This report recommer~ds that the ~'~ty Counc~l introduce for f~rst
reading an ord~nar~ce implementing a series of am~ndments to Part
9.~4.~8.~5 of Ax~tyc~e IX of the Santa I~onica Municzpal Code
including Sec~zon 9.09.08.15.020(1} ~o clarify the requarements for
S~dewalk Cafes in the BSC-1 subarea of the Bayszde Commerc~.a1
District (BSC), Section 9.04.08.15.040I2) to a~loT,~ ground floor
office uses in 4he front 75' o~ a parcel with the approval of a
Conditional Use Permit in the BSC-2, BSC-3 and BSC-4 portions of
the BSC distr?ct as shown on the attached Bayside District map
(Attachment A;, Sectlon 9.04.08.15.060(b) to clarify the building
stepback requlrement for build~.ngs in ~~e BSC d~.s~.ric~, and Section
9.04.0$.15.080 to revise the per block limitat=ons on the number of
food uses, alcoho~ outlets and fast foad ~ood courts perm~tted in
the BSC dzs~rict.

Dlstrict and the Cham.ber of Commerce to obtain input on these
issues, an~ thezr recommen~aticrs are ~ncluded in this stafF
report . The prcpcsed amendmen~s werz revie;,red by 4Y~e Plannir_u
Commission at their meet~~g on Jul~~ ~7, i996. Trie Plan~~ng
Commission recomm~nded that the C~.ty ~ouncil adopt t~~e ardinance
arnendments as prapos~d by staf~.
DISCUSSION
Sidewalk Cafes in the B~C-1 Subarea
Due to the fact that al~ food uses ~n ~he BSC district are limited
by the per black allocati~ns contained in Section 9.04.a8.15.080 of
the ordinance, all such ~~ses ar~ l~stec~ as permitted or
conditionally permitted "sub~ect to the l.imitations contai:~ed in
Section 9.04.08.1_5.08~7". Wren tne BSC d~s~rict ard~nance was
drafted, this li~nitat~on was noL included in the secLion t~at

al].ey. Staff had Ox'~g-rial' y r~corimended that offi~e uses in ~'~e
front ?5' o~ a~a~cel not be al~owed in order to encoura~z
pedestrian orie:~ted ases cn the groun~ floor, such as retaii ard
service ~ases. When City Cauncil reviewed the ordinance
establish~ng standards ~or the BSC ~istrict, tney suggested that
perhaps there should be an opport~znity to alloa off~ce uses on tre

The Chamber of Com.rnerce and the Bayside District Corpoxata.an both
cons~dered the issue of ar~ ad~itional fast fcod food cour~ at
meetings with their meme~ersY~iip. While the Chambez di~ not take a
~osition on t'~e 3ss;~e, the Baysid~ District's Board is opposed to
allow~~ag an additional food cour~. Tr~e Bayside Board feels t~at
there are already enough fast food type uses on the Promenade ir_
general and ~n the 1200 blocx spec~fically. atafF contends that
whiie there may be a number ~= ex~sting, free standing fast food
uses ~n the area, since fast food uses are prahibited in rhe
Bayside District except for in a food court, those establishmen~s
are lega2 non-confcr~rzng uses, and over tzme w=~1 be rep~aced w~th
other types of uses. Due to t~is, s~aff feels ~hat it is important
to provzde an opportunity for such uses to locate in the area. Tne
Planning Commission aiso supports ar~ allocation zor a fast fao~

199b the Baard af Directors passed a mouon clanfying its pasiuon on the District-wide
limitatton on faod ana al~ohol serving estab2ishments, ant~ on related matters.
In acvordance with City Council request, the Boa~ considered the meriu of the six {b)
options c~velaped b}~ yaur srat'f and BDC representarives d~ring a rr~et~ng he~d on March
6, 199b, as autlined in the attacf~ed BDC St~ff report. Upan mouon made hy Baard
Member Katz, the Baand unanimously voted to maintain the District-wide limitauon on the
numbcr of restaurants and alcohol serving establishcnent~ esta~lished under Interim
Ordinance 1820, which a~laws seventy six (76) food uses and fifty (50) atcohol uses.
Included in this motion, the Bvard supported maintainuig the per block limitation for
Blocks 4, 5, and b(Pmmenade BIocks), remova3 Qf the per block lu~nitation far the
remaining blocks on Second and Fourth Streets and allow the market place tv establish t~e
actual number of food and alcvhol serving establishrnents on these streets, but in no e~ent
shall the total District-wide number exceed 76 restaurants nor (SQ} alcoho~ servu~g
establishments. For example, within the per block cap established for the Promenade
Blocks, if an a~ailability should anse, this Promenade available restaurant/alcahvl use
could be used on Secand ar Fourth Streets. Also, if a restaurar-t a~d/or alcohal use shauld
become a~ailable frqm Second or Fourth Streets, then this available use could be
transferred to anyone of the Promenade Blocks as long as the respective per block
l~mitation was not exceeded. 4nce again, the limitations using these cxamples would be that
under no circurnstances could the District-wide numbers exceed (76) restaurants nar (50)
a3cohol serving uses. F~rt~errnore, a parncular proj~ct wauld remain subject to ali CUP
and ABC r~quirements noFinally inaposed upon restaurant and alcohot serving nses. An
important featUre of this formuta is that it maintains the current balance v~nthin t~e l3istrict
withauf increasing alcohol uses within the District.
Regarding fast food establishments, aithaUg~ the Board did nat take up this matter, the
Board's position rema~ns in opposiaon to aliowing a Fooci Court on the 120D Block of ttie
Promenade
Qn a related matter the Board passed a motion requesting the City Council ta direct City
Staff to investigate means by which to prevent cwrent and future non-restaurant types of
business from adc~ing as ~ttle as offer~ng coffee and light refreshments as ar~ aneillary use
to the n~ain commercial use, and by doing so vnlize a fuii restaurant use allacation. The
Board feels chat this cuirent opportunity is a loap hole in the Municipal Code that needs
iYnmediate attent~on.

WHEREAS, since th~ adoptior ot the SS~ Dis~rict standaras,
issues have bEen raised related to sidewalk cafes in tne BSC-1
portion af the BSC dzstrict and requz~ed building stepbacks in ~.he
BSC Distr~ct; and
WHEREAS, the P~anr~:~g Cor.uniss~an adaptea a Resalution oT
Intention or~ June 19, ~996, to amend ~he BSC Districu standards;
and
WHEREAS, the Planning Comm~ssion held a p~blic hearing an the
BSC District standards amendments and made recommendat~ons to tne
City Council following *he hearing; and
WHEREAS, the City Council held a public hearing on uhe
amendments ta the BSC D~strict s~andards; and
WHEREAS, ~he City Counci~ finds and declares that the proposed
amendments to the BSC District standards are consistent ir
princ~ple w~th the goals, ob3ectives, policies, land uses, and
programs specif~ed in the adopted General Plan, in that all of the
amendments to the BSC standards are in compliance with the land
uses and development s~.andards allowed in th~ Downtown Commerc~al
District of the Land Use Element of the General Plan, and
WHEREAS, the public health, safety, and general welfare
require the adoption of the groposed amendment in that the
amendments w~~l ensure that ground floor off~ce uses and s~dewalk
cafes are properly regulated, adequate building stepbacks are

in the Passageway Overlay Zone, there shall be no addit~onal
stepback requirement above fifty-s~x (56} feet of building height_
In addition, for parcels one hundred feet (100) or more in depth
measured from Wilsh~re Boulevard, Arizona Avenue, Santa Manica
Soulevard or Braadway (crass streets) any portian of a bu~lding
~levatiox~ fronting on the cross s~reet, above thirty (30} feet in

SECTION 5. Any provision af the Santa Monica Municipal Code
or a.ppendices thereto inconsistent with the provisions of this
Ordinance, to the extent of s~ch inconsistencies and no further,
are he}eby repealed or modified td ~hat extent necessary to e~fect
~he provision of this Ordinance.

SECTION 6. If any section, subsection, sentence, clause, or
phrase of thzs Ordinarc~ zs for any ~easo~ held to be i~valid or
unconstitutional by a dec~sion of any court of competent
~urisd~ction, such decision shall nat affect the validi~y of the
re~a~ni~g portions o- this Ordinance ~he C~ty Ccuncil hereby
declares that it would have passed this Ordinance, and each and
ever~ section, subsectzon, sentence, elause, or phrase no~ declared
inva~id or unconstitutianal without regard to whether any portion
of the Ordinance would be subsequently dec~ared inva~id or
unconstitutional.
SECTI~N 7. The Mayor shaZl s~gn and the City C~erk sha~I
attest to the passage of this Ordinance. The City Clerk shall
cause this ordinance, or a summa~y thereof to be published once in
Che official newspaper withzn 15 days after ~ts adoption This
Ord~nance shall become ~ffective 3a days from ~ts adoption
