CM:LCB:dvm (Ord1303) City Council Mtg. 10/23/90 Santa Monica, California TO: Mayor and City Council FROM: city Staff SUBJECT: Proposed Revision to ordinances Regarding the Parking and Business Improvement Areas Introduction This report recommends that the City Council direct the City Attorney to prepare an amended ordinance expanding the purposes to which the Main street, Downtown and Montana Avenue business parking and improvement areas assessment proceeds can be used to be in compliance with the state and Highways Code Section 36000. Background The present ordinances provide that assessments from these Parking and Business Improvement areas can only be used for the "promotion of business activities in the area." The city has been asked to expand the allowable uses to all of those provided for in the state law which governs these type of districts. Section 36000 of the state Parking and Business Improvement Area Law of 1965 authorized assessment fees to be used for: (a) The acquisition, construction or maintenance of parking facilities for the benefit of the area. (b) Decoration of any public place in the area. (c) Promotion of public events which are to take place on or in 6 -1t1 - 1 - I'~~:: 1 --- -i ~ (c) promotion of pUblic events which are to take place on or in public places in the area. (d) Furnishing of music in any public place in the area. (e) The general promotion of retail trade activities in the area. Budget/Fiscal Impact No change in the assessment levies is proposed at this time. Recommendation It is recommended that the City Attorney be directed to amend Ordinances to allow assessment fee proceeds to be utilized for those purposes provided for in the state enabling legislation.
