Introduction
This report requests that the City Council accept petitions requesting the installation of new
street/rghts on the fol/owlng streets
23rd Street
29th Street
Lincoln Boulevard
Princeton Street
Prospect Avenue
Yale Street
- from Anzona Avenue to Wilshire Boulevard
- from Ocean Park Boulevard to Pearl Street
- from Montana Avenue to Alta Avenue
- from Wilshire Boulevard to Washmgton Avenue
- from Manne Street to the end of street (dead end)
- from Montana Avenue to Washington Avenue
The report also recommends that the City Council adopt the attached Resolution of
Intention to set public hearings for March 10, 1998, and April 14, 1998, at which the City
Will declare ItS IntentIon to assess property owners for costs and Issue bonds as security
for unpaid assessments on those streets In conformance with the Right to Vote on Taxes
Act (Proposition 218)
Backaround
In accordance with Santa MOnica MUniCipal Code 9704860, whenever 60% of the
occupants of the residential units In any area petition the City Council to institute

proceedings for reSidential streethghtmg, the CIty Council shall Institute those proceedings
under the Improvement Act of 1911 to provide residential streetllghtlng to such area
In 1995 and 1996, successfui petitions (those with greater than 60% support) were
receIved from these streets

Rent Control staff reviewed these petitions and determmed that they conform with Rent
Control Regulations for pass-through of assessments to tenants
These locations previously went through the prellmmary stages of the 1911 Act
assessment proceedings Public meetings were held between staff and affected property
owners and residents on December 10, 1995, and October 10, 1996, to discuss the
location of streetlights, types of streetlights available (decorative or standard) and
approXimate costs The residents of Yale and Pnnceton Streets opted for the more
expensIve decoratIve style streetlight, whIle the resIdents of Lincoln Boulevard, Prospect
Avenue, 23rd Street, and 29th Street opted for the standard streetlight The City CounCIl
approved the assessment dlstnct durrng the October 22, 1996 City CounCil meeting and
ordered the construction to begm Shortly thereafter, on November 5, 1996, Callforma
voters approved Proposition 218 The passage of Proposition 218 essentially Invalidated
the proceedings for thiS streetlight assessment district According to Proposition 218,

assessment dlstrrcts require two public hearrngs and eligible voters are able to vote, uSing
ballots, on the proposed assessment Eligible voters for reSidential properties are the
residents of the streets mcluded wlthm the assessment dlstrrct, either owners or renters
Eligible voters for non-residential properties are the owners of the properties The 1911
Improvement Act proceedings mcluded only one public heanng and elIgIble voters were
not given the opportunity to vote on the assessment ThiS staff report addresses the new
reqUirements of Proposition 218
In accordance with Proposition 218, an Engineer's Report was prepared which determined
the general and special benefits of streetlight Installation General benefits enhance the
public as a whole. while special benefits enhance a particular parcel A copy of thiS report
IS available In the office of the City Engineer and the office of the City Clerk According to
PropOSition 218. parcels may only be assessed for the special benefits or any portion
thereof The report reflects the Engineer's determination that the special benefit of
streetllg ht Installation IS 80% of the total benefit for residential properties and 81 % of the
total benefit for non-residentIal properties Consistent With recent City policy, assessments
Will be waived for non-profit organizatIons which can provide eVidence of receiVing a
welfare exemptIon from the Los Angeles County Tax Assessor The CIty WIll fund these
assessments
All properties are assessed for streetllghtlng based upon the parcel frontage and the
property's location relative to the street bemg Improved If the legal address of the
assessed parcells the on the street receiving streetlights, the parcel Will be assessed at

the front footage rate If the legal address of the parcells on the cross street of the street
receiving streetlights (I e some corner parcels), the parcel will be assessed at the side
footage rate I n accordance with past City policy, the proposed assessment spread for
standard style streetlIghts IS

These proposed assessment amounts are less than the special benefit cost of
streetllghtlng as Identified In the Engineer's report and are therefore In compliance with
Proposition 218
Notices of the City's Intent to form an assessment dlstrrct and hold a public hearing WIll be
mailed to affected eligible voters and published In The Outlook at least forty-five (45) days
In advance of the tIme and place of the public hearing In accordance with State law In
add Itlon to the notice, eligible voters WIll be sent a ballot by which they may vote for or
agamst the assessment A pass-through of the assessment to the tenants In conformance

with Rent Control RegulatIons will be permitted Eligible voters for non-residential
properties are the owners of the propertIes Ballots may be mailed to the City Clerk or
submitted In person before the end of the first public hearrng Ballots Will be tallied
proportIonal to the financIal obllgat/on of the affected property The results of the ballot
tally Will be presented to City Council at the second public heanng If a maJonty protest
eXists (50% + 1 negative vote), the assessments Will not be Imposed and the project Will
not be constructed If there IS a positive vote, the City Council may order the Improvement
work to begm after the close of the second public hearrng Competitive bids for the project
Will be soliCited by the City, and a contract Will be awarded by City Council to the lowest
responsible bidder Property owners may pay for the Improvements In full after
construction IS completed, or they may opt to pay the bond holder In installments over a
ten-year at an mterest rate of 8 5% The City Council must authOrize the sale of bonds
to accommodate Installment payments
These proceedmgs shall be conducted In accordance with the Right to Vote on Taxes Act
(Proposition 218) and the MUniCipal Improvement Act of 1911 (California Streets and

cost for this prOJect IS $382,342 15 and Includes labor and Incidental costs such as staff
tIme for englneerrng surveys, publIC notIficatIons, advertIsements, construction

management, Inspections, and construction costs The total assessment IS based on an
estimated cost of $32 00 per lineal foot for standard streetlights, multiplied by the total
lineal feet of property fronting the streets (both sides) petitioned for Improvement The
estimated prorated assessment for residential property owners IS $16 00 per Imeal foot of
property frontage, the City pays an equal amount The estimated prorated assessment for
non-residential property owners IS $25 60 per lineal foot of property frontage, the City pays
$6 40 per lineal foot of property frontage An additional charge of $6 00 per lineal foot IS
to be added to the above property owner assessment cost for streets that opted for the
decorative style streetlights (Yale Street and Princeton Street) The City does not
contribute any additional funding for the added cost of the decoratIve style streetlight
Federal Community Development Block Grant funds may be available to assist low-to-
moderate Income households with the costs of the streetlight assessment
The estimate for a tYPical residential property IS approximately $800 for standard
streetlights on a lot with a 50-foot frontage dimenSion The proposed breakdown of costs

property owner assessments. Assessments Will be paId upon completion of the work and
Will be held In a Trust Account No 80-000-000-00000-9750-04289 pending payment to the
contractor Bonds are Issued for any unpaid assessments Bond proceeds are paid to the
contractor or assignee, and the property owner(s) then reimburse the bond holder(s) over
time

Eligible voters may vote on whether the assessment district should be formed or
not. Eligible voters for reSidential properties are the reSidents of the streets Included wlthm
the assessment dlstrrct, either owners or renters Eligible voters for non-reSIdential
properties are the owners of the properties A ballot accompames thiS notice All ballots
must be returned to the City Clerk prior to the conclusion of the first public hearing.
The ballots Will be used to determme whether or not a "majority protest" eXists ThiS
determination Will be made by tabulatmg the ballots before the second public hearing In
tabulation, all ballots submitted Will be weighted according to the proportional financial
obligatIon of the affected property If a maJonty protest eXists (50% + 1 negative vote), the
assessments Will not be Imposed and the work Will not be done
If the dlstnct IS formed and assessments are Imposed, property owners Will have two
options for paymg the assessment after the construction IS complete and costs have been
confirmed First, there Will be a thirty day cash collection penod for collecting
assessments Second, an Installment payment plan to repay the assessment Will be
available Non-resident owners of controlled rental Units may pass through the cost of the
assessment m conformity with Rent Control Regulations

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SEITING PUBLIC HEARINGS FOR MARCH 10, 1998, AND
APRIL 14,1998, FOR THE PURPOSE OF DETERMINING WHETHER OR
NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
CONSTRUCTION OF STREETLlGHTING AND DECLARING ITS INTENTION
TO CONSTRUCT STREETLlGHTING ON VARIOUS CITY STREETS AS
SHOWN ON CITY DRAWING NO 10061 WITHIN THE CITY OF SANTA
MONICA
WHEREAS. the City Council of the City of Santa MOnica proposes to Initiate
proceedmgs under the Right to Vote on Taxes Act (Proposition 218), the MUnicIpal
Improvement Act of 1911, the Government Code, and the Santa MOnica MunIcipal Code
for new streetlight Installation on
23rd Street
29th Street
Lincoln Boulevard
Prrnceton Street
Prospect Avenue
Yale Street
- from Anzona Avenue to Wilshire Boulevard
- from Ocean Park Boulevard to Pearl Street
- from Montana Avenue to Alta Avenue
- from Wilshire Boulevard to Washington Avenue
- from Manne Street to the end of street (dead end)
- from Montana Avenue to Washington Avenue, and
WHEREAS, Section 19 of Article XVI of the CalIfornia Constitution prOVides that
certain speCified debt limItation and maJority protest prOVIsions shall not apply If, after the
gIving of reasonable notice by publication and posting and the holding of such public

heanng as the CJty Council of the City of Santa MonIca shall have prescribed, the CIty
Council by no less than four-fifths vote of all members thereof finds and determines that
the public convenience and necessIty require the proposed Improvements to be made, and
WHEREAS, Streets and Highways Code Section 2804 prOVides that the "Special
Assessment. Investigation, Limitation and Majority Protest Act of 1931" shall not apply to
any proceeding otherwise subject thereto when the Improvement proceeding IS held by a
charter city and the City has compiled With the prOVISions of SectIon 19 of Article XVI of the
Callforma Constitution I and
WHEREAS, the City of Santa Momca IS a charter City of the State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS
SECTION 1 The City CounCil proposes to Imtlate proceedings for the Installation
of streetllghtlng and appurtenant work on the streets shown on City Drawing No 10061
and generally known as FY 1995-96 (Phase VII) - Construction of High Pressure Sodium
streetlight systems on
23rd Street
29th Street
Lincoln Boulevard
Pnnceton Street
Prospect Avenue
Yale Street
- from Arizona Avenue to WilshIre Boulevard
- from Ocean Park Boulevard to Pearl Street

SECTION 2 The total estimated cost of the proposed Improvements IS
5382.342 15 The property owners' share of the cost IS estImated at $181,275 27
SECTION 3 Improvements shall be conducted under the Improvement Act of 1911,
which IS DIVISion 7 of the Streets and Highways Code of the State of California, the Right
to Vote on Taxes Act (ProposItion 218), and Section 704370 of the Santa MOnica
MUOIclpal Code
SECTION 4 Public meetings were held between City staff and Impacted property
owners and residents on December 10, 1995, and October 10, 1996, to discuss the
location of streetlights, types of streetlights (decorative versus standard) available and
approximate costs
SECTION 5 The proposed Improvements In the opinion of the City Council of the
City of Santa MOnica are of more than local or ordmary public benefit, and the City Council
hereby proposes that the dlstnct In the CIty of Santa MOnica to be benefitted by the
Improvements be assessed the costs of the Improvements as hereinafter provided For
standard style streethghts, reSidentIal properties shall be assessed at approxImately $1600
per foot of footage with the City contributing an equal amount, and non-residential property
owners shall be assessed $25 60 per foot of frontage with the City contributing $6 40 per
foot of frontage For decorative style streetlights on Yale Street and Prrnceton Street,
reSidential properties shall be assessed approximately $22 00 per foot of frontage With the

City contnbutmg 516 00 per foot of frontage, and non-reSidentIal property owners shall be
assessed 531 60 per foot of frontage with the City contnbutlng $6 40 per foot of frontage
The district IS shown upon a map mdlcatlng the exterior boundary thereof known as
Drawing No 10061-A, whIch IS on file In the Office ofthe City Engineer The assessment
dIstrict Includes In general the lots and parcels described In Section 1 above, but reference
hereby IS made to Drawing No 1 0061-A for all details as to the extent of the assessment
district and for any vanatlon between the last mentioned general description and the extent
of the assessment district as shown on the map All publrc streets or alleys, or portIons
thereof, hereby are excepted from the district
SECTION 6 Parcels owned by non-profit organizatIOns which can demonstrate that
the organization receives a welfare exemptIon from the Los Angeles County Assessor shall
be exempt from this assessment
SECTION 7 The City Will pay a portIon of the costs and expenses of the work
described herem, and the City Controller IS authOrized and directed to pay the same
Immediately upon confirmation of the assessment by the City CounCil
SECTION 8 Serial bonds beanng Interest at the rate B 5% per annum shall be
Issued to represent each assessment of One Hundred Fifty Dollars ($15000) or more
remaining unpaid for thirty (30) days after the recordmg of the warrant Each senal bond

shall extend over a penod ending nine (9) years from the second day of January next
succeeding the next September 1 st following Its date Payments on the principal of unpaid
assessments and Interest shall be made by property owners to the City Treasurer and the
same shall be disbursed by him/her or as provided In the "Improvement Act of 191111
hereinafter referred to In accordance wIth Streets and Highways Code SectIon 6442. the
first two percent (2%) delinquency penalty authonzed by such section may be retained by
the City Controller as the cost of servIcing the delinquency. ThIs bond may be redeemed
by the owner or any person Interested In any lot or parcel of land described herein, at any
time before matunty and before commencement of proceedings for sale, upon payment
to the Treasurer for the holder of this bond of the amount then unpaid on the principal sum,
together with a premium of five (5) percent of said unmatured principal thereof with Interest
thereon (If not previously paid) up to the next succeeding January 2 or July 2, as the case
may be, at the rate named In this bond, and all penalties accrued and unpaid
SECTION 9 NotIce IS hereby given that on Tuesday, March 10, 1998, and
Tuesday, Apnl14, 1998, at 630 P.M., In the City CouncIl Chambers located In City HaU,
1685 Main Street, Santa MOnica, Califorma, there shall be public heanngs before the City
Council for the purpose of determining whether the public conveOlence and necessll
require the above-described Improvements and for the purpose of allowmg any and;
persons haVing any objections to the proposed work or improvements to appear and sh,
cause why the proposed work or Improvements should not be carned out in accorda

with this Resolution of Intention InqUlnes concerning the public hearings should be
directed to the Department of Environmental and Public Works Management, DIvIsion of
Engineering. at 458-8727
SECTION 10 The City Clerk shall gIve notIce of the heaflngs by publicatIon as
hereinafter proVided Any Interested person may file a protest against the proposed work
or Improvements in wntlng wIth the City Clerk at any tIme not later than the hour set for the
first public heanng In the manner set forth In the Streets and HIghways Code Section 5220
Eligible voters may also vote on the assessment dlstnct by submIttIng ballots before the
close of the first public heanng. Eligible voters for assessed resIdentIal propertIes are the
reSidents. whether owners or renters, of the streets included within the assessment dIstrict.
Non~resldent owners of controlled rental umts may pass through the cost of the
assessment to tenants In conformance with Rent Control Regulations Eligible voters for
non-reSidential properties are the owners of the properties.
SECTION 11 City Staff is directed to mall notIces and ballots. pursuant to
;overnment Code Section 54954 6 and the RIght to Vote on Taxes Act, In the manner and
rm prescribed by law, upon the adoption of thIS Resolution to all eligible voters In the
"elnbefore described assessment dlstnct. whose names and/or addresses appear on the
equalized assessment roll for the City taxes or are known to the office of the City

Engineer City staff IS directed to mall notIces but not ballots to any owners of reSidentIal
propertIes that are not resIdents of the streets within the assessment dIstrict
SECTION 12 The City Clerk hereby IS directed to publish this Resolution, In
accordance with Government Code Section 6063, In The Outlook, once a week for three
succeSSive weeks, with at least five days Intervening between the respective publication
dates, not counting the first day of publication and terminates at the end of the twenty-first
day, Including thereIn the first date The first publicatIon IS to be made not less than forty-
five (45) days prior to the date of the above public heanng
SECTION 13 Pursuant to Public Contract Code Section 20433, the City Council
hereby states that the property owners may not contract for the Improvements and that the
CIty shall be responsible for letting and admlnlstenng the construction contract for this
dlstrrct
SECTION 14 The City hereby declares that Community Development Block
Grant (CDBG) funds may be applied for payment of assessments on property owned by
low-fe-moderate Income households

SECTION 15 The City Clerk shall certify to the adoptron of this ResolutIon, and
thereafter the same shall be In full force and effect
