BACKGROUND
The Clty Plannlng CommlSSlon approved the Tentative Map and the Ten-
ant-Partlclpatlng ConverSlon for the above proJect on January 11,
1995, after a public hearlng and a careful review of the record and
staff recommendations The actlon of the Plannlng Commlssion was
based on the CommlSS10n's findlngs that the proposed Tenant-
Partlclpatlng Converslon meets the requlrements of Artlcle XX of the
City Charter and that the proposed subdivlsion lS conslstent with
appl:.cable general and specific plans as adopted by the City of
Santa Monlca along wlth all mandatory requlrements of the
Subdlvlslon Map Act of the State of Callfornla
The owners have submltted to the Clty a Written Consent Agreement
bindlng the owners and any successors in interest to each condltion

imposed 10 connectlon with approval of thlS Tenant-Partlclpating
ConverSlon Thls Wrltten Consent has been approved by the City
Attorney and the Clty Manager Each partlclpatlng tenant has been
lnformed in writlng of his or her rights under Article XX of the
Clty Charter The License Divlsion reports that proper arrangements
have been made to ensure payment of the Tenant-Particlpating
Conversion Tax.
The Final Map conforms to the Tentatlve Map. The Flnal Map has been
certifled by the Clty Engineer for conformance with the Ten~ative
Map and conditlons thereont the Subdlvision Map Act and local
ordlnances. The Clty Attorney's offlce has approved a Declaratlon
of Covenants, Conditlons, and Restrictlonst or equlvalent documentt
for this proJect as complying wlth the condltions of the Tentative
Map and the Tenant-Partlcipatlng Converslon.
Counc:Ll approval of a flnal map for a Tenant-Partlcipatlng
ConverSlon represents one of the last steps necessary In the
converSlon process. Following City Councll actlon and approval by
the California Department of Real Estate the appllcants may begln
selling thelr unlts to the tenants. As each unlt lS sold a
conversion tax per Section 2008 of Artlcle XX lS due In an amount
equal to twelve times the monthly maXlmum allowable rent for that
unit These taxes will be used to assist low and moderate lncome
households to purchase or improve thelr unlts subJect to affordable
repayment per Sectlon 2009 of Article XX.

BUDGET/FISCAL IMPACT
The recommendation presented ln this report does not have an lmmedi-
ate budget or flscal lmpact. If and as unlts In the proJect are
sold ln the future, Tenant-Partlclpating Conversion Taxes wlll be
collected pursuant to the prOV1Slons of Artlcle XX of the Clty
Charter and some lncreased property tax revenues may be generated
RECOMMENDATION
It is respectfully recommended that the Final Map for thlS Tenant-
Partlclpatlng Conversion be approved by adoptlon of the accompanying
resolutlon.
