Introductior~
At fts meeting on July 8, 1997, the City Cour~c~l directed the C~ty Attorney to prepar~ an
ofdinance establ~shmg a preferer~tial parkmg zone on 22nd Street between Califo~-nia
A~enue and Washington Avenu~ In response to this direction, the accornpanying
ordmance has been prep~red and is presented tv the City Council for Ets cor~s~deration

The accompanying ordinance adds Section 3 08 510 #o the San#a Monica Mun~cipal
Code establishing Preferent~al Parking ~one MM on 22nd S#reet between Cai~fom~a
Avenue and Washmgton Avenue Parking m Zone MM will be prohibited for more than
two hours between the haurs of 9 DO a m and 9 00 p m, daily, except by permit The
parking restrictions for this zone will be consistent with existing Zone O on 21 st and
22nd Streets between Wilshire Bo~levard and Cal~fornia Avenue All other pro~isions
appficable ta pref~ren#aal parking zones would apply

TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE MM
WHEREAS, the Parkmg and Traffic Engineer has received a petition requestmg
establishrnent of a preferentiai park~ng xo~e on 22nd Street between California A~enue
and Washington Avenue, and
WHEREAS, the petition has been verifEed ta be signed by reside~#s li~mg En
two-th~rds of the dwelling units comprising not less tF~an fifty percent (50°~) of the
developed frantage of #he propased preferential parking zone, and
WHEREAS, the Parking and Traffic Engmeer has undertaken s~ch studies and
surveys deemed necessary #o determine whether a preferential park~ng zone should be
des~gnated in the area, and
WHEREAS, #he City Cour~cil is sat~sfied that the proposed area meets the
des~gnation cnter~a set fiorth in Municipal Code Sectior~ 3 08 040,
NOW, THEREFORE, THE CITY GOUNCiL OF THE CfTY ~F SANTA MONICA
DOES flRDAIN AS FOLLOWS

read as follows

(a) The follawing named and described area within
the City shall constitute Preferential Parking Zone MM 22nd
Street between California Aver~ue and Wash~ngton Avenue
(b} No ~ehicle shall be parked or stapped ad~acent
to any curb in Preferential Park~ng Zon~ MM for more than two
(2) hours between the hours of 9 00 a m and 9 00 p m, da~ly,
withou# a permit issued and cf~splayed ~n accordance with this
Chapter
(c) Any vehide parked or stopped without a permit
when required by this Section may be removed from the street
by any ~olice officer
(d} The annual f~e far each permit issued for
Prefierential Parking Zone MM shall be $15 4fl per perm~#, or
suct~ other fee as may be sstabf~shed from ttime to time by
resolutian of tt~e City CounciE
SECTION 2 Any pravision of the Santa Mon~ca Municipal Code or appendices
thereta ~nconsistent wEth the pro~isions of this Ord~r~ance, to the extent of such

~nconsistencies and no further, are hereby repealed or madified to that exter~t necessary
to affect the pra~isions of this Ordinance
SECTION 3 If any section, subsection, sentence, clause, ar phrase af this
Ordinance is for any reason held to be invalid or unconstitutional by a decision af any caurt
of any competent ~urisdiction, such dec~s~on shalf not affect t~e ~alid~ty of the remainmg
partions o# tnis Ordinance The City Council hereby declares that it would have passed th~s
Ordinance, and each and every sectron, subsection, sentence, clause, or phrase not
declared ~nvahd or unconstitu#aonal without regard ta whether ar~y p~rtion of the Ordinance

SECTIQN 4 The Mayar shall sign and the Cfty Clerk shall attest to t~e passage of

WHEREAS, t~e Parking and Traffic Engmeer has received a pet~t~on requestmg
establisF~ment af a preferential park~r~g zone on 22nd Street betwesn Cal~fornia Avenue
and Wash~ngton Avenue, and
WHEREAS, the petition has been verif~ed to be signed by residents living in
twa-thirds of #he dwellmg ~nits com~t~sEng nat less than f~fty percent {5Q%) of the
developed frontage of the praposed preferential parking zone, and
WHEREAS, the Parking and Traff~c Engmeer has undertaken such studies and
surveys deemed necessary to determFne whether a preferential parkmg zone should be
designated ~n the area, and
WHEREAS, the CEty Council ~s sat~sf~ed that the proposed area meets the
designation cr~teria set ~orth in Municipal Cade Sectior~ 3 08 040,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA M4NICA
DOES ORDAIN AS FOLLOWS

SECTION 1 SectEOn 3 08 510 is added to the Santa Mvnica Mun~cipal Code to
read as follows
Section 3 DS ~1 Q Prefarential Parkina Zone MM
(a) The followmg named a~d described area within
the City shall constitute Prefersntial Parkmg Zane MM 22nd
Stree# between Cal~forn~a Avenue and WashEngton Avenue
{b} Na vehicle shall be ~arked or stopped ad~acent
to any curb ~n Preferential Parking Zone MM for more thar~ two
(2} haurs be~n-een the hours af 9 00 a m a~d 9 00 p m, daily,
without a permit issued and displayecf in accardance with this
Chapter
(c) Any veh~cle parked or stop~ed without a permit
when rec{uired by th~s Section may be removed from the street
by any police off~cer
(d) The annual fee for each perm~t issued for
P~eferent~al Park~r~g Zone MM shal~ be $~ 5 00 per per~mit, or
such other fee as may be established from time to time by
resolution af the City Counci!
SECT~ON 2 Any provtision of the Santa Mo~tica Munic~paf Code or append~ces
