(Attachmen# E} The study mvolved f~eld observations from 7 30am to 5 OOpm on Wednesday, Aprif 16, 1997 to pro~ide an assessm~nt of the vehicular-pedestrian conflicts at the driveway and #he mer~ts of a dr~veway elos~re The~ car~clus~on of th~ study ~nd~cated that a relat~vely low number of vehicles use the Fourteenth Street driveway with a mm~maf number of veh~cular- p~destrran con#ficts and that accEdent data mdreates that no accEdents t~a~e accurred over the past four years ta ~ehicles or pedES#r~ar~s at the driveway The consultants also concur with the applicantlappellant that the closcare Parking and Traffic Engineer has re~iewed the operat~onal traffic study prepared by Kaku Associates and concurs with the conclusian that clasure of the Fourteenth Street 4 dr+~eway cauld result in some hazardous traff~c conditions The Parking and Traffic Engineer also cancludes that the data inciicate few pedestrEanlvehECle canfl~cts at the dri~eway ~ocafion and that the closure of the Fourt~enth Street dri~eway has the ~otential to encourage dr~uers to cross #he eastboUnd lanes of P~co Ba~levard and ~ncrease fraffic circulation in the ad~acent neighborhood from vehECles circling the block in order to proceed westbound The analysis by the Parking and Traffic Engir~eer indicates that the ~oUrteenth Street dr~veway can safely operate given the modest ~olume of traffic nor#hbaund an Faurteenth Street and the {evel of service at the intersect~on (Level af Service B) However, there are concerns regarding left-hand turns enter~ng and exiting the Fourteenth Street drrveway g~ven ~ts praximrty to the Ptco Boule~ard intersec#ron Whrle the del~neators originally proposed are effective in prohibiting left-tur~ vehicle movements, these fixtures are unsitely and require frequer~t repair and replacement As an alternat~ve to the delir~eators, the Parking and Traffic Engineer has recommended redesigning the Fourteer~th Street driveway to ~nstall a triangular-shaped channelizat~on island This redesign would allow right-turn vehicle movements but wauld prohibat left-turns entermg and exiting the sGfe af this Iocation By allow~ng r~ght turns out of the s~te on to Fourteenth Street, veh~cles w~l! be ab~e to praceed west on P~ca Boulevard without c~rcling ~nto the residential r~eighborhood or crass~ng multiple lanes of traffic on Pico Boule~ard Planrnng staff believes this design resolves the Plannfr~g Commission concerns regarc{ing traffic overtlaw ir~to the neighborhood and that, given the site's history, concerns regarding vehicularlpedestrian confiicts are unwarranted Condit~on #24 has been modified to reflect th~s recommendatian 5 BUDGETIFINANCIAL IMPAGT The recommendation presented ~n #his report does not have any budget or fiscal ~mpacts STAFF RECOMMENDAT~ON It ~s recommer~ded that the City Council a~erturn the determir~ation of the Planning Comm~ss~an, uphold the appeal and approve CUP 96-023 based upan the followmg findings and cand~tions wh~ch incEude the mod~fcation of Condition #24 regarding retention ar~d redes~gn of tl~e Fou~eentYr Stre~t dr~veway as d~scussed ~r~ #he Appeal Analysrs section of this staff report CONDITIONAL USE PERMIT FINDINGS The proposed convenience store and fas#-food uses are cond~t~onally permitted wjthin the sub~ect distric# and comply with ali af the appl~cable provisions of the "City of Santa Mon~ca Compreher~s~~e Land Use and Zon~ng Ordinance," m that self- service gas stations w~th con~en~ence stores and fast-foad restaurants are cond~t~onally permst#ed w~thin the C2 Zonmg D~str~ct 2 The proposed con~enience store and fast-food uses wauld not impair the integrity and character of the ciistr~ct in which they are to be ~stabhshed or lacateci, in fhat the C2 D~str~ct aflows a range of neighborhood-senr~ng cammercial uses, including self-serv~ce gas stations, con~enience stores and fast-faad restaurants 3 The sub~ect parcel is phys~cally su~table for the type af land use being proposed, m that t~e exis#ing building w~ll not be expanded m size, the sub~ect praperty is nearly double the m~nimum size required for a selfi-service gas station with a convenience store and is over two and one-half times the minimum required size for a fast-food restaurant, and ts a graded parcel with aclequate ~ehict~iar access 4 The proposed uses are compat~ble with the land uses presently an the sub~ect parcel, ~n that the s~te is currently occu~~ed by a smafl food mart w~th~n a self- service gas stat~on and the expansion of tf~e conven~ence store and the addition of a#ast-food restaurant are compatible with these on-site uses 6 5 The praposed uses are compat~ble with existing and perm~ssible land u~es wjth~n tt~e dEStrrct ar~d tne generaf area ~n which t~s proposed uses are to be loca#ed, ~n that a self-service gas station w~th a mini-market and a fast food restaurant are conditianally permjtted in the C2 Zoning Distr~ct, and such uses pro~ide a con~en~ent sernce for local res~dents whjch ~s cor~sistent w~th the purpose af the C2 Distr~ct fi There are adeguate prov~sions for w~ter, san~tation, and public util~ties and servECes to ensure that th~ proposed uses wauld not be detrimental to pubVic health and safety, ~n that tne proposed pro}ect ut~l~zes ex~st~ng square footage to accommodate an expansaon o# an existing food mart ar~d a new fast-food establishment requiring a m~nimal increase in the need for publ~c ut~lities 7 Public access ta the prapased use will be adequate, ~n that ~eh~cular ingress and egress -rvff! be provided from P~co Boulevard and Faurteer+t~ Stree# and pedestrian access is pro~Eded from bo#h P~ca Baufevard and Fourteenth Street ta the walk-up fast-food window and the conven~ence store and that a b~cycls rack with four (4~ bkc~cle parkmg spaces is pro~ided 8 The physrcal locat~on or placement of t~e uses c~n the s~te ~s compatibie wa#~ a~d relates harmoniously to the surrounding ne~ghborF~ood, in that the propvsed project wiil pro~ide a seif-ser~ice gas station, conve~~ence store and fast-faod restaurant wh~c~ wi{1 serve t~e Emmediate residential neighborhood as well as the nearby busmesses and institutions including the Y W C A located ad~acent to the sub~ect property and Sar~ta Man~ca Coi~ege located two blacks to k~e east Substant~al landscapmg ~s proposed which w~il buffer the proposed uses on site from the ad~acent iand uses 9 The proposed use is consisten# with the goais, ab~ectives, and polic~es of the Generai PEan, in fhat it ~s consistent w~#h Land Use and Circu~ation Element Ob~~ctive #1 7 which states that the City shall "Protect and expand uses that provide for the day-to-day shopp~ng and s~rv~ce needs of nearby residents," and that "The City shall er~coura~e the prov~s~or~ ot ne~ghborhood commercra~ sernces w~thm walkir~g distance of all ne~ghborhoads " The proposed pro~ect pravades a serv~ce statian which serves, in part, the day to day veF~icular needs of tF~e nearby community, a canvenience store ar~d fast-fovd restaurant are provtded in a walkable, con~enient location for nearby residents 10 The praposed use would nat be detr~mental to the public interest, health, safety, conven~ence, ar generai wekfare, ~n that serv~ce stat~on, convenience store and fast- food restaurant operab~ns are canditionally perm~tted within the C2 Zoning Distnct and are in compliance, as approved, with the applicable standards and special cond~trans cor~ta~ned m Subchapter 9 04 14 af the City of Sar~ta Mon~ca Comprehensive Land Use and Z4ning Ord~narrce ar~d that the ~roposed pro~ect ~ invol~es the expansian Qf an existing food mart w~thin #he service statian and a fast- food restaurant operation which as conditioned with limited aperatmg ho~rs and landscaping and screenEng walls to buffer the use from ad~acent residential and institutional uses, is compatible with the ad~acent res~dent~al, bus~ness and ~nstitutEOnai us~s ~n the area 11.
