SUBJECT: A Resolution to Set a Public Hearing on March 23, 1993
for the Confirmation of Assessment of Costs for Street
Reconstruction on Lincoln court Between Olympic
Boulevard and Michigan Avenue
Introduction
This report requests that City Council set a public hearing on
March 23, 1993 to hear protests regarding the completed work and
to confirm the assessment of costs for the reconstruction of
Lincoln Court between Olympic Boulevard and Michigan Avenue.
This improvement was completed in conjunction with the 1991-92
Street Resurfacing Program.
Backqround
The City's policy is to assess commercial and residential
property owners for certain public works improvements using the
Improvement Act of 1911. These include gutter construction,
street and alley paving, tree planting and streetlighting.
On November 12, 1991, City Council approved the formation of an
assessment district for the reconstruction and appurtenant work
on Lincoln Court between Olympic Boulevard and Michigan Avenue.
Lincoln Court was in extremely poor condition along the full
length of the alley containing numerous irregularities and
potholes. There was also a drainage problem due to the extremely
flat grade of the alley. Due to the extent of the needed

repairs, patching was not feasible. Thus, reconstruction was
required. The reconstruction of Lincoln Court consisted of
grading and replacing the existing deteriorated asphalt paving
with new concrete paving. The life of the new concrete alley is
estimated to be in excess of 50 years.
On November 22, and December 5, 1991 notices of the public
hearing was posted and mailed in accordance with state law to all
affected property owners. The public hearing was held on
December 17, 1991 and after closing the public hearing, Council
ordered the work to commence.
The street construction was completed in conjunction with an
annual street improvement project and property owner assessments
are now due. A public hearing to confirm the assessment of costs
must be held pursuant to section 5882 of the California streets
and Highways Code. The attached resolution sets the public
hearing for 6:30 p.m. on March 23, 1993. All affected property
owners will be notified of the public hearing date and the
assessment amount at least forty five days prior to the public
hearing. A list of property owners and assessments amounts will
be available to Council at the time of the public hearing.
Discussion
The Lincoln Court assessment is similar to a streetlighting
assessment. Industrial and commercial property owners are
assessed 100% of the cost per footage, $67.25 per lineal foot.
Residential property owners will be assessed 50% of the cost per
footage, $33.63 per lineal foot, with the city paying an equal

share. The sharing of costs is related to the proportionate
amount of wear and tear caused by vehicles from the commercial
properties as compared to less wear and tear caused by
residential properties. The residential owners share will range
from $1,680 to $3,700/lot. A similar alley assessment project
was completed in 1985, on Ozone Place North where property owners
were assessed for a portion of the costs.
BUdget/Financial Impact
The total cost of this project is $38,450 which includes the
City's contribution and staff time, engineering, surveying,
posting and mailing of notices, construction management and
inspection time.
It is calculated that $29,163 will be generated from property
owner assessments for this street reconstruction:
Commercial and industrial property owner assessments $ 19,875
Residential property owner assessments 9,288
Total owner assessments $ 29,163
The total cost of this project, including the City's share, has
been charged to CIP Account No. 01-770-421-20092-8900-99152,
"street Repair/Resurfacing". Cash revenues will be received in
FY 1992-93 and any unpaid assessments will be placed on the
1993-94 property tax roll by the Los Angeles county Assessor's
Office. Revenues will be deposited in Account Number
01-500-401-00000-0124-10000, II street Resurfacing Assessment
District. II

Recommendation
It is recommended that City Council adopt the attached resolution
setting a public hearing for March 23, 1993 to confirm the
assessment of costs for street reconstruction on the above named
City street.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING ON MARCH 23, 1993, TO HEAR ANY
PROTESTS OR OBJECTIONS TO THE
CONFIRMATION OF ASSESSMENT OF COSTS FOR
THE CONSTRUCTION OF CONCRETE PAVEMENT AND
APPURTENANT WORK ON LINCOLN COURT BETWEEN
OLYMPIC BOULEVARD AND MICHIGAN AVENUE IN
CONJUNCTION WITH THE 1991-92 STREET
RESURFACING PROGRAM
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The superintendent of Streets will file a report
of work pursuant to Section 5882 of the Streets and Highways Code
of the State of California, relating to the construction of
certain improvements completed on:
Lincoln Court - between Olympic Boulevard and Michigan Avenue
SECTION 2. Pursuant to Section 5870 et seq. of said code,
the City Council does hereby order and declare that on the 23rd
day of March, 1993, at 6:30 p.m., in the City Council Chambers of
City Hall, it will hear and pass upon the report by the
Superintendent of streets, of the cost of improvement together
with any objections or protests, if any, which may be raised by
any property owner liable to be assessed for the cost of such
improvement and any other interested persons.

SECTION 3. All protests or objections must be in writing
and filed with the city Clerk on or before the time set for the
hearing of the protests and objections.
SECTION 4. The Superintendent of Streets is hereby directed
to mail notices, in the manner and form prescribed by law, of the
cost of improvements and of the adoption of this Resolution to
all persons owning commercial, industrial or residential real
property in the hereinbefore described assessment district whose
names and addresses appear on the last equalized assessment roll
for the City taxes or as known to the City Clerk.
SECTION 5. The city Clerk is directed to publish this
Resolution in The Outlook on two successive dates- The first
publication is to be made not less than fifteen days prior to the
date of the above public hearing_
SECTION 6. The City Clerk shall certify to the adoption of
the Resolution, and thenceforth and thereafter the same shall be
in full force and effect.
