At the July 2, 1997 Planning Comm~ssion meeting dunng the Publ~c Input portion of the
agenda, Roxanne Auer, representi~g the Hotel Employees & Restaurant Employers Union
Local 814, asked the Planning Commission to agendize a dcscussion at a subsequent
meeting concernmg whether the Administrative Appro~ak should ha~e been granted far
th~s pro~ect She asked tF~e Planning Comm~ssion to cansider w#~ether the p~oposed
reno~ation triggered an intens~#ication of use The Plann~ng Commission took no actEOn
concerning #hEs request and on August 6, 1997 following a public hearing acted on the
conditional use permit to al4vw alcohol service at the hatel which is the sub~ect of the
appeals contained in this staff report

The proposaE is an a~plicatian far a Conditional Use Permit to al[ow Type-47 (On-Sale
General Eating Place), Type-66 (Controlled Access) and Type-68 ~Portable Bar} alcohol
licenses to be ~ssued in con~unctian w~th the operation af an ex~sting hoteE located at 191 ~
Ocean Avenue The Conditional Use Permit would allow the hotel to serve alcohol within
public areas including the lounge artd bar (2,830 s f-'~ 10 seats including 30 bar seats~,
and dir~Eng room (3,360 s f-90 seats) areas located on the th~rd floor at~d to persons
attending private functions m the meetmg, banquet and ballroom facilities on the first and
second floors (7,240 s f-350 seats) Alcohol would also be a~ailable in all 129 guest
rooms from controlled access liquor cabmets and fram room service, and to guests at the
pool deck (2,500 s f~ on the fourth floor Faod would be available m the meet~ng, ba~quet
and ballroom facilities, dming room, ba~ and lounge area, the area of #he pool deck and

through room serv~ce from a kitchen located on the third floor The proposed addition of
aloohol sales and serv~ce as ar~ availabie beverage at the hotel ~s considered an incidental
component of typical hotel operations and as such does not intensify existing hotel
operations and t~erefore is a permitted use sub~ect to approval of a Conditional Use
Permit
A CUP is a discretionary permit approved by the Planrnng Comm~ssion follow~ng a properfy
noticed public hearing Unk~ke an Admmistrati~e A~proval, t~e appro~al of a CUP may
contain conditions imposed by the Commissian The deas~on of the Plann~ng Commission
is appealable to the City Councif (n approving a CUP for the sale af afcoholic beverages,

not adversely affect the welfare of neEghborhood res~dents in a significant manner, that the

Parkina and Circulation
The existing hotel is a legal, non-conforming land use and, as such, no on-site parkrng is
requ~red for the reno~ation and the addition of a~cohol service However, the proposed
127-car parking lot located at 1828 Ocean A~enue wou~d be a~aifabfe for em~loyees,
guests, ar~d ~isitors to the hotel Nmety (90} parkang spaces are aEso prov~ded w~thir~ the
Sh~tters-0n t~e-Beach Hotel parking structure under an agreement with Pritikin that was
required as a cond~t~on of approval for the Shutters pro~ect to repface parkmg once used
by Pritikin that was eliminat~d for the construction of the hotel Additionally, as a condition
of approval by the Plannmg Commiss~on, the applicant is required to establash a valet
parking operation for the hotel which is sub~ect to the review and approvaf of the Director
of Planning and Community De~elopment
Planrnna Comm~ss~on Action
At its August 6, 1997 meeting, the Planning Commiss~on conducted a public hearing and
re~iewed the GUP application required far the issuance of the proposed afcahol licenses
at the existing hotef The Commissaon discussed the status of the property as an ex~st~ng
ho#el and the Administrati~e Appro~al issued for the renovatior~ After expressing support
for the pro}ect, the Commission approved t}~e CUP with the fndmgs and conditions
contained m#he staff report with an added conditior~ that prior to the ~ssuance of a buElding
permit, tF~e app~~cant shall subm~t for City approval a park~r~g and circulation plan for the
valet parkmg aperation at the hotel 1n approvmg the CUP, the Plar~ning Commission

found that the issuance of alcohof f~censes at the exfsting hotel was compatib[e with the
existing and permitted land uses at the site and withm the zoning district a~d related
harmon~ously to the surrour~dEng ne~ghborhood as the area is characterized by a mix of
visitor-servmg commeraal ar~d residential uses The Gommission also found that the
Essuance of alcohol I~censes would not impair the ~ntegrity of the neighborhood and was
not detrimental to the public mteres#, health, safety or general welfare m that the alcohol
ser~ice wrll not mtensify the exastmg hotel use and w~li be offered entirely wEthin the
building premises The Planning Commission minutes are conta:ned in Attachment E
APPEALS
Two appeals have been filed for the alcohol CUP This sectior~ of the report outlmes the
key issues of each appeal

The appeal is based on the appellant's content~on that °the hotef for which the alcohol
licenses are bemg sought thraugh the Conditiona! Use Perm~t application is a new ~Ilegal
hotel, and therefore a VEOlation of Prop S" as stated m the attached appeal form
(Attachment A) Tf~e appellant is questionkr~g the sub~ect property's status as an existing
hotel
The Administrative Appro~al that was issued for the renovation m October 1996 examEr~ed
the existing uses at the site, the proposed p~'o~ect and the proposed renovat~on The
~
Zoning Administrator faund that, cons~stent with Zornng Ordmance de~~nit~ons, the property
has been in contmuous use as a hotel since the 1920's Building permits for the site
datmg from 1952-1968 identify the property as a hotel, prior planning permits identify the
use as a hotel and the bus~ness l~cense for the existmg use descnbes the use as a hotef
The proposed building ~enovat~or~ was found to be in compliance w~th Zonmg Ordinance
standards for legal, non-conforming buildangs and uses
The appeiiant is challenging the iegal~ty of the hotel use Howe~er, s~nce #his
determmation was made throug~ the Admmistra#ave Appro~al, the proper avenue to
address the status of the property as an existing hotel ~s through a re~ocation procedure

the legal non-cor~forming use of the s~te as defined in Sect~o~ 9 04 18 030(f) (SMMC) as
a char~ge in mode or character of operat~on ~ncluding but not limited to " extended hours
o~ operation, substantial remodeling or a change in the number flf seats or serv~c~ area
floor space for bars and restaurar~ts"

hours of loading and unload~ng of goods to mitigate any ad~erse impacts on nearby
residences including the residential uses iocated d~rectly across the street from the pro~ect

at 1828 Ocean A~enue Th~s parkir~g lot was approved under CUP 97-008, which ~s a
separate application and t~e subject of a separate appeal before the City Council this
e~ening

existing hotel and does not m~ol~e any expansion af the hatei beyond what is existmg on
the s~te

Notice of the public hearFng has been sent to the owners and occupants of property within
a 500' rad~us of the subJect property and been published in the Q~tlook at least ten days
prior ta the date of the Co~ancil ~ear~~g (Attachment H)
BUDGETIFINANClAL IMPACT
The recomme~dation presented in this report does not ha~e any t~udget or fiscal impacts
The issues raised by the appellants primarily re~ol~e around the legality ot the hotel m
I~gh# of Proposition S, the lack af public process for the hotel pro~ect and the ~ntens~ficatian
of use of the property through the issuance of alcohal licenses The sub~ect property has
been a hotel m continuous operation for mar~y years, pre-datEng the approva~ of

Proposition S, and ~s considered, therefore, a legal, non~orrform~ng use An Administrative
Appro~al for the remodeling of the hote! was issued in October, 1996 and, as a manisteria!
permit, required no notification or public hearing The sales and service of alcohol is a
common, incidental component of hotel operations and does not const~tute an
intens~fication of a legal, non-conforming use which is defined ~n Sec#~an 9 04 18 Q30(f}
(SMMC} as a change m mode or charact~r of operatior~ mcluding but not limited to ~
extended hours of operation, substantial remodeling or a change in the number of seats
or service area floor space for bars and restaurants"
STAFF RECOMMENDATION
It is recommended that the City Council deny the appeals and appfo~e CUP 97-003 based
upon the follow~ng fmdmgs and condit~ons
CONDITIONAL USE PERMIT FINDINGS
The proposed use is one conditionally permitted with~n the su~~ect district and
compl~es with all af the applicable pro~isions of the "City of Santa Mor~ica
Comprehensive Land Use and Zor~ing Ordinance", in that the proposed sale of
alcoholic be~erages m connection w~th t~e hotel restaurant, lounge and bar, private
fur~ction rooms, pool area, guest rooms and room service ~s condi#ianally permitted
p~rsuant to SMMC Section 9 04 10 18 030

whic~ it is to be estabiished or located, in that the area ~s characterized by a mix of

cited the criter~a as incfucf~ng researching the pri~r uses of the
property, the focatfon (v~ihich is in the R-4 Beach Overlay zone),
researching the building permits, ~the bus~ness license records, the
overaEl history of the site, and pre~~ous Planning D~vis~on actions She
stated that based on the e~idence, the s~t~ has b~en ~s~d as a hotel
and club since it was built and was a hotef use when Praposition S
was apPro~ed by the voters ~n 1990
Chair Zrnner asl<ed about an issue ra~sed regarding coifection of the
hotel occupancy tax. Ms ~r~clc stated that while th~s tax has not been
calfected through some ov~rsight ~n the Business Lfcense Di~ision, the
Ciry ~s woric~ng on an agreement for the calfectiort of the back taxes.

the ~ntensity of use for th~ ~ro~erty Deputy Crty Attom~y Strobel
stated the proposal fs not interpreted as an intensificatian

has no concerns regarding the Zoning AdmEnistratnr fi~ndings.
Commissioner Moench asked if the AA ~s relevar~t to the CUP
application. Chair Zinner stated ~t is only relevant if someone wishes to
agendize ~t for discuss~on at a Eater date
Commfssioner Moench asked if the CUP application for alcohol is
indepencfent of the AA appro~al. Staff responded in the affirma~~~e.
Commissianer Werem~uk stated #hat she has no problem with the
issu~s regardEng the AA and she does not wan# the tapic agendized for
later discussEOn. She stated that she i5 pleased w~th the work being
done on this pra~ect and the effort ta save the h~storic br~ck building.
She also stated that there are no good arguments against grant~ng tne
alcohol CUP She asked abaut the requirement far fQOd serv~ce
a~ailab~lity when alcohol is be~ng ser~ed Mr Mart~n stated that foad
service must be available during the hours of alcohol ser~ice, whic~ is

I wauld IEke to comment on the above pro1ect and br~ng seve~al cor~cerns and
questions to your attentEOn Th~se ~ssues became apparent after 1 saw a recent
presentatian by the Edward Thomas Company at the South Beach Ne~ghborhood
Watch meet~r~g on Jur~e 18 i rea~ized many crucEaf aspects were not considered
wh~cf~ w~fl ha~e a direct ~mpact on res~dents ar~d v~stors to the area
The restoration aspects af the prolect are very exc~t~ng If there cauld only be
one hotel on t~e beach this a~e would be my choice Howe~er, there are questions
which anse as to ~arking ar~d traffic ci~cUlation wh~ch sho~ld be addressed pr~or to the
Ess~ance of an alcohol f~cense at th~s s~te As a ne~gY~bor who l~~es ad~acent to the
parkmg fot these are my concerr~s
1) What plannmg estimates have been done #o ensure that adequate park~ng
wGll be aWailable'~ This hote~ mcludes plans for 130 rooms,a 7~ sea# restaurant,
lounge, meeting rooms and ballroom facilities What arrangements w~lE be made to
~nclude space for employee park~r~g~ As you know there ~s little space m the area #or
street park~ng
2~ As there is a`no stoppmg' zone and little s~ace ~n front of t~e Y~otel, how wE4t
space be arranged for ~alet parfcmg '~ DurE~g busy t~m~s at the Shutters Hotel there is
a ~am of wa~t~ng cars on P~co and Appian V11ay and inadequate space for load~ng and
unloading Will same one from #he pfann~ng staff visit this site and expla~n how thrs will
work d~nng week~nds and busy evenings?
3) Where w~El #rucks parK to load and unioad supplies #or the hotel'~ Based on
my experience with the obstruct~or~ of traffic an Appian Way at Shutters, there is the
need for a loading dock that will accomodate se~eraf trucks ~nclud~ng large semi-
trucks
4) Once cars are dropped off with ~alet parkmg in front of the hotel
(sauthbound} ,f~ow wtil~ the traffic flaw to the parkmg I~t on Pieo'~ Keep tn msnci t1~at th~s
area is often congested and blocked w~th traffic during peak hours Will the va~et
parkers ma~ce a U-turn in front of the hote! or ga around the corr~er turning left off P~co~

6) What stud~es ha~e beer~ done to assess how many people firom the general
pubiic uti~ize th~s lot #o park close to the ~each~ Often on busy weekends this fot ~s
almost at capacity and not ut~lized exclus~~ely for Pr~t~k~n park~ng Plann~ng w~ll r~eed ~o
be done ta ~nciude these cars ir~ other pubiic areas Thfs space may nat be adequate
for tk~e needs of hotet guests, v~s~tors and employees so the general publ~c w~1! need
to park ~n ex~stmg lots
Most importantly has someone from the plann~ng staff spent considerable time
abser~a~g th~s locat~on ( as l and many res~dents are forced to do) to see #~ow the
add~tian of a hotel ofi this s~ze and no#oriety w~ll effect the parkmg and trafffc flaw o# this
area'~ Th~s project ~s estEmated to cost approx~mately 50 m~[l~on doHars Dur~ng tha
presenta#~on that I attended,there was no cor~s~deratEOn g~~er~ by #he Edward Thomas
Compar~y to these ~ssUes of traff~c and piann~ng A~tt~ough t~e proJect's traff~c p~anner
had not v~sited the sfte ir~ o~er a year, he feit that the use wauld be the same w~th no
change from the current awne~s at Pr~t~k~n Bas~d or~ th~s IacEc of plann~ng and
understanding of the #raffEC m thES area, I became ~ery cancerned that realist~c
plann~ng had not beer~ done
For that r~ason, ~ am asking you to address the eoncems that I ha~e rafsed m
thas ~etter There w~~! certainly be a ma~or impact on traff~c and park~ng that wEll effect
res~dents and ~~s~tors #o #h~s area Th~ ~ssuar~ce of a I~quor I~cense ar~d the extens~on
ofi the perm~t to the fot at ~ 9~ 0 P~co should be continge,~t a~ ensuring the peace~ui
err~oyment of this area to tne residents
if there were to be one hotel between Pico and the P~e~, t~is pro~ect would
certam~y mer~t f~rst cor~siderat~on Unfortunately there are currently two very large
ho~efs iR operatiar~ and plans for the Macqufre Thomas and Pr~tikm site wa~tEng to
begir~ withm the next few months Mem~er of the Plann~ng Commission and C~ty
Gouncii, how many hote€s are you plannEng to a¢pro~e akvr~g th~s section ~f the
beach~
