SUBJECT: A Resolution to Rescind Resolution 8530 (CCS) Adopted
on January 26, 1993 and Set a Public Hearing for May
11, 1993 for the Confirmation of Assessment of Costs
for street Reconstruction on Lincoln Court Between
Olympic Boulevard and Michigan Avenue
Introduction
This report requests that the City Council rescind Resolution
8530 (CCS) adopted on January 26, 1993 setting a public hearing
for March 23, 1993. This report also requests that city council
set a public hearing on May 11, 1993 to hear protests regarding
the completed work and to confirm the assessment of costs for the
reconstruction of Lincoln court between Olympic Boulevard and
Michigan Avenue. This improvement was completed in conj unction
with the 1991-92 Street Resurfacing Program.
Background
On January 26, 1993 city Council approved Resolution 8530 (CCS)
setting a public hearing for March 23, 1993. Due to new
legislation effective January 1, 1993, legal notification and
publication deadlines have changed from 15 to 45 days prior to
the date of the public hearing. Sufficient time was not allowed
to meet these legal requirements. This new public hearing date
allows sufficient time for notification of property owners and
publication in The Outlook. 6-[

Recommendation
It is recommended that city Council rescind Resolution 8530
(CCS), adopted on January 26, 1993 and adopt the attached
resolution setting a public hearing for May ~1, 1993 to confirm
the assessment of costs for street reconstruction on the above
named city street.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA RESCINDING
RESOLUTION 8530 (CCS) ADOPTED ON JANUARY
26, 1993 AND SETTING A NEW PUBLIC HEARING
ON MAY 11, 1993, TO HEAR ANY PROTESTS OR
OBJECTIONS TO THE CONFIRMATION OF
ASSESSMENT OF COSTS FOR THE CONSTRUCTION
OF CONCRETE PAVEMENT AND APPURTENANT WORK
ON LINCOLN COURT BETWEEN OLYMPIC
BOULEVARD AND MICHIGAN AVENUE IN
CONJUNCTION WITH THE 1991-92 STREET
RESURFACING PROGRAM
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby rescinds Resolution
8530 (CCS) adopted on January 26, 1993 setting a public hearing
for March 23, 1993.
SECTION 2. The superintendent of streets will file a
report of work pursuant to section 5882 of the Streets and
Highways Code of the State of California, relating to the
construction of certain improvements completed on:
Lincoln Court - between Olympic Boulevard and Michigan Avenue
SECTION 3. Pursuant to section 5870 et seq. of said
Code, the City Council does hereby order and declare that on the
11th day of May, 1993, at 6:30 p.m., in the city council Chambers
of City Hall, it will hear and pass upon the report by the
Superintendent of streets, of the cost of improvement together

with any objections or protests, if any, which may be raised by
any property owner liable to be assessed for the cost of such
improvement and any other interested persons.
SECTION 4. All protests or objections must be in
writing and filed with the City Clerk on or before the time set
for the hearing of the protests and objections.
SECTION 5. The Superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the cost of improvements and of the adoption of thl.s
Resolution to all persons owning commercial, industrial or
residential real property in the hereinbefore described
assessment district whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known to the
City Clerk.
SECTION 6. The City Clerk is directed to publish this
Resolution in The Outlook on two successive dates. The first
publication is to be made not less than 15 days prior to the date
of the above public hearing.
SECTION 7. The City Clerk shall certify to the
adoption of the Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
