AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS
9.04.10.08.190 AND 9.04.10.08.200 REGARDING COMMON
SUBTERRANEAN PARKING STRUCTURES AND LOCATION OF REQUIRED
PARKING SPACES
INTRODUCTION
At its meet1ng on March 21, 1995, the city council introduced for
first reading an ord1nance amending Santa Mon1ca Municipal Code
Sections 9.04.10.08.190 and 9.04.10.08.200 regarding common
subterranean parking structures and locations of required parking
spaces.
The ordinance is now presented to the City Council for
adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying ordinance be
adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL
CODE SECTIONS 9.04.10.08.190 AND 9.04.10.08.200
REGARDING COMMON SUBTERRANEAN PARKING STRUCTURES AND
LOCATION OF REQUIRED PARKING SPACES
HHEREAS, the Plannlng COmIHssion adopted a Resolutlon of
Intentlon to amend the zonlng ordinance to prohlbit projects on
indlVldual parcels from sharlng subterranean parking structures
unless the parcels were comblnedi and adopted a Resolutlon of
Intention to allow greater design flexlblllty In garagesi and
WHEREAS, the Plann1ng Cornm1ssion held a publ1C hearlng on the
proposed amendments on June 15, 1994 and November 2, 1994, and made
recommendations to the City Councll following the hear1ngi and
WHEREAS, the city Council finds and declares that the
proposed amendment 1S conslstent in pr1nclple w1th the goals,
Ob)ectlves, policles, land uses, and programs specified 1n the
adopted General Plan, 1n that the amendments allows development
conslstent with the General Plan, and ensures that while greater
des1gn flexibility 1S provlded, development projects comply with

applicable setback, lnclusionary housing and environmental review
requ~rementsi and
WHEREAS, the public health, safety, and general welfare
requlre the adoption of the proposed amendment, in that the
amendment wlll allow greater deslgn fleXlbillty and ensure that
indl vidual projects will not be bUll t over common subterranean
garages and thereby avold environmental analysis and incluslonary
houslng requlrements associated with larger projects;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. section 9.04.10.08.190 of the Santa Monica
Municlpal Code 15 amended to read as follows:
9.04. 10.08.190 Loca tioD of required parking spaces.
(a) Requlred off-street parklng spaces shall be
located on the parcel or bUllding slte. In commercial or
lndustrial dlstricts, off-street parking may be located
off of the parcel or bUl1ding slte, except as prohlblted
by section 9.04.10.08.200 of this Chapter, lf each of the
followlng conditions are satisfied:
(1) All parking spaces are located W~ thin
1,000 feet of the perimeter of the parcel or bUlldlng
Slte and the parking area commences w1thin 300 feet of

the perimeter. This distance shall be computed from the
nearest point of the parking area.
(2) The property on which the park~ng spaces
are provlded is owned in fee by the owner of the parcel
or bU1lding slte WhlCh 1S subject to the parklng space
requ~rements.
(3) Addi tional documents, covenants, deed
restrictions, or other agreements as may be deemed
necessary by the Zonlng Adm~nistrator are executed to
assure that the required parking spaces are maintained
off slte.
(b) Parking requirements may not be met by providing
park1ng in the front one-half of a parcel ~n a
resldentlal district except:
(1) In a garage WhlCh shall have not more than
18 feet of garage door or doors facing the front lot
llne for each 75 feet or fraction thereof of lot wldth.
A door to a slngle space shall be not less than 8 feet
nor more than 9 feet wlde, and a door to two spaces shall
not be more than 16 feet wlde. Not more than one double
garage may be entered from the side street slde of a
corner of a reversed corner lot through a door not more
than 16 feet w1de. Any garage on the front one-half of a
lot or on the side street slde of a corner or a reversed
corner lot shall be fully enclosed wlthin the
architecture and structure of the maln bULldlng except

for entrances;
(2) In mult~-famlly res~dent~al districts,
where the parcel has no alley, provlded that no part of
a requlred front yard shall be used for parking purposes;
(3) Where the parcel J..S in the A Overlay
Dlstrlct and has been approved for parking use pursuant
to the prov151ons of Part 9.04.08.36.
SECTION 2. Section 9.04.10.08.200 of the Santa Monica
Munlclpal Code 15 amended to read as follows:
9.04.10.08.200 Subterranean parking structures.
A parklng structure shall be considered to be
subterranean if the structure 15 entirely underground.
All subterranean parking structures shall be constructed
and malntained as follows:
(a) All open1ngs for ingress and egress facing the
front parcel line shall be s~tuated at or behlnd the
front building line of the main bUllding. There shall be
no more than two openings facing the front parcel llne
for each main bUllding.
(b) A subterranean parklng structure may be
constructed and malntalned In any requlred yard area
except ~n the requ~red unexcavated areas.
(c) Exits from any subterranean parklng structure
shall provide slght distance WhlCh comply with standards

establlshed by the city Parklng and Trafflc Englneer.
(d) Development located on two or more separate
parcels may share common subterranean parking garages or
llnk clrculatlon between subterranean parking facllitles
only lf the parcels are combined pursuant to Sectlon
9.04.06.010(g) .
SECTION 3. Any provision of the Santa Monica Municipal Code
or appendlces thereto, inconsistent with the provisions of this
Ordinance, to the extent of such inconslstencies and no further,
are hereby repealed or modified to that extent necessary to effect
the provlslons of this Ordlnance.
SECTION 4. If any sectlon, subsectlon, sentence, clause, or
phrase of thlS Ord~nance ~s for any reason held to be lnvalld or
unconstitutional by a decislon of any court of any competent
Jurisdiction, such deC1Slon shall not affect the validlty of the
remalnlng portions of thlS Ordinance. The city council hereby
declares that it would have passed this ordinance, and each and
every section, subsectlon, sentence, clause, or phrase not declared
invalld or unconstitutlonal wlthout regard to whether any portlon
of the Ord~nance would be subsequently declared lnvalid or
unconstltut1.onal.
SECTION 5. The Mayor shall sign and the Clty Clerk shall
attest to the passage of thlS Ordlnance. The Clty Clerk shall

cause the same to be published once ln the officl.al newspaper
within 15 days after its adoption.
This Ordlnance sha II be
effectlve 30 days from its adoptl.on.
