Section.
