SUBJECT: Recommendation to Adopt a Resolution to Set a April 7,
1992 Public Hearing to Hear Protests Regarding the
Weed Abatement Program
Introduction .
This report requests that the City Council adopt a Resolution of
Intention declaring weeds and rubbish on vacant lots, improved
lots, parkways, sidewalks, and dirt upon sidewalks to be a public
nuisance and to set an April 7, 1992 public hearing to hear
protests, if any.
Background
The annual weed and rubbish abatement program has been in
operation for many years in accordance with the provisions of
Chapter 13, Section 39500 to 39588, Title 4 of the California
Government Code. Approximately 291 lots will be cleaned during
the weed and rubbish abatement. Of these lots, 273 are privately
owned and will be posted, and 18 are City owned. These lots were
selected for inclusion in the weed for inclusion in the weed
abatement contract based on the street Inspector's citywide
inspection of lots. The estimated cost for this work is $67,200
which includes a contract amount of $60,000 and an administrative
charge of $7200.00 (12%) for administrative
costs including inspection, supplies, and clerical support.

The city is reimbursed for both contract and administrative costs
incurred on private property for this program through property
assessments.
When the weed abatement work is done by a contractor hired by the
City, the costs are assessed against the property and collected
through the property tax bills by the County Assessor on the
city's behalf. If the property owner chooses to do the work,
there is no assessment against the property. While the state
Government Code requires only that the property owner be notified
of the necessary work by posting the lot, the City has instituted
procedures to notify property owners by mail that it is necessary
to clear the lots of weeds and rubbish. This notification
ensures that non-resident property owners receive notification
and are allowed sufficient time to clear their own lots.
BUdget/Financial Impact
Appropriation authority for the issuance of the weed abatement
contract to a maximum of $67,200.00 is in street Maintenance
Account No. 01-500-421-00000-6642-00000. Appropriation for
additional funds will be requested at the time the contract for
weed abatement work is awarded, if necessary. Revenues will be
received in FY 1992-93 through assessments which will be on the
December 1992/April 1993 tax bills.
Recommendation
It is recommended that the City council:
1. Adopt the attached Resolution of Intention which declares

2. Set a April 7, 1992 public hearing to hear protests.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA DECLARING CERTAIN WEEDS
GROWING UPON CERTAIN LANDS WITHIN THE CITY
OF SANTA MONICA TO BE A PUBLIC NUISANCE
WHEREAS, there are weeds growing upon the streets,
sidewalks, and certain lots in the city of Santa Monica, which
bear seeds of a wingy or downy nature or attain such a large
growth as to become a fire menace when dry, or are otherwise
noxious and dangerous to the public health and welfare; and
WHEREAS, there are accumulations of rubbish, refuse,
and dirt upon certain streets, sidewalks, and lots in the City of
Santa Monica which are hazardous or dangerous to the public
health and welfare,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA RESOLVES AS FOLLOWS:
SECTION 1. That all weeds growing upon the streets,
sidewalks, or certain lots in the City of Santa Monica, which
bear seeds of a wingy or downy nature or attain such a large
growth as to become a fire menace when dry or which are otherwise
noxious or dangerous, are hereby declared to be a pUblic
nuisance.
SECTION 2. That all rubbish, refuse, and dirt
accumulated upon streets, sidewalks, or lots in the city of Santa
Monica are hereby declared to be a public nuisance.
SECTION 3. That a public hearing shall be set for
April 7, 1992, at 7:30 p.m. in the city Council Chambers of City
Hall, to hear any protests in regard to this Resolution.

SECTION 4. That the names of the streets and
description of the properties in the City of Santa Monica upon
'!.vhich or in front of which said nuisa~ces exist are attached to
this Resolution.
SECTION 5. That the Street Superintendent be, and
hereby is, authorized and directed to cause to be conspicuously
posted in front of the properties on which or in front of which
the hereinabove described nuisances exist, a notice in the form
and in the manner pursuant to the powers and authority contained
in sections 39560 through 39586 of the California Government
Code.
SECTION 6. The city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
