SR-6-G (38) I 6-G ~ ..~~ ~ ~.<~ LUTM:PB:WR:wr/housing1.hpword.bldg , _t- y' t":' J..., council Meeting: April 13, 1993 Santa Monica, California TO: Mayor and city Council FROM: city staff SUBJECT: Annual Report on Compliance with California Revenue and Taxation Code Section 17274 Regarding Rental Housing Code Enforcement for Calendar Year 1992 INTRODUCTION This report presents the rental housing code enforcement activities of the Building & Safety Division for 1992 as required by California Revenue and Taxation Code Section 17274 and recommends that City Council accept and file this required report. DISCUSSION Sectlon 17274 of the Californla Revenue and Tax Code requires that regulatory agencies report to the Franchise Tax Board the names and addresses of the owners of substandard rental housing in the city who fail to make necessary repairs to bring the property into compliance with health, safety and building codes withln a spec1.fied period of time. The Franchise Tax Board is required to deny income tax deductions to owners of these properties until the regulatory agency determines that the substandard housing has been brought into compliance. The statute also requires that a report be filed by each regulatory agency with l.ts local legislative body by July 1 of each year, advising of the status of enforcement activities initiated under this program during the prior calendar year. This is the tenth 6-b - 1 - ..,. ~ , .. -.I. ~...' ~- ; . , - ---- annual report filed regarding Santa Monica's housing code enforcement activities. The Building and Safety Division staff reviewed the City's records of rental housing code complaints and enforcement activities during 1992. Table 1 presents the information for calendar year 1992 on Section 17274 compliance activities for Santa Monica in the specific lanquage and format required by the state statute. For 1992, a total of nine substandard housing complaints were filed of which two are still unresolved and being processed by the Building & Safety Division and City Attorney's Office. BUDGET/FINANCIAL IMPACT There is no budget or financial impact related to the filing of this report. RECOMMENDATION Staff recommends that the City Council receive and file this report as the calendar year 1992 report required by Revenue and Taxation Code Section 17274 for Santa Monica.
