SUBJECT: A Resolution to Set a Publ ic Hearing on Apnl 13, 1993 for the
Confirmation of Assessment of Costs for the FY 1991-92 Street
Resurfacing Program and Appurtenant Work on various City Streets
Introduction
This report recommends that City Council set a pub 1 i c heari ng on Apri 1 13,
1993 to hear protests regarding the completed work and to confirm assessment
of costs for constructing concrete gutters; resurfacing streets; and repalring
damaged sidewalks, driveways and curbs and removing pavement in parkway areas.
These improvements were in conjunctlon wlth the FY 1991-92 Street Resurfacing
Program at various commercial, industnal and residential locations 1n the
City.
Background
The FY 1991-92 Street Resurfacing Program 1ncluded gutter construction; street
resurfacing; slurry sealing; parkway pavement removal; curb repa1r and
construction of sidewalks and driveways at various locat10ns in the City. The
Director of General Serv1ces, the City Engineer and the Street Maintenance
Superintendent inspected and evaluated the streets that ranked high on the
"Pavement Management System Reportn as streets in need of repair. The
cr1teria used to determine WhlCh streets were to be resurfaced and the method
of repair included: age, surface and subsurface condit ions, complaints
recelved, type of use (i.e., commerc1al and residential), current traffi c
volume, and projected change of use or volume of the streets.

In accordance with a 1981 City CounCll policy, res 1 dent ia 1 properties are
assessed one half the cost of removal and replacement of curbs, sidewalkst
dri veways and the removal of parkway pavement. Commercial propert i es are
assessed the full cost of repair of this work.
Residential properties are not assessed for new gutter constructlon or street
resurfacing; howevert commercial and industrial property owners are assessed
the full cost. The proposed assessments are designed so that each commercial
and industrlal property owner pay the same unlt cost regardless of the width
of the street on which their property fronts. Consi stent with the present
pol icy for assessing commercial and i ndustri a 1 propertiest this assessment
will be a cash assessment and no bonds will be lssued.
On Apri 1 24, 1992 notices of the public hearing was posted and mailed 1n
accordance with State law to all affected property owners. The public hearlng
was held on May 12, 1992 and after closing the public hearingt Council ordered
the work to commence.
The street reconstruction was completed and property owner assessments are now
due. A public hearing to confi rm the assessment of costs must be held
pursuant to Section 5882 of the Cal ifornia Streets and Highways Code. The
attached resolution sets the publlC hearing for 6:30 p.m. on April 13, }993.
All affected property owners will be notified of the public hearing date and
the assessment amount at least forty five days prior to the publ1c hear1ng. A
11st of property owners and assessment amounts wlll be available to Council at
the time of the public hearing.

The unit cost includes construction, staff time, engi neeri ng, surveying,

The assessment district was administered in accordance with the procedures set
forth in the Improvement Act of 1911 of the California Streets and Highways
Code.
Budget/Financial Analysis
The total revenue from this assessment is $102,107.40. It is calculated that
$71,199.90 is generated for gutter construct 1 on and street resurfacing and
will be deposlted in Revenue Account No. 01-500-401-00000-0124-10000, "Street
Resurfacing Assessment". Add; t i ana 1 reven ue in the amount of $30,907.50 for
the repair of sidewalks, driveways and curbs, and the removal of pavement in
parkway areas will be deposited in Revenue Account No.
01-500-481-00000-0179-10000, "Sidewalk Repair Revenue." Any unpaid
assessments will be placed on the 1993-94 property tax roll by the Los Angeles
County Assessors offlce.
Recommendation
It is recommended that City Council adopt the attached Resolution settlng a
public hearing for April 13, 1993 to confirm the assessment of costs for the
gutter construction, street resurfacing, and repair of damaged sidewalks,
dn veways and curbs and the removal of parkway pavements on the above named
streets.
