SUBJECT RecommendatIon to Form an Assessment District for the Annual Street
Resurfacing Program and Appurtenant Work and Set Public Hearings for
November 11, 1997 and November 25, 1997
IntroductIon
This report recommends that the City Council approve the formation of an assessment
district for repairing concrete curbs, dnveways, and sIdewalks, for resurfacing streets, for
restonng parkways, for constructing concrete gutters, for reconstructing alleys, and for
completmg the appurtenant work These Improvements are to be performed In fulfillment
of the FY 1996-97 Annual Street ResurfaCing Program at various commerCial, mdustnal,
and reSidential locations The report also recommends that the City CouncIl adopt the
attached Resolution of Intention to set public heanngs In conformance With the Right to
Vote on Taxes Act (Proposition 218) for November 11, 1997 and November 25, 1997, at
which the City declares Its intention to assess property owners for constructIon costs, count
property owner ballots, and hear protests regarding the proposed work
Background
The FY 1996-97 Annual Street ResurfaCing Program Includes gutter construction, street
resurfacIng, alley Improvements, slurry sealmg, parkway pavement removal, curb ramp
construction. curb and gutter repairs, bus pad construction, and Sidewalk and dnveway

repair and constructIon at various locations In the City The crltena used to determine the
streets and alleys mcluded m this year's program and the method of repaIr Include age,
drainage problems, surface and subsurface conditions, complaints received, type of use
(I e , commercial or resIdential), current traffic volume, and projected change of use or
traffic volume
Bids for the construction of thiS project were received on January 21, 1997 Damon
Construction Company was awarded thiS project by City Council on February 25, 1997
The contractor was authonzed to proceed With the non-assessment portIon of the project
until the new Right to Vote on Taxes Act (ProposItion 218) assessment dlstnct process was
resolved The non-assessment related portion of the work IS complete and the contractor
IS currently awaiting authOrizatIon to proceed With the remammg work
In accordance With the Right to Vote on Taxes Act (PropOSItion 218), an Engineer's Report
was prepared which determined the general and special benefits of each speCific proposed
Improvement General benefits enhance the public as a whole, while special benefits
enhance a partIcular parcel A copy of thIS report IS available In the offIce of the City
Engineer According to the Right to Vote on Taxes Act (Proposition 218), parcels may only
be assessed for special benefits
ThiS report recommends that parcels be assessed for only 50% of the special benefit cost
of the proposed Improvements determined by the Engmeer's Report The recommended

reduction In assessment charges IS In consideration of the burdens on properties caused
by the Northrrdge earthquake and the hIgh policy priority whIch has been assIgned to
Infrastructure repaIr and mamtenance by the City Council as a significant community
benefit It IS recommended that street resurfacing and alley reconstruction assessments
for resIdential properties be waived to be consistent With long-standing City policy
Consistent With recent City policy, assessments will also be waived for non-profit
organizations whIch can prOVide eVidence of receiving a welfare exemption from the Los
Angeles County Tax Assessor
Notices of the City'S mtent to form an assessment dlstnct and hold a public heanng will be
mailed to affected property owners at least forty five (45) days in advance of the lime and
place of the public heanng In accordance With State law In addition to the notIce, property
owners will be sent a ballot by whIch they may vote for or against the assessment Ballots
may be mailed to the City Clerk or submitted In person before the end of the first public
hearing Ballots will be tallied proportional to the financial obligation of the affected
property The results of the ballot tally Will be presented to City Council at the second
public hearing If a maJonty protest eXists (50% + 1 negative vote), the assessments Will
not be Imposed If there IS a majority protest, staff Will return to the City Council at a
subsequent meeting With an analYSIS and recommendatIons as to whether thiS work can
proceed In the absence of assessment finanCing
These proceedings shall be conducted In accordance With the Right to Vote on Taxes Act
(Proposition 218) and the MUniCipal Improvement Act of 1913 (Callforma Streets and

Highways Code DIvIsion 12) A list of property owners and the assessment map will be
available to the City Council at the time of the public hearing
Payment Options
Property owners paYing for street resurfacing, alley reconstruction, gutter, curb, parkway
and sIdewalk reconstructIon wIll have the option of making a cash payment wIthin 30 days
or Installment payments plus Interest The terms of the Installment payment plan shall be
determined at the time staff returns to council to confirm costs

The unit costs are set by the Supermtendent of Streets, and are periodically updated to
reflect actual costs They Include staff time In conductmg englneenng surveys, postmg and
maIling of notices, construction management, mspectlon and construction The street
resurfacmg assessment IS calculated so that non-residential property owners pay the same
respective Unit cost regardless of the width of the street affecting their property
Corner lots are assessed either 50% or 100% of the proposed assessment share
dependmg on legal address Owners of corner lots where the legal address IS the street
berng reparred pay 100% of applIcable repaIr work If the legal address IS the adjacent
street, the property owner pays 50% Corner lots have the potential of being assessed for
both SIdes of thelr lot If both streets are Improved ThiS polley eases the Impact on corner
lots by assessing 100% on one street and 50% on the cross street
The assessment amounts were spread to all properties m the district based upon the
proportIon of the speCial benefit realized Any amount waived Will be financed through CIty
funds not the remaining properties In the assessment dlstnct CIty funding for thiS project
totals $2.570,731 23 and the assessments total $329,119 77

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA TO SET PUBLIC HEARINGS ON NOVEMBER 11, 1997,
AND NOVEMBER 25, 1997 FOR THE PURPOSE OF DETERMINING
WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY
REQUIRE THE CONSTRUCTION OF CONCRETE GUTTERS, ALLEY
IMPROVEMENTS, STREET RESURFACING, SIDEWALKS AND
DRIVEWAYS, CURB REPAIRS, RESTORATION OF PARKWAYS, AND
APPURTENANT WORK, IN CONJUNCTION WITH THE FY 1996-97
STREET RESURFACING PROGRAM
WHEREAS, the City Council of the City of Santa Monica proposes to Initiate
proceedings under the Right to Vote on Taxes Act (Proposition 218), the MUnicipal
Improvement Act of 1913, and the Government Code for the construction of concrete
gutters. alley Improvements, street resurfacing, repair of damaged sidewalks, dnveways
and curbs, and the restoratIon of parkways, and
WHEREAS, Section 19 of Article XVI of the Calrfornla Constitution provides that
certain specified debt limitation and maJorrty protest prOVIsions shall not apply If, after the
giVing of reasonable notice by publication and mailing and the holding of a public heanng
as prescnbed by the City CounCil of the City of Santa Monica, the City CounCil, by no less
than fOUf-flfths vote of all of Its members, finds and determines that the public convenrence
and necessity require the proposed Improvements to be made, and

WHEREAS. Streets and Highways Code Section 2804 provides that the "Special
Assessment. Investigation, limitation and MaJonty Protest Act of 1931" shall not apply to
any proceeding otherwise subject thereto when the Improvement proceeding IS by a
charter city and the City has complied with the provIsions of Section 19 of Article XV] of the
California ConstitutIon, and
WHEREAS, the City of Santa MOnica IS a Charter City of the State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOllOWS
SECTION 1 The City Council proposes to Initiate proceedmgs for the construction
of concrete gutters, alley Improvements, street resurfacing, repair of damaged Sidewalks,
driveways and curbs, restoration of parkways, and appurtenant work adjacent to
residential. and non-residential properties on CIty streets as follows

SECTION 3 The Improvements and repairs shall be conducted pursuant to the
Municipal Improvement Act of 1913, which IS contamed In DIvIsion 12 of the Streets and
Highways Code of the State of CalJforma and the Right to Vote on Taxes Act (Proposition
218)
SECTION 4 The crltena used to determine which streets are to be resurfaced and
the method of repair Include age, surface and subsurface conditions, complamts received,
type of use (I e . commercial. Industnal or residential), current traffic volume, and projected
change of use or traffic volume The proposed work or Improvements In the opinion of the
City Council of the City of Santa MOnica are of more than local or ordrnary public benefit.

SECTION 5 Payments on the pnnclpal of unpaId assessments and Interest
shall be made by property owners to the City Treasurer and the same shall be disbursed
by him/her or as provided In the "Municipal Improvement Act of 1913"
SECTION 6 Parcels owned by non-profit organrzatlons which can
demonstrate that the organization receives a welfare exemption from the Los Angeles
County Assessor shall be exempt from this assessment
SECTION 7 Notice IS hereby given that on Tuesday, the 11th day of
November. 1997. and Tuesday, the 25th day of November, 1997, at 6 30 P M I In the City
CounCil Chambers located In City Hall, 1685 Main Street, Santa Monrca, Callfornra, there
shall be public heanngs before the City CounCil for the purpose of deterrmnlng whether
the public convenrence and necessity reqUire the above-descnbed Improvements and for

the purpose of allowing any and all persons having any objections to the proposed work
or Improvements to appear and show cause why the proposed work or Improvements
should not be earned out In accordance With thiS Resolution of Intention Inquiries
concerning the public heanngs should be directed to the Department of Environmental and
PubliC Works Management, DIVISion of Englneenng, at 458-8727
SECTION 8 The City Clerk shall gIve notice of the heanngs by publicatIon
as hereinafter provIded Any Interested person may file a protest against the proposed
work or Improvements In wntlng With the City Clerk at any time not later than the hour set
for the fIrst public heanng m the manner set forth In the Streets and HIghways Code
SectIon 5220 Property owners may also vote on the assessment district by submitting
ballots before the close of the first public heanng
SECTION 9 CIty Staff IS directed to mall notices of the adoption of thIS
Resolution and ballots, pursuant to Government Code Section 549546, to all persons
ownmg property In the assessment dIstrict deSCribed above, whose names and addresses
appear on the last equalized assessment roll for the City taxes or as known to the office
of the City Engineer
SECTION 10 The City Clerk IS directed to publish thiS Resolution, m
accordance With Government Code Section 6066, In The Outlook once a week for two
weeks With at least five days mtervenlng between the first date and second date of

SECTION 11
Pursuant to Public Contract Code Section 20433, the City
Council hereby finds that It IS not In the public Interest to allow property owners to contract
for the street resurfacing r alley Improvements, and gutter construction and thereby the City
shall be responsible for awarding and admlnlsterlng the construction contract for this
dIstrict
SECTION 12 The City Clerk shall certify to the adoption of this Resolution,
and thereafter the same shall be In full force and effect
