SUBJECT: ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
RELATING TO THE REGULATION OF SMOKING AND REPEALING SANTA
MONICA MUNICIPAL CODE SECTIONS 4.44.010, 4.44.040,
4.44.050,4.44.060,4.44.070 AND 4.44.080 AND AMENDING OR
RENUMBERING SECTIONS 4.44.020, 4.44.030, AND 4.44.090
At lts meeting of January la, 1995, the City Council approved on
flrst reading an ordinance modlfYlng Chapter 4.44 of the Municipal
Code regulating smoking. That ordinance repeals sections 4.44.010,
4.44.040, 4.44.050, 4.44.060, 4.44.070 and 4.44.080 and amends or
renumbers sections 4.44.020, 4.44.030 and 4.44.090. In substance,
the ordinance has the effect of imposing local prohlbitlons against
smoklng in elevators, on buses (except charters), in restrooms, and
in Cl ty-owned buildings used for municipal purposes.

retains the prohibition against cigarette vending machines and
establishes a definition of bars which would apply to any
applicable smoklng restriction. Otherwise, the ordinance permlts
state law to regulate smoking within the Clty. The ordinance is
now presented to the Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying ordinance be
adopted.

CITY OF SANTA MONICA REPEALING
SANTA MONICA MUNICIPAL CODE SECTIONS
4.44.010, 4.44.040, 4.44.050, 4.44.060, 4.44.070
AND 4.44.080 AND AMENDING OR RENUMBERING
SECTIONS 4.44.020, 4.44.030, AND
4.44.090 REGULATING SMOKING
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLO\-lS:
SECTION 1.
Santa Monica Municipal Code Sections 4.44.010,
4.44.040, 4.44.050, 4.44.060, 4.44.070, and 4.44.080 are hereby
repealed.
SECTION 2.
Munlclpal Code Section 4.44.030 is hereby
renumbered as Sectlon 4.44.010 and amended to read as follows:
4.44.010 General Prohibitions.
It shall be unlawful to smoke In the
followlng places:
(a) Any elevator;
(b) On any bus used In the business of
transportlng passengers for hire in the city,
exceptlng for charter operations;

(c) Any restroom open to the general
public or provided for use to customers or
patrons, unless there are separate smoking and
nonsnok~ng restroomsi
(d) Every building owned or leased by the
C1 ty of Santa Monica and used for municipal
purposes. If only a port1on of a bU1lding is
used for municipal purposes, th1S subsection
shall apply only to that portion of the
build1ng used for mun1cipal purposes.
SECTION J. Mun1cipal Code Section 4.44.020 is hereby amended
to read as follows:
4.44.020 Definitions.
The following words and phrases, as used
1n this Chapter or in any other appl1cable law
regulat1ng smok1ng, shall have the followlng
mean1ngs:
(a) Bar. An area where alcoholic
beverages are served for consumption on the
premises and in which the serving of food, if
any, 1S only incidental and consists solely of
hors d'oeuvres, snacks and slmllar foods.
(b) Smoke or smoking. The carrying or
holding of a lighted pipe, c~gar, or cigarette
of any kind, or any other lighted smoking
product or equ1pment used to burn any tobacco

products, weed, plant, or any other combustible
substance. Smoking includes the emitting or
exhaling the fumes of any pipe, cigar, or
clgarette of any kind, or any other lighted
smoking equipment used burning any tobacco
product, weed, plant, or any other combustible
substance.
SECTION 4. Munlclpal Code Section 4.44.090 is hereby
renumbered Section 4.44.030 and lS not otherwlse amended.
SECTION 5. Any provlslon of the Santa Monlca Municipal Code
or appendlces thereto inconsistent with the provisions of thls
Ordlnance, to the extent of such lnconsistencles and no further, are
hereby repealed or modified to that extent necessary to affect the
provlslons of thIS Ordinance.
SECTION 6. If any section, subsectIon, sentence, clause, or
phrase of thlS OrdInance is for any reason held to be invalId or
unconstl tutional by a declsion of any court of any competent
jurisdictIon, such decision shall not affect the validIty of the
remaIning portions of this OrdInance. The City Council hereby
declares that It would have passed thIS Ordlnance, and each and
every sectlon, subsection, sentence, clause, or phrase not declared
Invalid or unconstitutional without regard to whether any portIon
of the Ordlnance would be subsequently declared invalid or
unconstitutIonal.

SECTION 7.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall cause
the same to be published once in the officlal newspaper within 15
days after lts adoptlon.
