INTRODUCTION This report recommends that the city Council extend by resolution the time period for exercising the certificate of Appropriateness permitting the demolition of the existing Arcade Building and the construction of a new Arcade Building on the same site at 350 Santa Monica Pier. Pursuant to section 9612I of the Landmarks Ordinance, the approved Certificate of Appropriateness will expire on October 9, 1990 if it is not extended by the city Council. The city Council Resolution is contained in Attachment A. BACKGROUND The Landmarks commission approved the subject certificate of Appropriateness permit on April 12, 1990. As stipulated in the Landmarks Ordinance, this approval expires within 180 days unless the authorized work has begun. Due to the length of time needed to obtain the required approvals from the City as well as from the Coastal commission, the Pier Restoration Corporation (PRe) must begin permit processing far in advance of when they - 1 - 6 -k OCT " 1090 ~ 1...._. ~ - - ~ - " . anticipate commencing construction. In addition, the PRC has been unable to begin work during the summer season when the pier was most actively used. For these reasons, they have been unable to utilize the permit within the 180 days. These issues were presented to the Landmarks Commission at their April 12th meeting. The Commission, at that time, recommended that the City council extend the Certificate approval by resolution for the maximum permitted 180 days if it appeared the approval would expire. As stated in section 9620 of the Landmarks Ordinance, certificate of Appropriateness approvals may only be extended by city Council resolution upon a recommendation of the Landmarks Commission. BUDGET/FINANCIAL IMPACT The recommendation presented in this report does not have any budget or fiscal impact. RECOMMENDATION It is respectfully recommended that the Council extend by resolution this Certificate of Appropriateness permit for the maximum permitted 180 additional days. RESOLUTION NO.Bloa (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA EXTENDING THE TIME PERIOD FOR EXERCISING A CERTIFICATE OF APPROPRIATNESS PERMITING THE CONSTRUCTION OF A NEW ARCADE BUILDING TO BE LOCATED AT 350 SANTA MONICA PIER WHEREAS, a certificate of Appropriateness application was filed requesting the demolition of the existing Arcade Building and the construction of a new Arcade Building on the Santa Monica Pier on March 20, 1990; WHEREAS, the Landmarks Commission, following a public hearing, approved the requested certificate of Appropriateness on April 12, 1990; WHEREAS, pursuant to Santa Monica Municipal Code Section 96121, this certificate of Appropriateness shall expire if the work authorized in not commenced within 180 days of the approval; WHEREAS, this certificate of Appropriateness shall expire on October 9, 1990 unless otherwise extended; WHEREAS, the Landmarks Commission has recommeded that the City Council adopt a resolution extending this certificate of Appropriatness for the maximum permitted 180 days. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: - 1 - .. + SECTION 1. The City council has reviewed the Landmarks Commission's recommedation and extends this certificate of Appropriateness permit for an additional 180 days. SECTION 3.
