Streets In Conjunction With the 1990-91 Street Resurfacing Program
Introduction
This report recommends that City Council set a public hearing for April 14,
1992 to hear protes ts regarding the completed work and to confirm the
assessment of costs for the construction of concrete gutters, street
resurfacing, the repair of damaged sidewalks, driveways and curbs, and the
removal of hazardous pavement in parkway areas, on various City streets. These
improvements were completed with the 1990-91 street resurfacing program
Background
On May 28, 1991 City Council approved the formation of an assessment district
for the construction of concrete gutters, street resurfacing, the repair of
damaged sidewalks, driveways and curbs, and the removal of hazardous pavement
in parkway areas in conjunction with the 1990-91 street resurfacing program

On June 21, 1991, notices of the public hearing were posted and mailed in
accordance with State law, to all affected property owners. The public hearing
was held on July 9, 1991. After closing the public hearing, Council ordered
the work to commence
The street resurfacing, curb, gutter, sidewalk, driveway and parkway work was
completed as part of an annual street improvement project and the property
owner assessments are now due. A public hearing to confirm the assessment of
costs must be held pursuant to Section 5882 of the California Streets and
Highways Code. The attached resolution sets the public hearing for 7 30 p m.
on April 14, 1992. All affected property owners will be notified of the public
hearing date and the assessment amount fifteen days prior to the public
hearing A list of property owners and assessments amounts will be available
to Council at the time of the public hearing

Residential properties are not assessed for gutter construction or street
resurfacing. Commercial and industrial property owners will be assessed the
full cost for the construction of the gutters and the street resurfacing
fronting their property. The proposed assessments are des igned so that each
commercial and industrial property owner will pay the same unit cost regardless

of the width of the street on which their property fronts Consistent with the
present policy for assessing commercial and industrial properties, this
assessment will be a cash assessment and no bonds will be issued. For a
commercial or industrial property owner with a 50 foot lot, the total estimated
assessment would be $450.00 for resurfacing, and $575.00 for gutters, if
gutters are to be constructed on that location
Sidewalks, driveways and curbs, if damaged, were replaced and hazardous parkway
pavings removed, but not replaced. Property owners were assessed 100% of the
costs An exception to the above were areas damaged by parkway tree roots, in
which case the residential property owner was assessed only 50% of the costs
and the City paid the balance
Budget/Financial Impact
It is calculated that $125,813 will be generated from property owner
assessments for gutter construction and street resurfacing Revenues will be
deposited in Account No 01-500-401-00000-0124-10000, "Street Resurfacing
Assessment" Additional revenues in the amount of $27,245 will be generated
from the repair of sidewalks, driveways and curbs, and the removal of pavement
in parkway areas which will be deposited in Account No.
01-500-481-00000-0179-10000, "Sidewalk Repair Revenue" Any unpaid assessments
will be put on the 1992-93 property tax roll by the Los Angeles County
Assessor's office.

Recommendation
It is recommended that City Council adopt the attached resolution setting a
public hearing on April 14, 1992, to confirm the assessment of costs for gutter
construction, street resurfacing, and the repair of damaged sidewalks,
driveways and curbs, and the removal of hazardous pavement in parkway areas on
the above-mentioned streets.

SECTION 2 Pursuant to Sect10n 5870 et seq of said Code, the City
Council does hereby order and declare that on the 24th of March, 1992, at 7 30
p m., in the City Council Chambers of City Hall, it will hear and pass upon
the report by the Superintendent of Streets, of the cost of 1mprovements
together with any obJect10ns or protests, if any, which may be raised by any
property owner liable to be assessed for the cost of such improvements and any
other interested persons
SECTION 3 All protests or objections must be in writing and filed
with the City Clerk on or before the time set for the hearing of the protests
and objections
SECTION 4 The Superintendent of Streets is hereby directed to maLl
not1ces, 1n the manner and form prescribed by law, of the cost of improvements
and of the adoption of this Resolution to all persons owning commercial,
industr1al or resident1al real property 1n the hereinbefore described
assessment district whose names and addresses appear on the last equalized
assessment roll for the City taxes or as known to the City Clerk
SECTION 5 The City Clerk is directed to publish this Resolut1on in
