Brief desc~ip~icns of the rationale of the proposed Changes are
provided below. `The proposed ordinance contained in Attachment A
srows ~he exis:~ng code with proposed deletio~s in strike-au~ and

A moai=icatian which cccurs throughout the clean up is a change
from tre use of the term "lot" to "parcel". This ~s done in order
to prov=de consistency throug?:ou~. ~he code. A second
-rodif~cat~on is t~e deletion of terms that have envire Parts i~
t~e Code. Fc~ example, "home occupation" has a part ~n the Cod~
which establ~shes procedures for an a definition. of home
occupations; therefore, a separate definition is not needed.
In addition, some of the definitions for specific terms have been
~r,ovnd and p~aced under ~he key word Fer examble, ra~her than
"Fast-Faod or Take-Out Res~aurant" b~ing under "F", tnis term has
bee~ placed under "Restaurant, Fast-~ood or Take-Cut". This is
beA~g done in order to ke~p like definitions together.

Acc~ssory Buildinq. This is a modif3ca~ion to the current
d~finition to aad a notation that there is a distance of 5 feet
between an accessory building and the principal sCruct~re on a
parcel. The defin~t-on pravides that an accessory building is
"'d2tached" and the purpose of s~ating a distance is to provide
d_rection on what c~nstitutes detached in this ~ontext In
addz~~on, the definition provides that the 5 minimum feet space
betweer an accessory bui-ding and ~he principal structure may be
covered but must remain apen on two sides
Accassory Livinq Quarters This ~s a clarifica~ion to the
existing d2f~nit~or~. Rat~~r than sta~ing that the quar~ers cannot
have "coaking facilities"', tne definition is being clarified to
read "kitchen, showzr, or tub enclosure". The proposed change
re=at2s th~s definitian tQ that of "kitchen" rather than using
4h~ term "cook~ng facilities" which are not defined. The

direcrion as to what can and cannot be included in accessory

Artis~ Studio. The propcsed chanaes are to c].arify that an artist
studio caz be eitrer an ent_re build~ng or a portian of a
bui~dir_g where an art~st works. The proposed definition draws a
distinc~ior between artist studzos and performa:~ce or exhibition
s~ace.

A~utamobile Repair Facility. The words "trailers, or similar
vehicles" is added to ex~and ~he def~n~t~on and provide greater
clarity.
Automobi~e Sales Fac=lity. This dzfinition is b~ing deleted sinc~
it is not used elsewhere in the Code. The te~m "Autornobile
Dea-zrship" is coMMOn?y ased.
Au~ornobile Service Station. Thi~ definition has been moved ~rom
"~e_rv_ce Stati~n" and the word "Automobile" has been added to
refe~en~e a~ore commonly used term.
Aatomobi_e Stcraqe ^he phrase "off-site or or_-site" has been
added ta the defi~ition for clari~ica~~or nurposes. The stcrage
can be _~ relatioz to an automobi~e dealership that either shares
the property or is located on a separate property
Bakery. A dzfinition is being addEd for bakery since it is a use
that ~s s~ecifically ident~fied as a permit~ed use in some of the
zoning ~istricts, su~h as tre C4. This d~Tinition is similar ~o
t~~at adopted ~n tnz I~ierim Fast Food Ordinance ~y City Council
c~ September 13, 19~4. T~e definit~on includes language that
bakeries are conszdered a general reta_1 use, which will clarify
that bakerie~ may be located in zonzs in whic~ ge~eral retazl use
is allowed.
Bathroom, Fall & Bat~roo~, Hal~ Definit~ons are being added for
~ull and ~alf bathroorns There are instances, such as in
accessory baildings, where only half bathrooms are allowed so

CITY OF SANTA MONICA AMENDING ZONING
ORDINANCE SECTION 9.04.02,030 REGARDING DEFINITIONS;
AND SECTTON 9.04.20.34.030 REGARDING ADJUSTMENTS
WHEREAS, the Planning Cammisszon adapted a Resalution of
Intention to amend the Definitians and Adjustment section of the
zoning ordinance; and
WHEREAS, the Planning Co~nmission held a public hearing on the
proposed amend5nent and made recommendations to the C~ty Council
following the hearing; and
WHEREAS, the City Council held a public hearing on the
proposed amendxnent; and
WHEREAS, the City Cauncil finds and declares that the
proposed amendment is consistent in principle with the gaals,
ob~ectives, policies, land uses, and programs specified in the
adapted General Plan, including several of the objectives listed
under Objective 1.1 nf the Land Use Element of the General Plan,
including protecting the quality of life in all ~'esidential

neighborhoods, promoting affordable housing, and insuring fair
treatment af property awners and residents in that the Zoning
Ordinance is the primary means af implementing the policies of
the General Plan, and to effect~vely implement General Plan
policies, the Zoning Ordinance must be clear, concise, and
camp~et~ in its expression of the City's land use policies; the
proposed changes to the Definitions section of the Zoning
Ordinance will act to clarify existing definitions; add new
definitions of terms used in th~ Ordinance, and reduce
unn~cessary or duplicative language by d~leting terms which are
not used in the Ordinance or are defined elsewhere ~n the
Ordinanc~; in addition, the proposed amendment ta the Adjustment
section of the Zoning Ordinance will promote the retention of
useful building elements, which may, among other effects, reduce
consumption of na~ural resources and act to reduce development
costs, promoting housing affordability; and
WHEREAS, the public health, safety, and general welfare
require the adaption of the proposed amendment, in that the
propased changes to the Definitions sectian of the Zoning Ordinance
will act to enhance understanding of and compliance with the
development standards of the General P~an as implemented by the
~oning ~rdinance; in addition, the praposed amendment to the
Adjustment section af the Zaning ordinance will, by allowing the
retention of viable building elements, reduce consumption of

Thirty-Threa Percent (33~) of the floor area of the total

Altered Grade. A change in the elevation of the
ground surface from its n~tura~ state due to grading,
excavation o~ filling.
Arcade. A public passageway or colonnade open along
at least one side, except for structural supports,
usually cavered by a canopy or permanent raofing,

Hameless Shelter. A residential facility, other than
a cammunity care facility, operated by a provider which
provides temporary accammodations to persons or families
with low incame. The term "temporary accommodations"
means that a person or family will be allowed to reside
at the shelter for a time period not ta exceed six ~5~
months. Far purpose of this definition, a"provider"
shall mean a government agency or private rion-profit
organization which pravides or contracts with recognized
community organizations to provide emergency or temporary
shelter, and wh~ch xnay alsa provide meals, counseling and

the facility. Such a facility may have individual rooms,
but is not developed with ind~vidua~ dwelling units, with

Haspiae. A facility that provides residential living

hospice is a permitted use in all residential districts.
Hotel. A building, group of buildings, or a portion
of a building which is designed for or occupied as the
temporary lodging place of individuals for less than
thirty {3~3~ consecutive days including, but not limited

apartment hotel, hastel, inn, time share praject, tourist
court, or other similar use.
Household. Fersons living together in a single

Parcel, Flaq. A parcel not fronting on or abutting

Parcel Frontaqe. Tha width of the front parcel line

Parcel, Rey. The first interior parcel to the rear
of a reversed corner parcel and not separated therefrom

appendices theretos inconsistent with the provisions of this
Ordinance, to the e~tent af such inconsistencies and no further~
are hereby repealed or modified ta that extent necessary to effect
the provisions of this Ordinance.
SECTION 4. If any sectian, subsection, sentence, clause, or
phrase of this Ord~nance is for any reason held to be invalid or
unconstitutional by a dec~sion of any caurt of any competent
~urisdiction, such decision shall no~ affect the validity af the
remazning par~ions of this Ordinance. The City Council hereby
d~clares that it would hav~ passed this Ordinance, and each and
every section, subsectian, sentence, clause, or phrase not declared
invalid ar unconstitutional without regard to whether any partion
of the Ordinance would be subsequently declared znvalid or

SECTION 5. The Mayor shall sign and the City Clerk shall
