SUBJECT: Recommendation To Authorize the city Manager to enter
into an Agreement with the Los Angeles Unified School
District (LAUSD) to require notification and receipt of
CEQA documents for LAUSD projects located in a specified
geographic proximity to Santa Monica
INTRODUCTION
This staff report recommends that the City council authorize the
ci ty Manager to enter into an Agreement W1 th the Los Angeles
Unified School District to specify in what instances the city of
Santa Monica should be notified of proposed LAUSO projects under
the California Environmental Quality Act (CEQA)..
BACKGROUND
Assembly Bill 3108, effective in 1991 made changes to Public
Resources Code section 21104 and 21153 regarding a lead agency's
responsibilities concerning notification of proposed projects under
CEQA to other state and local agencies. In addition to notifying
all agencies which have jurisdiction by law over a proposed
project, the changes require notification to cities and counties
adjacent to the city or county within which the project is located,
unless this requirement is waived by an agreement.

The LAUSD recently notified Santa Monica regarding this requirement
and has asked Santa Monica to consider entering into an agreement
to waive the requirement for projects located beyond a reasonable
distance from Santa Monica's boundaries. In response to this
request, staff worked with representatives from the LAUSD to draft
the attached Agreement which will waive the requirement for
projects located more than a 2-mile radius outside the city of
Santa Monica limits. staff believes that proposed projects which
are located more than two miles outside the City limits will be
unlikely to impact the City of Santa Monica.
BUDGET/FINANCIAL IMPACT
There is no budget or financial impact associated with this
proposed action.
RECOMMENDATION
It is recommended that the city Council authorize the city Manager
to enter into an Agreement between the LAUSD and the City of Santa
Monica to require the receipt of CEQA documents from the LAUSD
which are for projects located within a 2-mile radius outside the
city of Santa Monica's boundaries.

of speclfymg the manner of complIance wIth the reqUIrements of the CalIfornia EnVIronmental
QualIty Act regardmg notIficatIons to adjacent cIl1es and countIes
Pursuant to ~21104 and ~21153 of the PublIc Resources Code, the CIty of Santa MOnIca
agrees that the LA usn need not submIt for revIew envIronmental documents for projects whIch
are not located wIthm the City of Santa MOnIca, except as further outlmed herem
LAUSD agrees that It WIll submtt to the CIty of Santa MOnIca envIronmental documents
for any project located WIthm a two-mIle radIUs outSIde the CIty of Santa MOnIca lImIts or
boundanes.
