SR-6-G (41) - > . 6 (9 GS:SS:RV:swset187 FEB - 9 1993 council Meeting: Febuary 9, 1993 Santa Monica, California TO: Mayor and City Council FROM: City Staff SUBJECT: A Resolution Setting a Public Hearing for April 13, 1993, on the Confirmation of Assessment of Costs to Repair Damaged Sidewalks, Driveways, Curbs, and the Removal of Damaged Pavement in Parkway Areas on Various City streets (SR-93-1B7) Introduction This report recommends that City Council set a public hearing for April 13, 1993, to hear any protests regarding the completed work and confirm the assessments of costs to repair damaged sidewalks, driveways, curbs, and the removal of damaged pavement in parkway areas on various city streets. Backqround On October 9, 1979, city council approved a sidewalk repair program which provided for property owner participation in the cost of repairing damaged sidewalks. Residential property owner participation is 50% of the cost of the repairs, if the damage is related to tree roots with the City paying the remaining 50% of the repair costs. Property owners are assessed 100% of the cost if the damage is not related to tree roots and commercial property owners are assessed 100% of the cost regardless of the cause of the damage. 6-6 - 1 - FEB - 9 1993 . . Where damage is not because of the roots, the property owner's share is 100% of cost. Sidewalks, driveways, curbs and parkways, if damaged, were replaced and repair work has been completed at the following addresses: 1047 12th street, 752 19th Street, 1760 19th street, 2520 21st street, 1523 Bay Street, 903 Fourth street, 1450 Franklin Street, 2107 Hill street, 2337 Hill Street, 1809 Michigan Avenue, 122 Montana Avenue, 124 Montana Avenue, 2001 Santa Monica Boulevard, 707 Seventh Street, and 2002 Wilshire Boulevard. The property owners' share of the costs is now due. A public hearing to confirm the assessment of costs must be held pursuant to the provisions of Chapter 22, Sections 5600 to 5630, of the streets and Highways Code of the State of California. A Resolution setting the public hearing for 6:30 p.m. on April 13, 1993, is attached. All affected property owners will be notified of the public hearing date and the assesment amount forty five days prior to the public hearing. A list of property owners and - 2 - However, Alternative 3 generates a net benefit of $34.52 million and Alternative 4 a net benefit of $8.3 million. 2002 As with the buildout scenario, the fiscal projections for the year 2002 indicate that all of the alternatives would produce net cumulative beneficial impacts to the city's revenues. However, in this short-term scenario, the revenues associated with each alternative vary by only $2.25 million and expenses for each alternative vary by only $1.57 million. Net cumulative benefits range from a low of $1.79 million for Alternative 4 to a high of almost $2.59 million for Alternative 5. Alternatives 2, 4, and 6 are all in the $1.8 to $1.9 million range and Alternatives 1, 3, and 5 are in the $2.5 million range. Alternative 0, which results in the greatest amount of development, would generate $2.3 million. - 26 - -- \ RESOLUTION NUMBER B540{CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING A PUBLIC HEARING ON APRIL 13, 1993, FOR ANY PROTESTS OR OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIR OF SIDEWALKS, DRIVEWAYS, CURBS AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY AREA (SR-93-187) THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Superintendent of Streets will file a report of repair pursuant to section 5617 of the streets and Highways Code of the State of California, relating to the construction of certain improvements to sidewalks and driveways at 1047 12th street, 752 19th street, 1760 19th street, 2520 21st Street, 1523 Bay street, 903 Fourth street, 1450 Franklin street, 2107 Hill street, 2337 Hill Street, 1809 MiChigan Avenue, 122 Montana Avenue, 124 Montana Avenue, 2001- Santa Monica Boulevard, 707 Seventh Street, and 2002 Wilshire Boulevard, all within the City of Santa Monica. SECTION 2. Pursuant to Section 5600 et seq. of said Code, the City Council does hereby order and declare that on the 13th day of April 1993, at 6:30 p.m., in the City Council Chambers of City Hall, it will hear and pass upon the report by the ~ Superintendent of streets of the cost of repairs, together with objections or protests, if any, which may be raised by any property owner liable to be assessed for the cost of such repairs and any other interested persons. - 4 - -------- - ~ --- ~ . . . ~ SECTION 3. All protests or objections must be in writing and filed with the city Clerk on or before the time set for the hearing of the protests and objections. SECTION 4. The Superintendent of streets is hereby directed to mail notices, in the manner and form prescribed by law, of the costs of repair and of the adoption of this Resolution to all persons owning real property affected by the sidewalk assessment repair program, whose names and addresses appear on the last equalized assessment roll for the City taxes or as known to the City Clerk. SECTION 5. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
