Introduction This report requests the City Council direct the city Attorney to draft an ordinance which allows the Director of General Services to require more frequent collection, up to and including six day per week collection, of refuse generated by certain businesses within the City of Santa Monica. Background section 5215 (SMMC) of the Santa Monica Municipal code states that the frequency of collection of refuse shall not be changed without a resolution from City Council. Currently, the city provides a minimum of two times per week service to all customers, both residential and commercial. Customers with larger volumes of refuse have the option of requesting more frequent service from the City (typically six days per week Monday through Saturday service.) Businesses within the city have the option of using the City solid waste service or private service. There are no existing 6-.r - 1 - l _ Cl0 requirements for frequency of service for businesses contracting with private refuse companies. with the increase in the number of restaurants in the city there have been an increasing number of complaints of foul odors emanating from and putrid food waste being accumulated in the refuse containers of restaurants that do not have daily refuse collection. The odors of putrefied food wastes is the result of this waste remaining in the refuse containers several days between collections. Therefore, staff recommends that an ordinance be prepared that will allow the Director of General Services to require a minimum of up to six days per week refuse service when the Director determines that it is in the best interest of the community. This ordinance would apply to businesses using City services as well as those businesses contracting with private refuse haulers. Budget/Financial Impact Staff estimates that less than fifty business will be affected by this ordinance. For each affected business, refuse charges could increase a maximum of three fold in the case of restaurant using city service at the current minimum service frequency of two times per week. A typical small restaurant with twice per week service using a two cubic yard bin currently pays $74.83 per month. The requirement of a six day per week collection would result in a monthly fee of $224.49. The financial impact on businesses using private service is not known. - 2 - It is likely that all of these fifty businesses will be required to go from twice per week service to six times per week service. Therefore assuming this ordinance becomes effective by January 1, 1990, additional revenues would be generated in the amount of $44,898 (50 accounts times $149.66 additional per month times 6 months) . This additional revenue would be deposited in account number 27-500-441-00000-0150-10000. Recommendation 1. It is recommended that City Council direct the city Attorney to prepare an ordinance that will allow the Director of General Services to require more frequent collection of refuse when necessary to reduce public nuisance. 2. It is recommended that budgeted revenues at account number 27-500-441-00000-0150-10000 be increased by $44,898 to reflect the increased fees generated by this ordinance.
