INTRODUCTJ;ON
This repo~t recom~ends ~hat the Clty Council extend ny resolutlon
the time pe~iQd for exerclslLg Certiflcate of App~oprlateness LC-
05-022C permlttlng the replacement of an eXlsting wood fence wlth
a wood and netal fence at 415 Paclflc Coast Hlghway, the slte of
the Norch Guest House at the MarlOr. Dav~es Es~ate. Pursuant to
Section 9 36 170 (h) of the Santa Monica Munlclpal Code (SMMC)
this approved Certlflcate of Approprlateness wlll explre on April
10, 1995 if It 18 not exte:lded by the Clty Cour:cll. Staff lS

BACKGROUND
The Landmarks Com~lSSlon approved t~l8 Certlflcate of
Appropriateness permit on October 10, 1994. ~he proJect involves
replaclng a deterlo~atlng and damaged fence wlth a wood and metal
fence and gates at 415 Paclflc Coast Hlghway
As stipulated In the Landnarks Ordlnance, permlt approval expires

wlthln 180 days unless the authorlzed work has begun. The Clty
Engineerlng D1V1Slon has been unable to begi~ work on the proJect
withi::J. the tlme speclfled In the Certlflcate of Approprlateness
and has requested a SlX Tonth extenslon
On Ylarch ~3, 1995, the Landmarks CommlSSlon recommended that the
Clty Councll extend the Certificate approval for the maXlmum 180
day perlod. If the Certiflcate of Approprlateness is not
extended, the C::.ty Englneerlng D1V1Slon would be required to
resubmlt a Certiflcate of Appropriateness applicatlon and a new
publlC hearlng would be req',llred. As stated :..n Sectlon 9.36 250
of the Landmarks Ordlnance, Cer'.:ificate of Appropriateness
approvals may only be extended by C:.ty Council resolutlon upon a
recommendatlon of the Land~arks Co~nlssion.

RECOMMENDATION
It lS respectfully recommended that the CounCll adopt the

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
EXTENDING THE TIME PERIOD FOR EXERCISING A
CERTIFICATE OF APPROPRIATENESS PERMITTING
A REPLACEMENT FENCE AT 415 PACIFIC COAST HIGHWAY
WHEREAS, a Certiflcate of Approprlateness appllcation was
filed requestlng a replacement fence along Paclflc Coast Highway
at 415 Paciflc Coast Highway, historically known as the slte of
the North Guest House at the Marlon Davies Estate, on September
25, 1994; and
WHEREAS, the Landmarks Commisslon, followlng a pub11c
hearlng, approved the requested Certificate of Approprlateness on
October 10, 1994; and
WHEREAS, the Landmarks CommlSSlon recommended City Council
extend the Certlflcate of Approprlateness approval by resolutlon
for the maximum 180 day period on March 13, 1995; and
WHEREAS, pursuant to Santa Monlca Munlclpal Code Section
9.36.170(h} , this Certlflcate of Approprlateness shall explre if
the work authorized lS not commenced wlthln 180 days of the
approval; and
WHEREAS, th~s Certlflcate of Approprlateness shall explre
on April 10, 1995 unless otherWlse extended; and
