BACKGROUND
The Clty Plannlng Commission approved the Tentative Map and the Ten-
ant-Partlcipating Conversion for the above proJect on Aprll 7, 1993,
after a publlc hearing and a careful review of the record and staff
recommendations. The actlon of the Plannlng CommlSSlon was based
on the CommlSSlon IS flndlngs that the proposed Tenant-Participatlng
Conversion meets the requlrements of Article XX of the City Charter
and that the proposed subdiv1810n 18 conslstent with applicable
general and speclflc plans as adopted by the Clty of Santa Monica
along wlth all mandatory requirements of the Subdlvlslon Map Act of
the State of Callfornia.

The owners have subm1tted to the City a Wr1tten Consent Agreement
b1nd1ng the owners and any successors 1n 1nterest to each cond1t1on
1mposed 1n connect1on w1th approval of this Tenant-Partlc1pat1ng
ConverS1on. Th1S Wrltten Consent has been approved by the City
Attorney and the City Manager. Each part1cipat1ng tenant has been
1nformed 1n wr1t1ng of his or her r1ghts under Artlcle XX of the
C1ty Charter. The License D1V1Slon reports that proper arrangements
have been made to ensure payment of the Tenant-Partic1pating
Conversion Tax.
The F1nal Map conforms to the Tentatlve Map. The F1nal Map has been
certlf1ed by the C1ty Englneer for conformance w1th the Tentat1ve
Map and conditions thereon, the Subdlv1slon Map Act and local
ordinances. The City Attorney's offlce has approved a Declarat10n
of Covenants, Condltions, and Restrict1ons, or equlvalent document,
for thlS proJect as complYlng wlth the cond1t1ons of the Tentat1ve
Map and the Tenant-Part1cipating Conversion.
Councll approval of a final map for a Tenant-Part1clpating
ConverSlon represents one of the last steps necessary in the
converSlon process. Followlng Clty Councll action and approval by
the California Department of Real Estate the appl1cants may begin
selling the1r unlts to the tenants. As each un1t is sold a
converSlon tax per Section 2008 of Artlcle XX 1S due 10 an amount
equal to twelve times the monthly maX1mum allowable rent for that
unit These ~axes will be used to assist low and moderate lncome

SECTION 1. That the Final Map for Tract NO.51588 ln the Clty
of Santa Monlca hereby 18 accepted and approved.
SECTION 2. That the City Clerk hereby lS author.::.. zed and
d1rected to endorse upon the face of sald Map thlS order
authentlcated by the Seal of the C1ty of Santa Mon1ca.
SECTION 3. That the Clty Clerk shall cert1fy to the adoptlon

Changes to Section 9(g) (i) (Uses) of DA, p. 11-12 of amendment:
- The hotel use lS omitted and supermarket, residentlal and
neighborhood commercial uses are added to the DA; the
overall limitatlon on total floor area is retalned.
Changes to Section 9(g) (iii) (Alcohol Sales) of DA, p. 12-13 of
amendmen t :
- A reference to alcohol sales within a hotel has been
replaced wlth "Restrictlons on Speclfic Development",
includ1ng a prohibition on neighborhood retail, supermarket
or res1dential uses with1n the "Deslgnated Area" noted
above; a restrictlon within the western half of the Colorado
Avenue Zone, as shown on the Zone Dlagram, stlpulating that
no residential, neighborhood commercial or supermarket uses
shall be allowed untll November 18, 1996; a stipulatlon that
Colorado-fronting bU1ldings shall not contaln res1dentlal
uses within the ground floor portlon of the buildings
adJacent to Colorado Avenue. These changes are the result
of a settlement between the applicant and Santa Monica
Number Seven, the owner of the Sony Music Campus.
Changes to Section 9(i) (ii) (Cloverfield Access) of DA, p. 14 of
amendmen t :
- A prohibltlon on Cloverfield access has been revised to
allow access on Cloverfleld with restrictlons.
Changes to Section 9(1) (Review of Specific Buildings) of DA, p.
14-15 of amendment:
- Addit10nal findings are establ1shed if a Review of Specific
Buildings lncludes a residentlal, neighborhood commerc1al
and/or supermarket component. These findlngs relate to the
relatlonship between the specific bUllding being reviewed,
the entire project site, the publ1C right-of-way, and the
surrounding properties.
- A requirement 1S establ1shed that, If a supermarket is
approved for the slte, the next applicatlon made under the
ReVlew of Speciflc Buildings section must include a plan
show1ng the uses and landscap1ng intended for the remainder
of the Arboretum Development Partners property.
Changes to Section 12(a) (Housing and Parks Fee) of OA, p. 15-16
of amendment:
- The section on the Housing and Parks fee, which applled to
general and medlcal office uses, 18 revlsed to explicitly
