SUBJECT: Annual Report on Compliance with Callforma Revenue and Taxation Code
Section 17274 Regarding Rental Housing Code Enforcement for Calendar
Year 1996
INTRODUCTION
This report presents the rental housing code enforcement activities of the BUilding and
Safety DIvIsion for 1996 and recommends that the City Council accept and file this report
DISCUSSION
Section 17274 of the Callforma Revenue and Tax Code requires that regulatory agencies
report to the Franchise Tax Board the names and addresses of the owners of substandard
rental hOUSing In the City who fall to make necessary repairs to bring the property Into
compliance with health, safety and bUilding codes within a specified penod of time The
Franchise Tax Board IS required to deny Income tax deductions to owners of these
properties until the regulatory agency determines that the substandard hOUSing has been
brought Into compliance The Code also requires that a report be filed by each regulatory
agency with ItS local legislative body by July 1 of each year, adVISing of the status of

The BUilding and Safety DIvIsion staff reviewed the City's records of rental housing code
complaints and enforcement actiVities dUring calendar year 1996 The required Information
IS presented In Table 1 A total of 196 substandard housmg type complaints were filed with
the City In 1996 Of the 196 complaints, 107 were written notices of violation for
substandard dwellings, eighty-nine were Investigated and found not to be In violation SIX
cases remain unresolved and are being processed by the City Attorney's office and
BUilding and Safety staff

There are no budget or finanCial Impacts related to the filing of this report

It IS recommended that the City CounCil receive and file this 1996 report reqUired by
Revenue and Taxation Code Section 17274
