CA:f:\atty\muni\laws\mtt\elect.12 City Council Meeting 7-9-96 Santa Monica, california RESOLUTION NUMBER 9053 (City Council series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 1996 WHEREAS, City Charter Section 1400 provides that a General Municipal Election shall be held on the first Tuesday following the first Monday of November of each even numbered year for the purpose of election of elected officers; and WHEREAS, under the provisions of the City Charter, four members of the City Council shall be elected for a full term of four years; and WHEREAS, under the provisions of the city Charter, two commissioners of the Rent Control Board shall be elected for a full term of four years; and WHEREAS, under the provisions of the city Charter, three members of the Santa Monica-Malibu Unified School District Board of Education shall be elected for a full term of four years; and WHEREAS, under the provisions of Education Code Section 72034 and resolutions adopted by the Board of Trustees of the Santa Monica Community college District, three members of the Santa Monica Community College District Board of Trustees shall be elected for a full term of four years; and WHEREAS, Elections Code section 12107 authorizes the City 1 . . " . , Council to provide that all ballots cast at the General Municipal Election be counted at a central counting place; and WHEREAS, the Education Code and the Elections Code authorize the consolidation of the election of members of the Santa Monica-Malibu Unified School District Board of Education and Santa Monica College District Board of Trustees with .the General Municipal Election; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. A General Municipal Election shall be held in the Ci ty of santa Monica on November 5, 1996, which is the election required for purposes of electing four members of the City Council, two commissioners of the Rent Control Board, three members of the Santa Monica-Malibu Unified School District, and three members of the Santa Monica Community College District Board of Trustees. SECTION 2. The ballots to be used at the General Municipal Election shall be both as to form and matter contained therein such as may be required by law. SECTION 3. The City Clerk is authorized, instructed, and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment, and paraphernalia that may be necessary in order to properly and 2 ! .. lawfully conduct the General Municipal Election. SECTION 4. The polls for the General Municipal Election shall open at 7:00 a.m. on the day of the election and shall remain open continuously until 8:00 p.m. of the same day when the polls shall be closed except as provided in Elections Code Section 14401. SECTION 5. The notice of the time and place of holding of the General Municipal Election is hereby given and the city Clerk is authorized, instructed, and directed to give such further or additional notice of the election in the time, form, and manner required by law. SECTION 6. Pursuant to Elections Code section 12107, the city Clerk is authorized, instructed, and directed to give notice of the central counting place in the time, form, and manner required by law. SECTION 7. An election for members of the Santa Monica-Malibu Unified School District Board of Education and the Santa Monica College District Board of Trustees shall be consolidated with the General Municipal Election. Separate ballots shall be provided for those voters who reside outside the City of Santa Monica pursuant to Elections Code Section 10409. SECTION 8. The City Clerk is directed to send a copy of this 3 . , Resolution to the Board of Supervisors of the County of Los Angeles and to the Registrar of Voters. SECTION 9. In the event the General Municipal Election is consolidated with the statewide General Election on the same date, the provisions of this Resolution, which are applicable only in the event the election is conducted by the CitYI shall be of no force or effect. SECTION 10. The City Clerk shall certify to the adoption of this Resolutionl and thenceforth and thereafter the same shall be in full force and effect. SECTION 2. The Registrar of Voters is hereby authorized to canvass the returns of the General Municipal Election which it is hereby requested to consolidate with the statewide General Election and said election shall be held in all respects as if there were only one election, and only one form of ballot shall be used. SECTION 3. The Board of Supervisors of the County of Los Angeles is hereby requested to issue instructions to the Registrar of Voters to take any and all steps necessary for the holding of the consolidated election. SECTION 4. The City of Santa Monica recognizes that additional costs shall be incurred by the County of Los Angeles by reason of this consolidation and agrees to reimburse the County of Los Angeles for any such costs. 2 . , .j SECTION 5. WHEREAS, in the course of conduct of the election it is necessary for the city Clerk to obtain the services of a professional election supplier; and WHEREAS I all necessary expenses in performing these services shall be paid by the City of Santa Monical NOWI THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE, DECLARE AND ORDER AS FOLLOWS: SECTION 1. That the firm of Martin & Chapman Co., being a sole source, is approved to furnish to the city all necessary services and supplies authorized by the city Clerk to conduct either a concurrent or consolidated election, which include, but are not limited to: - 1 - -~ j 1. Provide a Calendar of Election Events setting out dates and requirements of the Election Code. 2. Provide suggested forms of resolutions and notices required for the election. 3. Provide necessary ballots, supplies and instructlons for voting in the precinct and for absentee voting. 4. Provide Self-Mailer sample Ballot & Voters Pamphlet with candidates statements, measures and absent voter application. 5. Prepare and attach special labels to Self-Mailer pamphlet and arrange for delivery to the post office. 6. Have a qualified person available by telephone or In person at all times to assist the city Clerk should problems arise at any time during the election process. 7. Furnish general guidance throughout the election. SECTION 2. That the City shall pay Martin & Chapman Co. for all election supplies and services rendered. In the event any election supplies requested by the City and furnished by Martin & Chapman Co. are not correct, or contain errors so that the same are not acceptable to or usable by the City, there shall be no charge therefor made upon the city. SECTION 3. That Martin & Chapman Co. shall submit an itemized invoice to the City detailing the supplies furnished. The City shall pay all sums due and owing within 15 days of the receipt of the statement. - 2 - . . SECTION 4. That the total amount of these services shall not exceed $150,000.00. SECTION 5.
