Subject: Recommendation to Adopt a Resolution Approving Rules and
Regulations for the Use of In-Vehicle Parking Regulators
INTRODUCTION
This report recommends the city Council adopt the attached
resolut1on approving rules and regulations for the use of 1n-
vehicle park1ng regulators.
DISCUSSION
At the C1ty Council meeting of November 17, 1992, an ordinance
amending Chapter 3.16 of the Santa Monica Municipal Code regarding
the use of in-vehicle parking regulators was introduced for first
reading. That ordinance included the requirement that rules and
regulations for the use of in-vehicle parking regulators be
approved by resolution of the city Council. The C1ty has 200
regulator un1ts on hand and is ready to implement the program once
the regulations are adopted. The attached resolution is presented
for City Counc1l approval of such rules and regulations.
The rules and regulatlons cover legal authority, lease
arrangements, warranty, fees and deposits and instructions for the
operation, display and use of the units. They also address misuse
of the regulators and the consequences thereof. They have been
approved by the Police Department, Park1ng Enforcement Divls1on.

The primary purposes for use of the in-vehicle parking regulator
are convenience and economy. They are convenient in that they
preclude the need for carrying a supply of coins for parking
meters. They are economlcal in that the user pays only for the
time parked.
It should be noted that the regulators are set for the rate of
fifty cents per hour for economy and simplicity. While they can be
used in areas where the meter rate is 35 cents per hour, the user
will overpay by 15 cents per hour. However, the 35 cent rate
applies to only a small number (17 %) of the City'S parking meters,
prlmarily those along Colorado Avenue, Lincoln Boulevard and pica
Boulevard. It is expected that the regulators will seldom be used
in 35 cent meter areas.
BUDGET I FISCAL IMPACT
No signlficant budget / fiscal impact is expected to result from
the proposed action.
RECOMMENDATION
It is respectfully requested that the City Council adopt the
attached resolution approving rules and regulations for the use of
in-vehicle parking regulators.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
APPROVING RULES AND REGULATIONS FOR THE USE OF
IN-VEHICLE PARKING REGULATORS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1- The City Council of the city of Santa Monica does
hereby approve Rules and Regulations for the use of In-Vehicle
Park1ng Regulators as follows:
RULES AND REGULATIONS FOR THE USE OF
IN-VEHICLE PARKING REGULATORS
Introduct1on
These regulations and procedures for the use of in-vehicle parking
regulators are promulgated by the Parking and Traffic Engineer of
the City of Santa Monica pursuant to authority granted by the
Municipal Code. Questions and comments should be directed to the

Authority
Authority for the use of in-vehicle parking regulators is set forth
in Section 3.16 of the Santa Monica Municipal Code.
Lease Arranqements
In-vehicle parking regulators may be leased only from the City of
Santa Monica by completing the attached Application and Lease
Agreement and br1nging it, along with the appropriate fee, to:

There 1S no term to the lease for an in-vehicle parking regulator.
The regulator un1t or card must be returned wlthin ten (10) days
after the time on the regulator has expired. In the event that
parking meter rates are changed, the regulator shall become invalid
and should be returned for credit. The City reserves the right to
inspect or audit the use of any regulator, and to terminate the
program, upon reasonable notice to the lessee. It is the sole
responsibility of the lessee to notify the City of any change of
address.

Fee
The fee to lease an in-vehicle parking regulator is $ 65.00. This
includes 100 hours of parking tlme at 50 cents per hour and the
$ 15.00 cost of each unlt.
Operation, Display and Use
The in-vehicle parking regulator may be used in anyone of four
veh1cles as listed in the Lease Agreement. The lessee has the sole
obligatlon to request the City to amend the Lease Agreement to add
or delete veh1cles in which the regulator is to be used. If the
regulator 1S used on a vehicle which is not properly currently
registered or included in the Lease Agreement, the vehicle shall be
cited as though the regulator was not in use.
The unit must be placed face out in the lower left corner of the
windshield so as to be clearly visible and readable to Parking
Enforcement Officers. It must be turned on as soon as the vehicle
is stopped ~n a metered parking space. Otherwise, a citation will
be lssued. It is recommended that the "REGULATOR" placard
furn1shed with the unit be used to alert officers to the use of the
in-vehicle parking regulator. In order to avoid wasting its value,
the regulator should be turned off immediately before the vehicle
leaves the parking space. The in-vehicle parking regulator is not
valid for parklng in excess of posted time limits.

Warranty
The Clty of Santa Monica makes no warranty or guarantee as to the
merchantability or performance of any in-vehicle parklng regulator.
Any user experienclng a problem with a unit should immediately
contact the Parking and Traffic Engineering Division at the above
address.
Misuse
The In-vehlcle parking regulator is the property of the city of
Santa Monica. It shall not be defaced, damaged, tampered with,
altered, destroyed or impaired. No person shall display any false
or imitation device which appears or purports to be an in-vehicle
parking regulator. Violators will be prosecuted pursuant to the
Municipal Code, and will not be eligible to rent or lease an in-
vehlcle regulator in the future.
Changes
These regulations and procedures are subject to change without
personal notice to the lessee.
SECTION 2. The City Clerk shall certify to the adoption of
this resolution, and thenceforth and thereafter the same shall be
in full force and effect.
