A Portion of the Property Located at 2415-2449 Main
street from OP-2 to CM-2
Introduction
At its meeting on August 26, 1997, the city council introduced for
first reading an ordinance amending the Official Dlstricting Map to
rezone 2415-2449 Main Street from OP-2 to CM-2.
The attached
Ordinance is now presented to the city Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying ordinance be
adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING THE OFFICIAL
DISTRICTING MAP TO REZONE A PORTION OF THE
PROPERTY LOCATED AT 2415-2449 MAIN STREET
FROM OP-2 TO CM-2
WHEREAS, an application was filed pursuant to Santa Monica
Municipal Code section 9.04.20.16.010 for an amendment to the
Official Districting Map of the City to change the zoning of a
portion of the property located at 2415-2449 Maln Street from OP-2
to CM-2 (tlproposed Districting Map Amendment) i and
WHEREAS, the Planning Commlssion held a public hearing on the
proposed Districting Map Amendment and made recommendations to the
city council following the hearingi and
WHEREAS, the City Council held a public hearing on the
proposed Districting Map Amendmenti and
WHEREAS, concurrently with the processing of this Proposed
Districting Map Amendment, the City Council lS considering an
amendment to the Land Use Map of the General Plan which, after
adoption, will change the Land Use Designatlon of the Property from

"medlum density residentlal" to "service and specialty commercial;
and
WHEREAS, the City council flnds and declares that the proposed
Districting Map Amendment is consistent ln principle with the
goals, objectives, pOllcies, land uses, and programs specified in
the adopted General Plan, In that the CM2 zonlng designatlon will
allow contlnuation of a neighborhood commercial area which serves
the needs of area residents. Land Use Element Plan Principles
encourage the retention and protectlon of such nelghborhood serving
commercial areas. Further, the Land Use Element found that a
cohesive and well functioning nelghborhood can be encouraged by
ensurlng that the day to day needs of residents are provided by
nearby shops withln walking distance; and
WHEREAS, the publlC health, safety, and general welfare
require the adoption of the Distrlctlng Map Amendment in that the
proposed zone change from OP2 to CM2 ensures protection of needed
commercial services and actlvltles that have been provlded at this
location since 1908. Such commerclal serVlces benefit the
surrounding neighborhood and region by providing leisure time
opportunities, places of employment, and daily necessities while
continuing to allow for the lnclusion of residential uses,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:

SECTION 1. The Official Districtlng Map of the City is that
set forth in Exhibit UA.U
SECTION 2. Any provision of the Santa Monica Municipal Code or
appendices thereto, inconsistent with the provisions of this
Ordinance. to the extent of such inconsistencies and no further,
are hereby repealed or modifled to that extent necessary to effect
the provisions of this Ordlnance.
SECTION 3. If any section, subsection, sentence, clause, or
phrase of this ordlnance is for any reason held to be invalid or
unconsti tutional by a declslon of any court of any competent
jurlsdlctlon, such decls10n shall not affect the validity of the
remaining portlons of this Ordlnance. The Clty Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional wlthout regard to whether any portion
of the Ordinance would be subsequently declared invalid or
unconstitutional.

SECTION 4.
The Mayor shall sign and the Clty Clerk shall
attest to the passage of th1s Ordinance.
The City Clerk shall
cause the same to be published once In the official newspaper
wi thin 15 days after 1 ts adoptlon.
This Ordinance shall he
effective 30 days from its adoption.
