SUBJECT Resolution AuthOriZing Acceptance of a One-Time Grant from the California
Department of JustIce for Domestic Violence Prosecution Programs and
Associated Budget Changes
Introduction
The California Department of Justice operates the Spousal Abuser Prosecution Program
through which the State disburses funds to local entities for the purpose of enhancing
domestic Violence prosecutions The Santa MOnica City Attorney's Office has received
Fifteen Thousand Dollars ($15,000) from the State for thiS purpose AuthOrization to
accept and utilize these funds for grant-eligible purposes IS requested
DISCUSSion
The City Attorney's Office has actively prosecuted domestic violence cases and related
crimes for many years In the last couple of years. the resources committed to thiS growing
and challengrng area of prosecutonal work have been Increased At present, one
expenenced prosecutor works full time on thiS case load That prosecutor takes a high
percentage of the cases to tnal, and has achJeved noteworthy success However, a
number of months ago, It became apparent that additional part-time assistance from a law

clerk and an Investigator would significantly enhance our ability to prosecute domestic
violence cases by allowing the prosecutor to focus his time on tnal work, rather than on
research or Investigation Shortly after that need was Identified, we learned that the State
of California was disburSing funds. through an expedited process, for the purpose of
enhancing domestic Violence prosecution programs
The City Attorney's Office submItted a wntten request to the State for $15,000 to be used
to acquire part-time, temporary assistance from a law clerk or an Investigator and the State
granted the funds
The accompanYing resolution authOrizes acceptance of the $15,000 grant from the
California Department of Justice These funds will be used generally to enhance the
prosecution of cnmes related to domestic Violence, and specifically to research a number
of Issues which recur In domestic Violence cases These funds cannot be used to meet
ongomg costs
Budget Impact
The $15,000 In grant funds has been received The following budget changes are now
needed to provide budget authonty for the recognition of such funds as revenue and for
expenditure of the funds
· Approve a $15,000 budget m Revenue Account No 20-130-224-00000-0608-

· Approve a $15,000 FY 1997-98 appropriation In City Attorney's Office Operating
Budget Account No 01-140-231-83504-1150-00000,
· For FY 1997-98, Increase the budgeted number of Temporary Employees for the
City Attorney's Office by 0 7 FTE, to provide spousal abuser prosecution program
support staffing on an as-needed basIs
· Approve the following Non-Departmentalllnterfund Transactions budget changes to
provide for reimbursement of the General Fund by the MIscellaneous Grants Fund
for grant-eligible expenses

No other budget Impacts are anticipated
RECOMMENDATION
Staff recommends that the City Council
1 Adopt the attached resolution authorizing acceptance of the $15,000 In Spousal
Abuser Prosecution Program grant funds from the California Department of Justice
and dedicating said funds to enhanced spousal abuser prosecution efforts
2 Approve the above budget changes

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AUTHORIZING THE ACCEPTANCE OF A ONE TIME GRANT
FROM THE CALIFORNIA DEPARTMENT OF JUSTICE FOR DOMESTIC
VIOLENCE PROSECUTION
WHEREAS, the CIty Attorney's Office actively prosecutes crimes Involving domestic
vIolence, and
WHEREAS, the effective prosecutIon of these Crimes requires a substantial
commitment of time and resources, and
WHEREAS, the State of CalifornIa, Department of JustIce, has a Spousal Abuser
Prosecution Program through which It provides grants to local prosecutonal agencies to
be used to enhance the prosecution of domestIc violence cnmes, and
WHEREAS, the CIty Attorney's Office has applIed for and has been awarded a one-
time grant In the amount of Fifteen Thousand Dollars ($15,000 00) from the Department
of Justice,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS

SECTION 1 The acceptance of a one-tIme grant from the Spousal Abuser
Prosecution Program of the California Department of JustIce In the amount of FIfteen
Thousand Dollars ($15,OOO 00) IS hereby approved
SECTION 2 The CIty Clerk shall certIfy to the adoption of this Resolution, and
thenceforth and thereafter the same shalt be In full force and effect
