I!:190 FROM: city Staff SUBJECT: Proposed Ordinance for First Reading Modifying the R2 and R3 District Boundaries in the North of Wilshire Neighborhood. BACKGROUND On September 18, as part of implementation of the North of Wilshire rezoning, the Council introduced for adoption a revised Interim Districting Map. The Interim Districting Map approved by Council reflects the boundaries for the new R2 and R3 District as proposed by the North of Wilshire residents. These boundaries result in the downzoning of some R4 parcels to R2 in the area bounded by Fourth Court to the west, Seventh Street to the east Wilshire Boulevard to the south and California Avenue to the north. It is not clear if the Council intended to downzone those parcels to R2. If the Council intended to downzone all R4 parcels to R3, and all R3 parcels to R2, then adoption of a revised Interim Districting Map is necessary. If not, the Interim Districting Map introduced by Council is appropriate. A revised Interim Districting Map and Ordinance have been prepared in the event the Council determines it wanted to change all R4 to R3 and decides to modify the R3 and R2 District - I - I~ OCT :: 3 1990 Qr- \.AI J -J r: J,~..-: ~. rJ;lv - boundaries. In order to facilitate implementation of the North of Wilshire development controls in a timely manner, staff recommends the Council proceed with the second reading of the original ordinance and map, and if the boundaries are to be modified, adopt for first reading the revised Interim Districting Map. This procedure will enable the new zoning to take effect without delay. RECOMMENDATION Should the Council decide to modify the proposed R2 and R3 District boundaries, staff recommends adoption for first reading the attached ordinance and Interim Districting Map. Prepared By: Paul Berlant, Director of Planning Suzanne Frick, Principal Planner .~ ~ .- - 2 - SF:Dez Santa Monica, California City council Meeting ORDINANCE NUMBER (City council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA IMPLEMENTING THE COMPREHENSIVE LAND USE AND ZONING ORDINANCE BY AMENDING THE INTERIM DISTRICTING MAP WHEREAS, the City Councll has adopted Ordinance Number 1452 (CCS) establishing a Comprehensive Land Use and Zoning Ordinance~ and \iHEREAS, the city Council has adopted Ordinance Number 1454 (CCS) establishing an interim Official Districting Map pending comprehensive revision of the Official Districting Map; and WHEREAS, the City Council has amended the Comprehensive Land Use and Zoning Ordinance by adding the following new district that is not contained in the interim Official Districting Map of the city: NW-North of Wilshire Overlay District, which is bounded by Ocean Avenue on the west, Montana Avenue on the north, 14th street on the east and Wilshire Boulevard on the south; and w~EREAS, the city council has reduced zoning densities in the North of Wilshire Overlay District by downzoning the R4 District to R3 and the R3 District to R2i and WHEREAS, in order to implement the amendments to the Comprehensive Land Use and Zoning Ordinance it is necessary to - 1 - designate properties subject to the new district classifications pending adoption of a new Districting Map for the City; and WHEREAS, this ordinance is necessary to ensure that the Comprehensive Land Use and Zoning Ordinance is consistent with the General Plan; and WHEREAS, pursuant to the city's constitutional authority as a charter city, the City Council waives any procedural requirement that normally would apply to changes to the Districting Map of the city~ and WHEREAS, the City Council finds that this Ordinance is necessary to preserve the public health, safety, and welfare so that development will be consistent with the General Plan, NOW I THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. section 2 of Ordinance Number 1454 (CCS) is amended to read as follows: SECTION 2. Pending adoption of a new Official Districting Map of the City, the Official Districting Map of the City in effect on July 26, 1988, is revised as set forth in Exhibit "A." SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid - 2 - or unconstitutional by a decision of any court of any competer. jurisdiction, such decision shall not effect the validity of ti remaining portions of this Ordinance. The City Council here, declares that it would have passed this Ordinance, and each ahu every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from its adoption.
