demolished, the Pr~t,k~n ~ongevfty Center, which is lacated on a separate parcel
approx~mately or~~ block away at 1910 ~cean Avenue, began to use the site for
automabile parfc~ng lay ~ts employees and v~s~tors No planr~fng appra~al was obta~ned
prior ta the cflmmer~cement of thfs use. The Planning Commiss~on subsequently
appro~ed CUP 94-012 to ~Ilaw f~r the de~elopment of the parEc~ng fot. The CUP was
due to exp~re m May, 1997, ~owe~er, prror to that date the applicant filed ~he subject
rec~uest to extend the CUP term for e.ghteen f18{ months

At ihe August 6, 1997 heanng, th~ Plann~ng Cammission rev~ewed the CUP
application requ~red for the developr~ent of tl~e sub~ect s~#e as a parking lot. The
Commissiot~ discussed the applicatio~, ~~ ~articular Condition #28 which requires, in
part, that the employees of the appl~cant's business located at 1910 Ocean Avenue
bs charged far parl<ing in the sub~ect lot as part of the bus~ness's compl~ance w~th the
City's transpartation demand management requ~rements. The CommESSion debated
this aspect of Canditian #28 and a~ternatives that m~ght be implemented, but voted
to reta~n the requ~rem~nt The appef[ant has chall~nged th~s requ~rement and two
other aspects of this cand~tion The Planning Comrnission minutes are contained in
Attachment C
APPEAL ANALYSIS
The appeiiant ~s a~pealing ~hree aspects af Condition #28. the requirement that the
applieant`s employees at 191~ Oc~an Avenue be charged for parlung at the proposed
parlc~ng lot; the reqwrement that the applicant prav~de and ma~ntain a secure area to
store a min~mum of twenty-f~ve {25) bicycles ~n the proposed park~ng lot, and the
requ~rement that the app'~cant ~ro~~de showers for its employees who commute by
bicycle The appellant mainta~ns that thes~ candit~ons are unfaEr to the empl~yees
and are not an ~ffective methad to m.t~gate parlung demand. The appEllar~t suggests
that these cond~tions b~ remo~ed ard re~laced ~~v~th a condrt~on that the devEloper
of the hotel at 1910 Ocean Avenue subsidize em~loyees' publrc transport~tiori costs.

for the operat~on of the pr~posed parlung lot
26. The applicant shall s~bmit deta,~ecf fence plans whrch demonsirate that fence
heights are consistent ~avith Ad~ustr~~ent 95-002 appraved ~ Q/25195 and, per
tF~e applicant's req~iest, ~xtended by the Zoning Administrator pursuant to
SMMC Sect~on 9 p4 20 34 080{b) unt~l November 8, 1997.
27 The appl~cant shali comply ti~,~ith the Archrtectural Rev~ew Board approval wf~ich
caref~lly examined the treatme~t of the pro~ect s~te's sautheast corner ~at the
intersect~on af Pico Baulevard and Ocean Avenuey as a gateway, and shall
reviewed the landscap~ng along P~ca Soulevard to ensure that ~t ~s cbmp8tible
with the iandscap~ng on the pub~~c rEght of way on Pico Boulevard in the
vic+nrty of the project s~te

d~fin~t~on of a hotel has changed smce 1921 and that clubs of that era
functioned as hotels with overnight accommodat~ons

incfuded the fong term occupancy of rooms througt~ rentals and the

issues regarding the AA and she does not want the top~c agendized for

Background
The subject site formerly conta~ned a restaurant w~th surface parku~g Dunng the
construct~an of the ad~acent Shutters on the Beach Hotel, the site was utilized as a staging
area far the construct~on of tlZe adjacent Shutters on the Beach Hotel. In approximately
1987, after the restaurant had been demalished, the Pritilcm Longevity Center, which ~s
located on a separate parcel approximately one block from 1828 Ocean Avenue, began to
use the site for automobiie parlcing by rts employees and visitars No planning approval
was obtained prior to the commencement of th~s use The applicant is now attempt~ng to
rectif~~ this srtuation by applying for a CUP ta allow a parking lot, as required in the RVC
D~stnct In con~unctian r~th this request, the applicant is propos~ng to restripe the parlang
lat and add landscapmg m comphance vv~th code requtrements

A total of 127 parking spaces are praposed, snclud~~ 52 con~pact spaces and 5

identified in the Local Coastal Plan, including Goal 4 to "assure priorrty far ¢
coastal-dependent and coastal-related development over other development on the
coast," and Goal 6 to "encaurage p~blxc anc~ recreational use and enjoyment of the
coast wlule ensurmg that the very resources that make the coast so valuable for
human en~oyment are not spoiled." It is also consistent w~th Genera! Access Pol~cy
6, encouraging the provision of pazking, and Scenic and Visual Resource Pohcy 48, `
