SR-8-D (24) / o()- 00/ ~1-~ Santa Monica, California CA:RMM:jld493jhpc City Council Meeting 10-9-90 STAFF REPORT FROM: Mayor and City Council city Attorney TO: SUBJECT: Ordinance Adding Chapter lA to Article I of the Santa Monica Municipal Code Relating to the Posting of Agenda Notices At its meeting on August 7, 1990, the City council directed the city Attorney to prepare an ordinance to require agendas to be posted at least 72 hours in advance of city council meetings. The accompanying ordinance has been prepared in response to this direction. The ordinance mirrors the language of the state's open meeting law, the Brown Act, and would affect city Council meetings as well as meetings of City boards and commissions. In addition, the ordinance adopts the language of the Brown Act with respect to special and emergency meetings. RECOMMENDATION It is respectfully recommended that the accompanying ordinance be introduced for first reading. PREPARED BY: Robert M. SIDEWALK WORK-DONE-2 WORK-DONE-J WORK-DONE-4 (b) Action may only be taken on items appearing on the posted agenda unless one of the following conditions are met: (~) By a majority vote the City Council, board or commission determines that an emergency situation exists that severely impairs public health or safety. (2) By a two-thirds vote, or if less than two thirds of the body is present by a unanimous vote, the City Council, board or commission determines that the need to take action arose subsequent to the agenda being posted. (3) The matter was continued from an earlier meeting held not more than five calendar days prior to date action is taken on the item, and at the prior meeting the item was continued to the meeting at which action is being taken. SECTION 1121. Posting of Agendas for Special and Emerqency Meetinqs. (a) At least 24 hours before a special meeting of the City Councilor any City board or commission, an agenda - 2 - of the special meeting shall be conspicuously posted specifying the time and location of the special meeting and a brief general description of each item of business to be transacted or discussed at the special meeting. (b) Notice of the meeting shall be provided City Council and board members or commissioners in the manner provided for in Government Code Section 54956. (c) Unless an emergency occurs that severely impairs public health or safety, no business other than that which appears on the posted agenda may be transacted at the special meeting. (d) Emergency meetings of the City Council, boards and commissions may be called and conducted in accordance with the provisions of Government Code section 54956.5. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid - 3 - -...- with all objections and protests as required by section 5618 of the streets and Highway Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The report of the Superintendent of streets heretofore filed and above-described be, and the same hereby is, confirmed. SECTION 2. All protests and objections of every kind and nature to the report of the Superintendent of streets be and the same hereby are, overruled and denied. SECTION 3. The cost of the repairs, as set forth in the report of the Superintendent of streets, shall be assessed against the properties therein described, which properties front the sidewalk upon which the repairs were made. SECTION 4. If such assessment is not paid within the time permitted by law, the same shall constitute a special assessment against and lien on the properties therein described in the amount set forth in the report of the Superintendent of streets, which lien shall continue until the assessment and all interest thereon is paid or until it is discharged of record. SECTION 5. If the assessment is not paid within the time permitted by law, the Superintendent of Streets, in accordance with section 5628 of the streets and Highway code, shall deliver a Notice of Lien, prepared in the manner required by Section 5626 of the streets and Highways Code, to the County Auditor who shall collect the assessment together with all other taxes against the property. SECTION 6. The city Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: r~.It ~ ~ ROBERT M.
