Cafe and has a menu af salads, sat~dwiches, burgers, burritos, juices, shakes and smoottues (Attachment E). The non-service area contains a smal~ self-serve salad bar. In con~unetion v+nth the proposed alcohol license, the apphcant proposes to add 14 booth-style cafe seats withzn an area which is currently used for display of retail merchandise T~e existuig ~tuce bar/cafe ~s located with~ an entry azea of the gymnasium and is open to the general public. No street-level signage exists for the juiee bar/cafe, but the applicant has stated that he plans ta apply to the Architectural Review Board for additional signage at the site to identify the Third Street Natural juice bar/cafe. Canclusion Altho~gh the exishng food-serv~ng establishment currently has an extensive food menu, the kitchen and seatuig areas are muumal The prunary use of the sub~ect business ~s a health club rather than a restaurant, with appraximately 7,000 square feet devoted ta gy~ uses and approximately 425 square feet devoted to food and beverage sernce {mcluding kitchen area} If the sub}ect fa,cility were not ~n the Bayside District, the ~rigtnal permztted food use would have fallen under the category of incidental food service ra#her than restararant Grven the small krtchen size, the poten~ia~ exists for creatuig a bar-like environment where people coine to dnnk alcohol rather than consume food ar non-alcoholic beverages Based on these factors, and the findings contained belaw, Plann~~~ staff concurs vv~th the Police Depar'trnent and recommends that th~.s applicat~on be demed by the Planning Commission - 4 - ~_ ~~ ~ RECONIIbIENDATION It is recommended that the Planning Cam~ssion deny CUP 94-017 based on the follow7ng findings• CONDITIONAL USE PERMIT FINDINGS 1 The praposed use is one conditionally permitted within the su~aject dismct and comp~ies with alt of the agplicable provisions of the "City of Santa Monica Comprehensive Land Use and Zoning Ordinance", in that an alcohal license in con~unct~on with a food seavice is canditionally pemutted in the C3C district of the Zoning Ordinance and in the T~uurd Street Mali Specific Plan. However, given the minirr~ kitchen facilities an-site and the incidental nature of the faad-serving use relative to the health club ~se at the srte, a denial of the proposed license is eonsistent with SMMC Sectian 9.44 10 18.O10{c), wl~ch states that "approval [shall be] based on the specific type of alcohol aut~et, neighborhood location, and patEntial problems xnvolved." 2 The proposed use would impair the in~egrity and character af the district in which it is to be established or located, in that the C3C distnct and Tlurd Street Mall Specific Plan azea perrmxs alcohol uses that aze ancillary to food uses, and the proposed alcohol use would be ancillary to a health club use to which food service ~s mcidental. 3. The proposed use is not compatible with any of the land uses presently an the sub~ect pazcel if the present land uses are to remain, ~n that the issuance of a Type 41 {On-Sale Beer and Wine for a Bona Fide Public Eat~ng Place) alcohol license is incompat~ble wrth the allowed ~uice bar v~th limrted ~utchen facilities lacated witlun at~ appraximately 7,U00 square foot health club 4 The praposed use would he incompatible with existing and permissible land uses wir.hin ~he district and the general area u~ which the proposed use is to be located, m that the zoning of the srte condltionally pemuts the ISSUaf1C~ of an alcohoi hcense for bona fide public eat~ng places. and the eacisting approved ~tuce bar/cafe is ancidental to a health club use and does not contain sufficient facilit~es to ensure that it will be continually utilized as a bona fide pubhc eating place. 5 The physical lacation or piacement of the use on the site is ~ncampatible with and relates unharmoniously to the surrounding neighborhood, in that the proposed Type 41 alcohol license is permitted only for a bona fide pubiic eat~ng place, and the incidental nature of the foad sen~ice relative to the health club use lends itself to the use of the alcohol license m a manner similar to a public premises, which is associated with alcohoi problems in the area and far which a license has not been -5- ~• ~I~ ~ filed 5 The proposed use as inconsistent vv~th #he goals, ob~ecti~ves, and pahcies of the General Plan, in that Policy 1.2 4 of the Land Use Element of the General PIan states t~at th~ Csty shall "limrt or control the location or otherwise mitigate the impact of commercial uses such as alcohol outlets" city-wide, and the proposed alcahol outlet has the patential to be utilized as a pubiic premises establishment arid that, u+hile Third Street Mall Sgecific Pia~ Policy 4.1.5 encourages the develogment of eating and drinktng establishments to promote econoiruc acti~ty ~ the area, the size and locat~on of the cafe, which may inhibrt general public access, and the cafe's aperation, wluch is incidental to the primary hea.lth club establishment, will not serve to promote act~vity in the area. 7 The propased use wouId be detrimental to the pubhc interest, health, safet}~, convenience, or general welfaze, ~ that the proposed permit would allow alcohol service in association with a food use which zs incidental to a health club and wo~ld have the patential to be utilized as a public premises. 8 The proposed use will not result xn an averconcentration of such uses m the imme~iate vicinity, in that the proposed alcahol license is a Type 41 license and on~ addrtional Type 41 or Type 47 license is perFnitted within Block 4 of the Third Street Promenade, where the praposed use is Iocated. However, given the layout of the proposed operat~on and the lack of sigm~icant kitchen facilities, the proposed use has the potential to be operated effect~vely as a generai prert~ses, which is a type af outlet that has contributed significandy to alcohol related problems in the area. ALCOHOL OUTLET FINDINGS I The praposed use and location is not in accordance with good zontng practice, is not in the public interest, and is not necessary that substant~al justice be done in that the alcohvl l~cense wauld be for a ~uice bar/cafe ~at is incidental to the pnnnary health club use and that alcohol in this type af facility could Iead to a prolifera~ion of alcohol autlets m establishments that are not pr'unarily food-serving operations. 2 The proposed use would adversely affect the welfare of neighborhoad residents in a significant rnanner in that the us~e cot-ld be easily converted from a bona fide pubhc eating place to a public preriuses, which is a type of alcohol autlet associated with alcohoI-related problems in the area 3 The proposed use will not contribute to an undue concentrahon af alcouol outlets in ~ the area in that a restaurant is not typically considered ta contnbute to o6jectionable problems assac;ated wrth alcohol autlets, and tha~ the area is in the - 6 - ~~ 018 downtoun portion af Santa Moruca which is frequen#ed by large numbers of local residents as well as office workers. shoppers, and ~isitors from outside the area However, given the size, location and layout of the proposed operation and the lack of sig~uficant kitchen facilrties, the p~oposed use has the potential tc~ be operated effectively as a general premises, which is a type of outlet that has contnhuted sigruficantly to alcohol related problerns m the area. 4, The proposed use wouid ~~e a potent~al to detrimentally affect nearby neighborhoods consider~ng the distance of the alcohol outlet ta residential buildings, churches, schooIs, hospitals, playgrounds, parks, ar~d other existin~ alcoho~ outlets in that tlae proposed facility wfluld have the pQtent~al to be utiliaed as a public premises and is within a 500' radius of a priva#e elementary school acid a private preschool 5 The proposed use is incompatible with exxsting and potential uses with~n the general area in that the ~uice bar/cafe would have the potent~aI to be effectively u~ilized as a public prem~ses 6 The p~blic health, safety, and general welfate are not protected in that the proposed use would allow alcohol service m an estabIishment that is primarily a health club 7 Harm ta ad~acent properties couId potentially result in that, because of the layout and timrted lutchen facilit~es contained at the establishment, rt would be difficutt to adequately condit~on ~he application to ensure that tt~e use would be maintained as a bona fide public eating estabhshment 8. 'Ihe praposed use is inconsistent with the goaLs, objecti~es, and policies of the G~n~al Pla~, in that Palicy 1.2.4 of the Land Use Element of the General Plan s±~±~s that the City shall "limit or control #he locahon or otherwise mitigate the impact of oomm~erc~a~ us~ such as alcohol outlets" city-wid~ and the proposed aloohal outlet has the potential to be utiliz~ad as a public premis~s establishrnent and that, while Third Street Mall Specific Plan Policy 4.1.5 encotuages the developmerit of eat~ng and drinking establishments to promote economic acavity in the ar~ea, ~lie size and locatian of the cafe, whir.h may inhibit general public acc~ss, and the cafe's operation, wluch ~s incidental to the primary heaIth club establis~mer~t, will not sexve to prnrrvo~te activity in the m~ea. 7. The proposed use would he detrimental to the public interesc, heal#h, safety, convenie~ce, ar g~eral welfare, in that the pt~oposed pemut would a11aw aloahol service in as.sociation with a foai ~e which is incide~tal tc~ a health club and, due to the l~k of standard r~±~~ ~ant cooking eqe~ipment such as a gxill, stove, or oven, would have the potential ta he utilized as a public prem~ses 8 The pra~ use will not result in an ov~c~tration of such tases in the imme~diat~ vicinity, in that the proposed aloohol lic~se is a Type 4~ license and one a~~Ttional Type 4~ ar Type 471icense is pemutted wi~hin Block 4 of the 'Ihird Str~t Pram~ad~, wh~e the proposed t~se is locatcd. However, given ti~e layout of the propased operation and the Iack of significant kitchen facilities, such a~ a grill, stove, ar uven, the proposed use has the potential to be opeiated effectively as a ge:neral premises, w~ich is a fype of outle~ that has contributed signifiicantly to alcohol reiated problems in the a~rea. AL~OHOL Oi_JTI ~ET FINDINGS 1. The praposed use and location is not in accordance with good zoning practice, is not m the public ~nterest, and is not necessary thaa~t substantial justioe be done in that the alcohol license would be for a juice barlcafe, without standard r~~~~ant cooking equipm+~t such as a grill, stove, or aven, that is incid~tal to the primary health club use and that alcohol in ~his type of facility could lead to a proliferatian of alcohol outl~ u~ establishments that are nat primarily faoc!-serving operations. 2. The proposed use would adversely affect the welf~re of neighborhood residerns in a sig~uficant maruier in that given the lack of standard r~~~?rant cooking ex~utpn~en~ the use could be easily converted from a bona fide pubiic eating place to a public premises, which is a type of alcohol outlet associated with alcahol-relazed prablems in the ~rea. 3 The proposed use will not corrtribute to an undue concen~ion of alcohol outlets in the area in that a resr~»±~ant is not typically considered to cantnbute to objeckianable problems associated with alcohol outlets, and that the area is in the dawntown portion 3 ~ ~ 051 of Santa Monica which is fra~uentad by large nw~ri6ers of local r~sid~ts as well as office warkers, shoppers, and visitors from autside the a~+ea. However, given the size, lacation and layaut of the propased operation and the lack of significant krtchen facilities, the proposed use has the potential to be op~rated effectively as a g~rteral premises, which is a type of outle~ that has contrib~rted significantly to alcohol related p~obiems in the area, and thaa~t given the second floor location and oonnection to the health club, the ~uice bar vM~l not function as an independent establishment easily acces.sible to the pubiic. 4. The proposed use wouid have a patential to de~in~tally aff~ct nearhy neighb~hoods consid~ing the distance af the alcohol outlet to resi~tia~ building,s, cLurches, schools, ~p~tals, P1~YSro~ P~ and othet' existitig a~cohol outlets in that the proposed facility would have #he potential to be trtilized as a pub~ic pr~mises and is within a SQO' radius of a private elernentary sr~zool and a p~ivate preschool. 5. The prQposed use is incoin}~tible with exi~ting and pot~tial uses within the ~ az~ea in that the jui~ bar/cafe wouid have the poter~ria~ to be effectively ukili~d as a public Premises. 6. 1he public health, safery, and general we~ne are not ~motected in t~at the ~opose~ use would a~low alcohol servioe in an establishment that is primarily a health club. 7 Harm to adjac~nt properkies could potentially result in tl~at, beca~se of the layout and lun~ted kitchen faci~ities caartained at the estabIishmern, it would be difficult to adequately condition the application ta ensure that the use would be rr~aintained as a bona fide pubiic eating establ.ishment. $.
