INTRODUCTION
At the Council meeting of September 13, 1994, a graup of massage
therapists addressed the City Council regarding the permit
procedures established by Chapter 6.104 of the Municipal Code. The
therapists express~d the viewpoint that the Municipal Cade
provisions imposE unfair burdens upon them to prove their
legitimacy as heaith care profe5siona~s and unduly interfere with
their ability to become gainfully emp].Qyed in the City. In
response, the City Council directed the City Attorney to r~view the
City's Massage Ordinance, study the issues raised by the massage
technicians, consult with City staff, inCluding, in particular,
~eprESentatives of the Police Department, and make appropriate
recommendations.

Chapter 6.104 of the Santa Monica Municipal Cade estab~ishes a
permitting process for massage establishmer~t operators, aff-
premises massage (perForming massage at a lacatian ather than at a
Iicensed massage establishment), and massage technicians. To

apply for an operator ar off-premises massage permit, an appl~cant
must file a written application, pay a fee, be fingerprinted, and
take a written test which covers the requirements of Chapter 6.104.
Permits must be issued unless certain specified findings ar~ made,
and an applicant can appea~ a denial of his or her application. To
apply for a massage technician permit, an applicant must file a
written application, pay a fee, obtain a doctor's certificate,
submit a diploz~a or certificate and a transcript from an approved
massaqe school, submit evidence showing that applicant has
undergone at least 100 hours of resident course work, submit a
course descriptian and outline of the material covered and a letter
from the school administratar verifying completion of the
coursework, and take a two part examination. Massage technicians
employed by a massage estalalishment cannot obtain a permit for o€f-
premises massage.
Chapter 6.104 sets forth various requirements applicable to massage
establishments and to rr~assage therapists, including requirements
relating to hours of vperation or work, rec~rd keeping, staffing,
inspectians, attire, sanitation, and equipment.
Chapter 6.104 alsa provi.das for exemption certificates. They are
available to persons whfl have an Instructor in Massage certificate
or are members of professianal organ~zations which meet certain
requirements, including 300 classroom hours in a variety of topics.

Persons who qualify for exemption certificates need not comply with
cert~in permi~ting req~ire~nents of this Chapter.
In arder to assass Santa Monica's massage regulations and the
options far revising them, we reviewed more than two dozEn massage
ordinances from other cities around the State. We also met with
massage technicians who had spoken ta the Council, with
representatives of the Police Department who are assigned to vice
and who supervise officers assigned to vice, and with the City's
License and Permit Supervisor. A summary of the information which
we obtained follows.
Ther~ are three massage schools and approximately 20 massage
estab~ishments in the City. Massage establishments ar~ located at
the Loews and Shutters Hatels, th~ Tao Healing Arts Center, Surke
Williams Day Spa and Massage Center, Massage Masters, and at over
10 massage parlors scattered thraughout the City. During the
1993/94 Fiscal Year, the City issued 109 on-site massage permits
and 72 certificates of exemption. A small percentaqe af the
parmits issued were issued as a change of address for an already
licensed massage technician. The numbers are expected to be
significantly higher for this fiscal year.
Police ~epartment representatives who are assigned to viee and who
supervise officers assigned to vice advised us that: (1) they have
no objectian to retaininq and even expanding the exemptions

applicable to Iegitimate massag~ therapists. Doing sv would not
hinder their enforcement work at all; indeed, it could relieve some
of the paperwork burden which they now experience; (2)~n their
v~e~v, agplicants who are renewing their massage permits should not
have to do a~l of the paperwark each year. The Falice Department
keeps a file on each permittee which can be referred ta from year
to year; {3) Santa Monica should continue to have its own written
test for massage technicians; (4} the Licensing Divisian should lae
clearly in charge of making sure that the applications are camplete
before transmitting them to the Po~ice Department; (5} th2 cade
provision on unlawful operations should be strengthened and
clarified to assist the police in their attempts to arrest p~rsons
who advertise massage but are in fact prostitutes; and (6) the code
shou~d alsa be amended to address the prablems posed hy diplomas
~rom "schools" which are not legitimate.
Representatives from Burke willia~s - a legitimate massage
~stalalishment - e~ressed a variety of concerns about the City~s
massage regulatians. One concern was that the length af time
required to process individual applications varies greatly. One
applicant submitted her application and it took three months to be
processed; another appla.cant submitted her applicat~on after the
first applicant and her application was processed in two days.
Another ax-ea af concern was the massage technician test. The
representatives felt that there was no set schedule f~r giving the
massage technician test. Applicants had ta wait long periods of

time between filling out the application and the next test data,
time during which they c~uld not work in Santa Monica. In
addition, it was felt that the test was not adequate to show
whether or not the applicant in fact knew much about massage.
Burke Williams representatives had the fo~lowing suggestions: (1}
Since the Gity's test covered primariiy health matters, the City
should use the same test given to health care workers in hospitals;
(2) The City shou~d exempt from the testing requirement persons who
had passed the massage test in Los Angeles, which is similar ta the
Santa Monica test; ( 3) The City shauld accept massage certi.f icates
or licenses from other states so that applicants holding these
licenses would qualify ta recei~e a certificate of exemption from
the City; {4) The educational requirement shou~d be changed from
100 hours of course work to ~50 hours of course wark, which is what
legitimate schools of massage now provide; {5) Applications for
massage permits should be process~d promptly and the City should
place time limits on the permit processing procedure; (6) The
written test for massage permits should be given more often and on
a date certain; and {7y Continuing education c~.asses should be
required far massage permit halders.
The general concern of these representatives was that the City has
burdensame requirements, particularly for legitimate massage
prafessionals, which in some instanc~s seemed arbitrary. They
found it inconsistent that the City has three ~icensed, legitimate

massage schoals aperating within the City and yet make it hard for
graduates of these schools to wark in their field in the City.
The licensing supervisor explained that the process by which
massage technician permits are issued is complex and innolves the
processing af many forms by the Licensing Division, the Planning
and Comznunity Development Department, and the Police Department.
The major concern of this Divisian was that the paperwork involved
is enormaus. One suggesti~n was to streamline the renewal process
by n~t requiring applicants to fill out the same farms year after
year.
DISCUSS~dN
In reviewing the many expressed concerns, it seemed ta us that the
impact of any proposed changes on the City's massage regulations
should be to make it easier far legitimate massage technicians to
obtain a permit, make it harder for non-legitimate massage
technicians to obtain a permit, retain the Police Department tools
necessary ta enforce the provisions of the ordinance, and ensure
that the City's regulations are streamlined so that people can
begin to work in Santa Monica as expeditiously as passible.
The proposed ordinance incorporates most of the Police Department's
suggestions. One suggestian actua~ly required no change to the cade
because it is merely a matter of correctly interpreting the
existing ordinance. When a person is issued a c~rtificate of

exemption for massage, that person is not required to undergo the
applicat3on process as sEt forth in the ordinance for massage
technicians. Exempt persons do not have to take a written test,
nar do they have to obtain a medical certificate, Exempt persons
merely have to ~ill out the application £or exemption and hold a
Instructor in Massage certificate or be a member of a professional
massage organization or massage association which meets specific
requirements.
Most of the suggestions made by Burke Williams representatives have
baen incorporated into the proposed ardinance, but a few have nat.
Rather than adopt a test given to health care workers as they
suggested, it is recommended that the City's test needs to be re-
evaluated, on a continual basis, and made more applicable to actual
massage wark. Likewise, it is felt that to accept a passing grade
on the Los Angeles massage test would not serve the City's purpose.
The Los Angeles test is similar ta the City's, which does not
currently screen out illegitimate massage workers, and to use it
wauld therefore not enhance the City's screening process. Revising
the City's written massage technician test and giving the exam more
frequently and predictably woul.d better serve the screening purpose
it was written ta achieve as well as to resolve the uncertainty
aver when tha test will be given. Burke Wiliiams representatives
also suggested that c~ntinuing education classes be required of
massage technicians. This suggastian was not taken due to the

Police Department~s concern aver the administrative problems it
would entail.
The business license supervisor's suggestion of not requiring a
full reapplicat~on far a permit renewal has been incorporated into
the proposal.
Tn summary, the proposed ordinance:
1. Makes clear that applications must be submitted ta the License
Divisian which has the responsibility for determining whether ~r
not an application is complete.
2. Imposes upon the Licensing Divisian a 10-day time limit for
determining that an application for a massage technican permit
which the applicant asserts is camplete is camplete in fact.
3. Provides that massage technician applicants need 150 hours of
resident course work in massage, an increase of 50 hours, which
corresponds to what is the lower limit requixed by all massage
schools in the area.
4. Requires the massage test to be given quarterly and at least
every 90 days.

5. Requires the massage test to be updated and revised
periodically, and at least every four years.
6. Adds anather category af people who could rsceive a certificate
of exemption. This would include indi~iduals who are licensed in
massage by another state, as long as the requirements for that
state license were determined to ~e comparable to the City~s
requirements.
7. Adds language granting discretion to the Chief of Police to
determine that a specific massage school is not an Approved School,
based on substantial evid~nce to the cantrary.
8. Eliminates ambiguity and awkwardness in the present wording of
the chapter.
FTNANCIAL IMPACT
The proposed amendments would have no significant financial irnpact.
RECOMMENDATION
It is respectfully recommended that the accompanying ordinance be
introduced for f~rst reading.

the giving, of any massage ta any person under
the age af eighteen (18) years, unless the
parent or guardian of such minor person has
consented thereto in writing.
(b) Each operator shall erect and
maintain, after obtaining the necessary
permits, a recognizable and readable sign that
will be posted adjacent ta the main entrance
identifying the premise as a massage
establishment. The signs may not use any strobe
lights or other flashing lights to illumi.nate
the front of the business. Each operator shall
have posted, in a conspicuous location upon the
premises where the massage operation is to be
canducted, the aperator's permit as issuEd by
the Chief of Police.
(c) Each operator shall provide in each
room where massages are given, sufficient
lighti.ng and ventilation as required by the
Uniform Building Code.

one toilet and wash basin shall be provided for
the patrons in every massage establishment. If
male and female patrons are ta be served
simultaneously, and if steam rooms and saunas
are provided, separate steam raoms or saunas

Hot and cold running water under pressure shall
be pravided to all wash basins, bathtubs,
showers, and similar equipment. Each wash basin
shall be provided with soap or detergent and

pravided in each toiletroom. In addition to the
wash basin pro~ided for patrons, a minimum of
one separate wash basin shall be provided iri
each massage establishment, which basin shall
provide soap or detErgent and hat running water
at all times and shall be located within ar as
practical to the area devoted to the performing

of massage services. In addition~ there sha11
b~ provided at each wash basin, sanitary tawels
placed in permanently insta~~ed dispensers. If
the wash basin for patrons is not in the
toiietroom but ~t is adjacent thereta, this
wash basin shall meet the separate wash basin
requirement if it is reasonably close to the
area devoted to tha perfarming af massages.
{f} No person shall operate a massage
establishment, or administer a massage as
herein defined in any massage establishment
between the hours of 10:30 p.m. and 7;00 a.m.
(g) No person licensed to do business as
herein prova.ded shall operate under any name or
eonduct business under any designation nat
specif ied in his or her permit.
(h) No person shal~ enter, be, ar remain
in any part of a massage establishment licensed
under this Chapter while in possessian of,
consuming, using, or under the influence of any
alcoholic beverage or drug. The owner,
operator, and manager shall be responsible far
ensuring that no such person shall enter or
remain upon the licensed premises.
(i) No building ar part thereaf t~sed as
a massage estahlishment sha~l be equipped with
any electronic, mechanical, or artificial

recarding or videotaping, for monitoring the
activities, conversation, or other sounds in
the treatment roam or room used by the business

a massage technician shall keep a record of the
dates and haur of each treatment vr service,
name, address and birth date of the patron to
be verified by legal ~dentification, name of
technician administering such service and
description of the treatment or service
rendered. These records sha~l be open to
inspection by the health officials charged with
the responsibility af preventing the spread of

communicable and contagious diseases and to
officia3s charged with the enfo~cement af the
pravisions of this Cade. The information
turnished or secured as a result of any such
records shall be used only to ensure and
enforce compliance with this Chapter and other
applicable laws and shall otberwise remain
confidential. Officials charged with
enforcement of this Chapter shall periodically
inspect said records to ensure compliance with
this Section. The records required by this
Subsectian shall ba maintained for a period of
not less than ane year.
(r) The holder of the p~rmit must have in
his or her possession a photo identification
card prepared by the Police Department when
working pursuant ta the permit. The photo
identification card shall be promptly presented
to any peace officer upon request.
(s) No person shall operate as an
off-premise massage technician or administer a
massage as herein defined between the hours of
~.0:30 p.m. and 7:00 a.m.
(t) No person while conducting business
as an off-premise massage t~chnician, shalX be
~,n possession af , or under the inf luance of any
alcaholic beverage or drugs.

(c) In order to obtain an exemption
certificate, the person must file an
application for an exemption certificate in the
form required by the Ghief of Police. If the
application far exemption is based upon the
person having been issued the necessary
Certificate of Authorization or Service as an
instructor, the application for exemption shail
be approved or denied within ten (10) days af
the filing of the application. If the
application for exempt~on is based upon
membership in a qualified organization or

the application for exemption shall be appraved
or denied within ten (10) days of the filing af
the application if the Chief of POZIGE has

Sectivn, or within sixty (60) days if no such

such persan is engaged in any ma5sage activity.
(e) At sueh times as the Chief of Police
deems apprapriate, persons exempt under this
Sectian may be required ta v~rify that he or
she continues to be entit~ed to an exemption
under this Section.
(f) The exemption certificate shall be
deemed revoked and of no further force or
effect an the date on which the person's
Certificate of Authorizati~n for Service as an
instructar in Massage pursuant to California
Educatian Code Section 94311(d) (3) or ~..1-_.r~
..t ir.~• license has expired or been suspended or
revoked or the person is no longer a member in
good standing of the arganization or
association entitling the person to an
exemption under this Section.
(g) No operator~s permit shail be
required by this Chapter ~"ar ~~ a person who
employs anly persons exempt under this Section.
An operatvr's permit shall be required by any
person wha emplQys both massage technicians
licansed under this Chaptsr and persons exempt
under this Sectian.

(h) An applicant ar exemption certificate
holder 5ha~1 have the right to appeal from a
decision of the Chie~ of Police under this
Section in the time and in the manner set forth
in Chapter 6.20 et seq. of this Code.
(i) A person exempt under this Section
shall not be required to obtain a police permit
pursuant t~ Section 6.20.~4d.
SECTION 5. Any provision af the Santa Monica Municipal Coda
or appendices thereto incansistent with the pravisions of this
Ordinance, to the extent of such inconsistencies and no further, are
hereby repealed ar madified ta that extent necessary ta affect the
provisions of this Ordinance.
SECTION 6. xf any section, subsection, sentence, claus~, or
phrase of this Ordinance is far any reason held to be invalid ar
unconstitutional by a decision of any court of any competent
jurisdiction, such decisian sha~~ not affect the validity of the
remaining portions of this Ordinance. The City Council hereby
dec].ares that it would have passed this Ordinance, and each and
every section, subsectian, sentence, clause, or phrase not declared
inva~id or uncons~itutional without regard to whether any portion
of the Ordinance would be subsequently deciared invalid or
unconstitutional.

SECTION 7. The Mayor shall sign and th~ City Clerk shal~
attest ta the passage of this Ordinance. The City Clerk shall cause
the same ta be published once in the official newspaper within 15
days after its adoption. This Ordinance shall became effective
after 30 days from its adoptian.
